0:03And welcome to the Tuesday, December 2nd, 2025 technical review meeting for the City of Mesquite.
0:10We're gonna go ahead and get started with opening public comment.
0:12You have three minutes.
0:18Good afternoon, Mayor, members of City Council, and the residents of Mesquite.
0:23My name is Debbie Benham, and I'm here to talk about the parade of lights.
0:27The parade is this Thursday at 5 30.
0:31We have right now we had 40 entries.
0:33We're down to 38, two had a cancel.
0:37Food wise, I have 19,711.6 pounds of food.
0:43And this morning I picked up an additional 625 dollars in donations.
0:48So I now have 1,710 to spend.
0:53So come out to the parade.
0:55It's gonna be awesome.
0:56It is the biggest parade, the biggest number of entries we've had since we've done it.
1:09And on that note, I'd like to thank Captain Rowley and the volunteer police for all the hours that they've put in.
1:17Uh Chris comes in on his day off with his truck and trailer.
1:21And uh they've done a fantastic job.
1:23We I don't know what we would have done otherwise.
1:25So a big thank you to Chris and the volunteers.

1:43Hello, Mayor Whipple.
1:44My name is Raylan Schivano, uh, director for Nordic Beach Properties.
1:48Um, today I'm asking the city to stop relying on the 2007 final map for Red Hills.
1:54It is defective, it is not legal, and the HOA itself has determined that 4C2 and 3D two are not on this map.
2:05So the uh since they don't exist, they are they're forced those slots are not on a lawful map.
2:13So to do any parking or any reciprocal agreements or cups, you can't do anything if the parcel is not on a legal parcel map.
2:22And I did call the county today to verify um how they got these parcels on the map, and they're just as confused as I am of how these parcels ended up on the map.
2:31So they're investigating how 4C2 and 3D2.
2:35Um, also that the fact that they can't get on the map, they have to have 67% vote.
2:41And if we were a legal HOA, Nordic Beach owns 33.33 percent, and they can't get on the map.
2:49Now we are not under NRS 116, according to the Red Hills attorney, and we agreed with him.
2:57And even if we were, they don't have any enforcement power.
3:01So our CC and CCNRs that are actually recorded under um book 11, page one or book 111, page 35.
3:12This would be the map that we would be going by, which doesn't have any subdivisions done in 2003.
3:19So those CC and Rs aren't valid for the 2007 amendment because the amendment was not done legally.
3:26Then you have the fact that we have the motions for summary judgment and a re-recording that tried to hide the fact that they had an annexed in the property correctly to the master association.
3:38So all I'm asking today for this part is that you stop relying on any CC and Rs from Red Hills and any final maps from Red Hills until litigation is finished because they are not legal and it's gonna put the city in a bad position, and we don't want that.
3:59Get a chance in the next week.
4:00My screen hasn't been working.
4:05Otherwise, I'll forget to tell you.
4:07So I have to look over Patty's shoulder.
4:10I was like, do we need to all the things?
4:12I was gonna say I don't buy it.
4:16Uh do we have anyone else?
4:18Okay, uh, with that, we're gonna move on to item two, our work session.
4:23Um we have items to add.

4:39So the first item is I emailed it to all of you.
4:43It's the US 250 tour.
4:45The United States is gonna be 250 years old.
4:48We've been approached by a group that is going to be going through all 50 states over the next year, and they're requesting funding.
4:56So that's that's the first item.
5:00Okay, do I have a motion to add that item?
5:05It'll just be for us to decide.
5:08So I'll make the motion.
5:11Okay, do we have a second?
5:13And remember, Mayor, we need to make sure there's public comment on any motion.

5:33Now the second item is 800 horizon.
5:36You've actually this is gone on for several months now.
5:40So uh the company did a presentation on putting about 25 single family lots on the 15 acres next to our shop.
5:51And then we did the first resolution.
5:53You approved the second resolution, and now so I'm just going to be adding the contract.
6:00Okay, do I have a motion to uh do you have any public comment on the uh proposal to add 800 horizon boulevard?
6:11Um councilman Wannless.
6:13I'll make a motion to approve that.
6:16Hopefully we can get done with this soon.
6:20This is the same builder that we've already approved.
6:24I just move forward with yes.
6:26We were we were we spent quite a bit of time working on the contract to really tweak it.
6:31Um Adam did with their attorney, you know, back and forth, back and forth, back and forth.
6:36So both sides finally felt like okay, we can present this now.
6:41It we had to make sure that there were some restrictions in there uh to hold their feet to the fire to actually perform.
6:47So that was part of the issue.
6:49I'll second Paul's motion.

6:58I've got two more, and they relate to John Deere.
7:01Um, John Deere 200, and then John Deere 201.
7:06So again, you know, we've been you've you're pretty familiar with that one, but we received a new addendum on both.

7:18Do we have any public comment on the two John Deere properties about adding that to the agenda?

7:28Um Adam, do I need to add these separately?
7:31Oh, since they are two different items.
7:33Well, that's a good question.
7:36You could do one motion to add both of them.
7:38I'd like to add 200 John Deere um and 201 Deere to the agenda.

8:03Umor and city council.
8:07I'd like to advise you about the order of the items.
8:11Um we have a five point one, uh, which is uh discussion about temporary moratorium on uh short term residential rental, and then 5.2 and 5.3 uh the conditional use permit for the vacation rental.
8:27So if we if we move those 5.2 and 5.3 in front of the 5.1, then we can review and issue the short term rental permits for them, or by leaving it like this, and the you approve if you approve the moratorium and moratorium will be effective immediately.
8:49So that means the 5.2 and 5.3 will not be reviewed.
8:55So I'll let you decide.
9:00Um, do we have any public comment on rearranging the order of 5.1, 5.2, and 5.5.
9:08Mayor, it'd be appropriate to have a if there's a motion to do that, then uh allow for public comment.
9:14If there's no motion, then it just stays as is.
9:19I will make a motion to um replace um 5.1 and make it 5.3 and move up 5.2 and 5.3.

11:09Kim about trail tide.
11:12We have branches that hanging over.
11:14He's trying to contact the HOA.
11:18They don't seem to really care.
11:20Um they trim them up.
11:24Kim said your ordinance said they only trim them to seven feet.
11:28You should change that to 12 feet, just like the CCNRs.
11:35They they hang an out if an ambulance or a fire truck go down, they're gonna take the roof off.
11:40And he's tried his best to do it, but they don't care.
11:44You know, they just don't.
11:46But before somebody gets hurt, and there's one tree right now that the branches are about this high off the ground.
11:54So we'll go, and that's on your property.
11:57Remember, you own the sidewalls and the streets in trail side.
12:01So I don't know what you guys can do, but you gotta do something.
12:05Are you talking on Hafenway or in the interior streets?
12:08Oh, it's right by the middle school.
12:10No, but are you are are you talking on Long Haven Lane or in the interior?
12:13In the development itself on the sidewalk.
12:15Okay, you get a kid come down there on a bike, it's gonna take ease.
12:19Oh, yeah, and we you gotta do I don't want to see no kids get hurt.
12:22And by the way, it's not gonna snow, but I saw a kid with a helmer on riding the scooter down Hafen on Monday.
12:38Rayleigh and Schiffano again.
12:39Is this the appropriate time to ask for 5.4 to be removed from the agenda since there is no legal parcel there?
12:45Um, and if the litigation with Red Hills prevents the city from enforcing the parking code, then it also should prevent the city from granting any liquor licenses or cup approvals that depend on that parking.
12:59So if the city's position is that they can't do anything because of litigation, they should not be able to grant liquor licenses and cup approvals for the same reason that they should let it play out in court before they add any of this stuff to the agenda.
13:12And this establishment has been open since October 31st.
13:16So they've already been serving liquor, they're already in business.
13:20So the fact that the city is waiting for after the fact to approve a liquor license that shouldn't be on a parcel that doesn't exist, that is our problem.
13:28And I'm asking for 5.4 to be removed from the agenda, please.

13:37Seeing no one else come forward.
13:40Oh just uh I wanted to give a just a quick update um today on the mill and fill project on Mesquite Boulevard.
13:49You may have seen that they did start removing the asphalt on Monday.
13:53Um they paved yesterday and they paved today.
13:56Um, and they'll be removing um the some more asphalt tomorrow and paving on Thursday, and then the weekends, just like what we've always talked about, will be no work on Friday, Saturday, or Sunday.
14:12That works happening down towards the Casablanca right now.
14:16Um they are working on the water line on Old Mill Road.
14:20That's the um work you see there fixing that water line, and then the city, there's a sewer line with the um that was had some bellies in it right there in front of the uh movie theater, and they're working on that.
14:35That uh so the work the paving will continue from the Casa up to Grapevine in this month of December.
14:43Um that's the stretch, but they'll be working from the west towards the east on our traffic signal project.
14:49Uh that work continues.
14:51Um they do have all of the boring completed for the conduit, and they're continuing to bring the fiber optic line down Falcon Ridge Parkway.
15:00So as um people ask, that's the trenching that's going along Falcon Ridge Parkway.
15:05And then the Hafen and Levitt project is continuing to go well.
15:12They are putting in utilities, the water line on that, and uh going strong with that.
15:19The other item of note um right before Thanksgiving, uh the water the water district had a large water line break on Whitware Trail, and that caused extensive damage to the roadway.
15:33That water line is a PVC, it's 24 inch, so it's a large water line, um, very high pressure.
15:40So they're looking at actually putting that, taking all of that line out and putting it in as ductile iron.
15:46Now they're not sure about that.
15:48They're doing the investigations, but if that is the case, um we will keep that roadway shut down until they get that.
15:56Um I've talked with fire, um, and that road isn't you know, it's a good little pass through, but it's not necessary.
16:05So we can close that and it'll probably be closed for the next two months while we're doing on that.
16:15Mayor can ask on on the roads with the temperatures dropping like they are, and we're getting down close to freezing at night and stuff.
16:23How is that going to affect your hot asphalt?
16:29Um, with all of the standards that are set within the Clark County and southern Nevada, a lot of historical data on this.
16:37We don't pave unless the base itself is 40 degrees and rising.
16:42So that's why they didn't start until I think 10 o'clock this morning.
16:47Um as long as the the real big killer on the paving is the wind during the winter because that cools it down too fast.
16:56The temperature of the asphalt when it's getting laid down is 280 degrees.
17:01So it has ample time as long as the base that it's getting applied to is 40 degrees and above.
17:09So we're still good.
17:16Can I ask a question going back to the previous comment about the tavern?
17:22I is that because we kind of jumped over it a little bit.
17:26But I you can ask the question.
17:28The agenda item is the we've concluded the agenda item to add a remove.
17:33And so if that was the question, then the agenda item had already.
17:37No, my question is something is selling liquor without a liquor license.
17:40That was my question.
17:43And and how did that happen?
17:46That we have to do that.
17:47Yeah, we so how are they still how are they open?
17:53It's a public comment that could come up here.
17:54I don't know if Simon's heard about that or not, but it's something that would be addressed.
17:58I haven't heard anything about it.
17:59I heard that uh they were doing the innovation a bit, but uh I did I haven't heard anything about the selling course in it.
