Mayor Messam's Comments: Mayor Messam called the meeting because he considered the issue too important to let a de facto no vote pass due to the summer hiatus. He emphasized Miramar's recent success in fighting a Miami-Dade incinerator near the city and argued that remaining outside the SWA would leave Miramar without a voice in Broward County's waste management. He proposed that if Miramar joined, it would work with the SWA to prohibit development of a waste-to-energy facility at the Broward County landfill (West Landfill on US 27 and Sheridan Street) or strengthen restrictions. He stated that the opt-out provisions in the second amendment allowed the city to later withdraw if concerns about costs and commitments were not resolved. He concluded that Miramar should have a seat at the table to shape the county’s solid waste future.

Commissioner Cherasard's Comments: Commissioner Cherasard expressed concerns about the contract language, particularly the flexible opt-out deadline and the lack of firm dates. She questioned the $500,000 spent on the plan and the short decision timeline. She asked whether the second amendment language had been available at the July 8 workshop (staff confirmed yes). She raised the possibility of including additional conditions, such as addressing the existing incinerator on 441 which is five miles from Miramar, and moving toward zero-waste goals. She noted the lack of concrete commitments to reduce incineration or pollutants. She wanted more tangible benefits for municipalities that had participated from the start, including consideration of the money spent. Despite her concerns, she acknowledged the value of being part of the group.

Mayor's Response: Mayor Messam noted that the SWA process is transformational, not transactional, and that the master plan currently contemplates incineration because of the active incinerator near the airport. He argued that a reasonable condition for Miramar would be to block a new incinerator at the West Landfill, as residents would prefer keeping it at the existing industrial location. He stressed that without membership, Miramar could not advance any of its ideas or conditions.

Good evening, everyone. Thanks for coming um for the special meeting called for the city of Miramar commission. Um currently right now. We have two members of the commission present physically. Absent members. I'm going to give them about five more minutes to reach here. But nonetheless, after that five minute has passed, I'll come back in regards to our next steps and direction of the meeting. So I just wanted to give everyone who's present in the chambers that update. I think we're good. I think we're good. Of course. Good evening. The meeting of the Myanmar City Commission is now called to order. An opportunity was given to the public to register to participate or email the city clerk twenty-four hours prior to the commission meeting with any questions, comments, concerns on the item we will hear on this evening's agenda. Any person may be heard by the city commission through the chair and upon registering pursuant to the published notice for not more than three minutes, unless modified by the chair.gov slash commission meeting and televised on Comcast Channel 78 and ATT Universe Uverse Channel 99 for City of Myanmar subscribers. As of August 13th, 2026 at four thirty PM, no member from the public has registered to participate virtually in this meeting. At this time, Madam Clerk, please call the roll. The sole purpose of this special meeting is for the City Commission to consider and take action on the City of Myanmar's continued participation in the Solid Waste Disposal and Recyclable Materials Processing Authority of Broward County, also known as the SWA, including consideration of a resolution approving the Solid Waste Authority's 40-year solid waste management and recycling master plan adopted by the SWA governing board on April 17, 2026, and the related amendment to the interlocal agreement establishing the authority. As which was just recorded and documented, the City of Myanmar Commission does not currently have a quorum. It was communicated to the city clerk or through the city administration that Commissioner Colburn sent an email that she could not make it, and as well as communication from Vice Mayor Edwards that he could not make it. And we have not heard back from Commissioner Chambers who could possibly come into the meeting. So due to not a due to lack of quorum, we are by charter are allowed from time to time to meet and discuss items, and we will treat this meeting as a workshop to have the staff presentation if Commissioner Chambers does arrive during this period of time. His um appearance uh will be um recorded as uh present and um therefore we would um have a quorum and could take action at that point. But currently, right now we don't have a quorum, so the meeting will be treated um as a a workshop, which will then be uh followed by um discussion. Um so um at this time I will ask the city attorneys to read into the record item number one, please. Yes, Mr. Mayor. Item number one, a resolution approving the facilities amendment and second amendment to the interlocal agreement for solid waste disposal and recyclable materials processing authority of Broward County, Florida, authorizing the city manager to execute the facilities amendment and second amendment authorizing the city clerk to provide a copy of this resolution and the executed second amendment to the interlocal agreement for solid waste disposable disposal and recyclable materials processing authority of Broward County, Florida. This is being uh this will be presented by division director RAF Ralph Trapani Trapani. Good evening, sir. You recognize the good evening, thank you. Uh Ralph Trapani, uh Solid Waste and Recycling Division Director, uh, Mayor, Commissioner Sarasad, uh, manager, attorneys, clerk, everyone here, and and watching at home. Okay, so the issue this evening is the city of Myanmar's participant in the Solid Waste Disposal and Recycling Process Authority of Broward County. Uh there's 29 municipal uh 29 municipal members, including Broward County, and it began with the Solid Waste uh working group back in 2019. Um there are two fundamental conditions required for adoption and continuation of the solid waste authority, the inner local agreement. It was the master plan, which was approved by the governing board on April 17th in 2026. Uh it was not approved by the governing bodies of the members. Uh the facilities amendment requires approval from 80 percent of members populated uh elected bodies, which has been met. So the issue this evening is the city of Myanmar must decide whether to continue with the uh solid waste authority um by August 14th and consider uh approval of the facilities amendment and second amendment with condition. So the solid waste appeal, the solid waste authority and local agreement appeal was the uh initial 40-year term with two-year uh two 10-year extensions, includes an opt-out clause, which is uh approved by the executive community and governing board on June 15th. Includes flow control requirements, the master plan provides recommendations on how the authority would meet those waste reduction objectives and mandatory waste diversion programs ordinances will need to be adopted from Broward County. Um continuing with the appeal of the interlocal agreement. There is a facilities amendment, uh, which is a procedures to protect public long-term investment, and the second amendment occludes two opt-out clauses. There's an indemnification for the uh provision of its members and the governing board and executive committee are made up of members from the elected uh bodies or elected officials from those governing bodies. Excuse me. So the facilities amendment condition is being proposed by the city of Miramar is to approve the facilities amendment and second uh amendment on the basis that the Solid Waste Authority prohibits any development of waste and energy facility at the Broward County landfill generally located on US 27 and Sheridan Street. This would not prohibit the development of a private equity, uh private entity uh development at the property. This would not prohibit a city individually from developing a waste energy facility at the property. It would not limit the SWA from ownership of its prohibited disposal facilities at any other location following procedures. It would not inherit uh inhibit the current waste of energy operations would not prohibit future expansion of the current uh waste of energy property.
