Public Comments & Testimony

- Grant Bargain Sale Agreements: Travis reported that the city attorney confirmed no additional agenda item was needed for the grant bargain sale agreements with the Dixie Levitt trust, as they were already addressed in prior development agreements and council approvals.
- Staff Comments on Bids: Staff announced apparent low bids for two projects: the traffic signal project had five bidders with bids ranging from $1.2 million to $1.7 million; the mill and overlay project had four bidders with bids ranging from $6.6 million to $10.4 million. Good afternoon, everyone, and welcome to the Tuesday, September 16th mesquite uh city mesquite technical review meeting. It's 2 30. Um, we're gonna start with opening public comment. You have three minutes, please come forward. Hello, Mayor Whipple and the City Council. Um, for the record, my name is Raylan Schiffano, Nordic Beach properties uh director. Today I stand here and ask you to table all mesquite vistas, annexations and subdivisions until the courts resolve the litigation between mesquite vistas master association versus Nordic Beach. Proceeding now risk entangling the city in disputes about subdivisions and annexations that remain unsettled in the courts at the last meeting. As exhibit A. Exhibit A does not have any of the properties that for the Aleve subdivision, the Hardy Ways, or the Hilltop Vistas subject, nor does it have for the Red Hills and a few other properties. It's not even in the expandable area, which is exhibit B. As you can tell, exhibit B is the description of the annexable area. We are asking when these governing documents were amended, because that takes a 67% vote of the people to amend these governing documents to add an expandable area. Now, the final map may have been done, a site plan, but there's nothing recorded in our governing documents that allow for this. Mr. Anderson states there's all kinds of changes, annexes in and out, but nobody can tell us what has been annexed in and what has been de-annexed from the properties. The members have a right to know. He said that these are legal real estate, complicated decisions. Yet at the end of the meeting, he says, go ahead, approve it. You we need to slow down, and I'm asking you to add this back on the agenda so that the public knows that there takes a vote, that there is a process to amend the governing documents, that the city is overstepping its bound when it's allowing for annexation that requires a vote of the people. It may even require a vote of 75% of the mortgage holders, the FHA. There's so many legal questions we have, and again, we are in court with mesquite vistas for annexation and subdivisions. We've had the land surveyor that did all this admit under oath in a deposition that he didn't do it correctly, that he didn't annex in the property correctly. So we know more than the city does, and we're asking you to slow down, put it back on the agenda. Let's halt all subdivisions and annexations until this gets to the courts and gets fit finalized so that the city doesn't jeopardize future homeowners, future consumers. What about consumer protections? We're selling people into something, a lawsuit. If the lawsuit is in our favor, it's gonna cost those homeowners a lot of money. So I'm just asking you not to add any more to the annex or two annex or subdivisions until these final maps are figured out and disclosed by the city to us. Thank you. Thank you, Rayleigh.
