The Mobile Planning Commission met on September 18, 2025, at 7:00 PM to consider a major modification of a previously approved planned unit development (PUD), a rezoning request, several subdivision approvals and extensions, and a call for a public hearing to amend the Downtown Development District code. Chair Jay Stubbs presided over the meeting, with a quorum present. The meeting followed a public hearing and deliberation format.

- Extension request for Phase 2 of the Angel Brook Subdivision (48 lots) at the same address: Approved for one year, with 16 conditions.
- New subdivision at 3520 Spanish Alley (Sunset Creek Subdivision, resubdivision of Lots 1-3, 7.5 acres): Approved with 10 conditions.

Discussion Items
Major Modification of PUD – 600, 700, and 800 West I-65 Service Road South Applicant Jay Watkins (Maynard Nexon) presented a revised site plan for a multifamily development, reducing the number of units from 240 to 217. The plan involves demolishing two hotels on the middle and southern lots and constructing an apartment complex with shared access and parking across three building sites. Discussion focused on the frontage landscape area (reduced from 25,000 to 5,000 square feet) and a request to allow a pet park or children's playground. Fire access concerns were raised, with the applicant agreeing to comply with fire department requirements. The commission approved the modification with amendments: removing condition 9 and amending condition 8 to reflect the 5,000 sq ft landscape area. Motion carried unanimously.
Rezone from R1 to R3 – 7211 and 7221 Cottage Hill Road Applicant Shabir Hussain requested a rezoning from R1 (single-family residential suburban) to R3 (multifamily residential suburban) to allow construction of 16 duplex units with potential future office use. The associated subdivision application was withdrawn. Commissioners debated whether to impose a density restriction (capping at 16 units) or rezone to R2 (which would require subdividing each duplex). The applicant preferred R3 for flexibility. The motion to approve the rezoning as applied (without restrictions) passed with 2 nays and the rest in favor.
Subdivision – South Side of Wood Alley, West of Green Street Applicant Carrie Comanis requested a waiver of condition 1, which required dedication of a 60-foot-wide street. The existing street is 16 feet wide, and the surrounding area has narrow streets. Commissioners recommended waiving the condition, noting the impracticality of widening. The subdivision was approved with the waiver and other conditions. Motion carried unanimously.

Good afternoon and welcome to the September 18th, 2025 Mobile Planning Commission meeting. I would like to take a moment to review our general operating procedures. This meeting is divided into two sessions, public hearing and deliberation. In public hearing, the agenda item is called. The applicant makes their presentation. Commission members ask questions and then the members of the public can make their comments to the commission. Only four people speak for an agenda item, four people against. Each speaker is limited to five minutes with questions subject to questions by the commissioners. At one minute remaining, you will have a warning bell or a beep prompting you to summarize your comments. After opposition speakers speak on an agenda item, the applicant is allowed a two-minute rebuttal. If you do intend to speak, please come down to the bottom of the stairs at the podium. Speak clearly into the microphone and give your name and address for the record. Please direct all your comments to the commission only and not to the applicant, the staff or the audience. After hearing all the applications, we will then go into deliberation where we will discuss each application with input from the staff as necessary, but with no input from the audience. Commissioners then vote on each application, and the results of that can be learned from the planning department. If some issues arise during deliberation that were not addressed in the public hearing, we have the discretion to allow additional comments to resolve the issues or call for the application to be held over for discussion at a future meeting. Occasionally we will have commissioners recuse themselves from discussing and voting on a given application. That doesn't mean that they are directly involved with the application or the applicant, but depending on circumstances, ethical rules may require the recusal. If they do recuse, we will have a supernumerary vote in their stead. Reminded that the planning commission makes final decisions on subdivisions with appeals of these decisions to the circuit court. The planning commission is strictly a recommending body for rezonings, conditional use permits, and planned developments. The city council makes the final decision on these applications and all appeals of the city council decisions are to the circuit court.
