We're gonna get started.

And we're gonna start with our opening public comment.

Mayor, members of council, thank you very much.

I have a uh technical question really.

Uh earlier there was an agenda item that was to me a competing interest in that parcel property at the late in the agenda here.

Has that been removed?

The first I don't see it on the agenda is why I'm asking.

Seems like it was there previously, but so six six point nine isn't and six ten.

Yes, 6.9 and 610.

And are they still two competing interests in that parcel?

Yes.

And that's what I'm looking at here.

Hello, Mayor Whipple and City Council for the record, my name is Railine Schiffano.

Um, I'm here today to request that the city council open a formal review into the September 2nd uh 2025 verification letter issued by Mr.

Simon Kim.

Um this letter is issued privately and without public notice.

It declares that the 2011 conditional use permit CUP 11001 for the MV Night Club remains valid and unrestricted.

Yet this correspondence was not the result of a public hearing inspection or council action.

It was simply a response.

You guys can see it.

Um a response uh to a personal request by Mr.

Seitz.

What makes this particular concerning is that as of July 31st, 2025, Mr.

Sites no longer holds voting rights within the Red Hills Association.

The association board determined that the his parcel was not on not on the final map, which Travis and I had that discussion.

The final map does not show 4C2 or 3D two.

So the association voted them out of the association with no voting rights because their two properties were not on this final map.

He is no longer an owner in Red Hills on the map.

He doesn't have any easement rights, he doesn't have any membership rights, and yet the city, Mr.

Kim is giving him a special letter to say that he has parking rights, which the parking rights are to be debated not by the city council or the city, but by the CC and Rs.

If Mr.

Sites thinks that he has the right to have reciprocal parking, his place is in civil court.

The only duty the city has is to enforce the parking code, which there's no parking variances, no waivers.

The 2005 site plan was never re never approved.

There's no parking studies.

The Red Hills is supposed to have 898 parking spots.

We have 524.

Even if they went by the 2005 site plan, it's a hundred parking spots short.

Mr.

Seitz is trying to sell his property now.

So he's gonna sell it to the next victim, the next person that's gonna have to deal with the same issues.

And the city is colluding with him to help him do that.

And that is where we have a problem with it.

Um, we've asked for this to be put on a public agenda so that we can both, if Mr.

Kim can give his why he feels the city coasts don't have to be followed, and we can respond with the same equal amount of time, not trying to rush it in a three-minute thing.

Um, but we are asking for this to be put on the agenda so that we can have this discussion so that we can deal with this parking code violation that the city is continuing to allow, which is affecting our property and business rights.

Um typically, if it's something of a positive nature towards the city, I will allow extra time.

I believe if you don't have any solutions to the problems, you're part of the problem.

What I'm gonna read to you is nothing negative.

It's my idea of what we could do to make the city council meetings and the city more uh productive.

Because right now, all you guys do is get a bunch of us up here yelling at you every time.

I don't know how you sit up there and don't throw rocks at us, but notice that we still have my uh oh, hey, whoa, whoa.

Oh I bruise easy, I'm old.

Uh and I may get it done in three minutes, and I may not.

So I got a 50-50 chance in.

Um these are both related to there's two of them.

They're both related to John Deere.

So we're finally ready.

I think we're really good at this point now with those two parcels.

So um 201, they've gone past their due diligence period, so I have I just have to put an addendum on there to extend the due diligence period because they were hoping to lump all that together, the 12 acres and the 34 acres and excavate it all.

And so anyway, it's just uh extending the due diligence period on 201 Deere.

That's the first one.

So it's just a one-page one sentence.

That's for the 34 acres, right?

Yes, and then the other one, the 200.

You've already looked at the contract before and we tabled it, but um, I'm bringing it back, and he they tweaked it, so they lowered the real estate commission to two and a half from three, and uh they tightened the criteria for actually purchasing the property.

They've been working really well with Adam, and so I think it's in a really good place.

So it's basically almost the same contract, but really tightened up.

So I think all of it's gonna work really well together.

So the second item is the 200 John Deere, the 12 acres contract.

Um, so we will need to have public comment.

Yeah, so I I mentioned the mayor previously that just reviewing the city code and other requirements, and we're we're adjusting to this new way that we're doing tech review, but when there's a motion to add something or remove, we should allow for public comment on just that specific motion.

So if there's a motion made, we just want to make sure there's a chance for public comment on that specific motion, and then the council can vote afterwards.

Let's start with the first one 2020.

To be a motion so that so that they know the topic of what they're gonna be commenting on and then so 201 deere, the 34 acres extending the due diligence period.

If I can, I just wanted to give a quick update.

You can uh just I'll try to do these uh quick updates at the staff review and then also um weekly emails as we were gonna have a lot of projects going on right now.

So uh as you've seen Las Vegas Paving has started the ADA ramp removal and reconstruction on Sand Hill.

That project goes all the way sandhill musquite boulevard.

Um they started Monday and they're just going gangbusters, it's going really well.

Um this is also separated from our mill and fill project, which is mesquite um boulevard and sandhill boulevard.

And Thursday, I have a meeting with the contractor to do a pre-construction meeting to where we set the start dates and just go through everything with that.

I have sent out a letter to all the property and business owners along Sand Hill and Mesquite Boulevard to let them know at first when we were originally planning this, we wanted to have this project as night work.

However, it came to my attention that now with the prevailing wage rates, there's the union CBA's collective bargaining agreements are in that.

And for asphalt and rotomill operations, anything that is worked past five and before six is time and a half.

So that would have moved our six million dollar job to a nine million dollar job.

And so unfortunately, this will be a daytime work.

Um, but we've tried to mitigate that as best we can in this uh what we've stated is that they'll be removing five inches of asphalt, but they have to um replace the three-inch base course that same day.

So they'll be opening up small sections, putting back the three inches, and then they'll get so far, and then they'll put the top two inches in one so that we don't have a whole bunch of seams going down through the boulevard.

Um, and that will help cap that.

Um, but I did send out letters to all the property and business owners.

We're gonna have three week schedules ahead of time to where I can try to keep all of the businesses aware that hey, this day you're maybe limited access on that.

So um trying to get ahead of it and to keep those.

I wanted to try to do uh each Tuesday just a quick summary of where we're at along with emails to you and I'll be putting it on the website as well.

Um the traffic signal project.

We also have um pre-construction meeting on Monday for that to start that project, and then um the Hafen and Levitt Lane, we have a pre-construction meeting next Thursday, the 16th.

Um, we do also have the Canyon Crest and Horizon job out for bid right now.

That will be bid on November 4th, and so we'll be going on that.

But um, if you do have any questions or people come to you on questions on the boulevard, please feel free to contact me.

I'll get a hold of them immediately.

It's one of those that uh we will feel a little bit of inconvenience on that, but we're gonna try to make it as least inconvenient as possible.

But I do know that it is a six-month job.

So if they're able to start in November, that means that it would end the first of May.

So it is it is going to be a little bit time consuming.

It's this isn't an agendized item, so it's not appropriate to discuss or further develop.

I was just gonna ask him one question on the project.

We could put his lies to rest and and move on with uh him enforcing this code.

Actually, he really should be removed from his position of code enforcer.

If you don't enforce codes, I don't know what his position is for then.
