Public Comments & Testimony

- Mike Benham raised concerns about low-hanging tree branches along sidewalks in the Trailside community. He stated that city ordinance requires trimming to only 7 feet, which he argued is insufficient for emergency vehicles. He suggested raising the trimming height to 12 feet to match CCNR standards.

- US 250 Tour: The council unanimously voted (4-0, with Councilman Parish, Councilman NSI, and Councilwoman Galloway in favor) to add an item regarding a request from a group planning a year-long tour through all 50 states for the United States' 250th anniversary. - 800 Horizon Boulevard: The council approved adding a contract for 25 single-family lots on 15 acres near the city shop. This follows previous resolutions on the same project. - John Deere Properties: Councilwoman Fielding moved to add both 200 John Deere and 201 John Deere to the agenda, which was seconded by Councilman Parish. The motion passed unanimously (4-0) to address new addendums from the NRC.
Agenda Reordering Vote
- A motion was made by Councilman Fielding to reorder items 5.1 (discussion of a temporary moratorium on short-term residential rentals), 5.2, and 5.3 (conditional use permits for vacation rentals) so that 5.2 and 5.3 would be heard before 5.1. The motion failed, with Councilmen Parish and NSI voting against. As a result, the agenda remained in the original order, which could impact the review of the two conditional use permits if the moratorium is approved as effective immediately.

Good afternoon, everyone. And welcome to the Tuesday, December 2nd, 2025 technical review meeting for the City of Mesquite. It's 2 31. We're gonna go ahead and get started with opening public comment. You have three minutes. Good afternoon, Mayor, members of City Council, and the residents of Mesquite. My name is Debbie Benham, and I'm here to talk about the parade of lights. The parade is this Thursday at 5 30. We have right now we had 40 entries. We're down to 38, two had a cancel. Food wise, I have 19,711.6 pounds of food. And this morning I picked up an additional 625 dollars in donations. So I now have 1,710 to spend. So come out to the parade. It's gonna be awesome. It is the biggest parade, the biggest number of entries we've had since we've done it. Thank you. Thank you, Debbie. And on that note, I'd like to thank Captain Rowley and the volunteer police for all the hours that they've put in. Uh Chris comes in on his day off with his truck and trailer. And uh they've done a fantastic job. We I don't know what we would have done otherwise. So a big thank you to Chris and the volunteers. Thank you so much. Mike, say your name, just for the record. You don't know that. Hello, Mayor Whipple. My name is Raylan Schivano, uh, director for Nordic Beach Properties. Um, today I'm asking the city to stop relying on the 2007 final map for Red Hills. It is defective, it is not legal, and the HOA itself has determined that 4C2 and 3D two are not on this map. So the uh since they don't exist, they are they're forced those slots are not on a lawful map. So to do any parking or any reciprocal agreements or cups, you can't do anything if the parcel is not on a legal parcel map. And I did call the county today to verify um how they got these parcels on the map, and they're just as confused as I am of how these parcels ended up on the map. So they're investigating how 4C2 and 3D2. Um, also that the fact that they can't get on the map, they have to have 67% vote. And if we were a legal HOA, Nordic Beach owns 33.33 percent, and they can't get on the map. So we have voted no. Now we are not under NRS 116, according to the Red Hills attorney, and we agreed with him. And even if we were, they don't have any enforcement power. So our CC and CCNRs that are actually recorded under um book 11, page one or book 111, page 35. This would be the map that we would be going by, which doesn't have any subdivisions done in 2003. So those CC and Rs aren't valid for the 2007 amendment because the amendment was not done legally. Then you have the fact that we have the motions for summary judgment and a re-recording that tried to hide the fact that they had an annexed in the property correctly to the master association. So all I'm asking today for this part is that you stop relying on any CC and Rs from Red Hills and any final maps from Red Hills until litigation is finished because they are not legal and it's gonna put the city in a bad position, and we don't want that.
