Ronald, please come up annually and just for everybody's sake or clarity's sake.

We're not actually paying these folks $80,000 to teach lessons.

This is these are they're charging for their services and it just rolls through the city.

So this is not coming out of the city's account.

President, uh Ms.

Uh first of all, I'm excited to see this type of service.

Um, you know, ensuring that the um services and systems are working properly.

But I do have a question for admin.

If you look at the uh actual fee compared to the budget, the budgeted amount, it's almost 50% less.

I'm excited that it is less, but that's a huge difference.

What could be some of the causes for that type of uh difference in a budget?

Yeah, councilwoman.

Primarily the the reason that's significantly lower is we were able to negotiate with Henderson Building Solutions, their sister company, Henderson Engineers did all of the mechanical electrical plumbing design.

So they're intimately familiar with it.

So rather than bring a different firm in that would uh have to uh go through learning curves and and studying of the design, we were able to achieve that savings by using their sister company.

Okay, thank you for that.

But a follow-up question based off of that.

If they're using a sister company, then that's um satisfactory performance.

The way that's evaluated is going to be critical because again, it's assistant company and they know each other, and we want to make sure that we're getting the best service.

My question is what is that going to look like?

Do we have a system to know what's going to be used for that?

Uh prior to that payment.

Uh, and I'm looking at the method of payment when it states that before paying, it will have a form of satisfactory performance.

Yeah, so with commissioning, uh, what that service is is that firm works with the general contractor.

So when the general contractor starts bringing all their systems online and testing them, the commissioning agent is there, they witness the testing, and then they provide a commissioning report, which essentially says that everything is in compliance with the design requirements.

That's Sam, if you don't mind.

When uh are they taking on the liability then when that commissioning report is done, they're then taking on the liability for those systems working as they say they were.

No, the the liability remains with the general contractor.

The commissioning agent just confirms that that everything is in compliance.

Okay.

And they have a one-year warranty, the contractor does.

So if there's any issues that come up after commissioning within the first year, you know, they're obligated to correct those.

Okay.

Um, how about an update on where we're at budget-wise?

So we got bricks going up on the walls, which is nice.

Yeah, so uh we're we're on budget.

Uh I don't have any real concerns about staying on budget at this point.

Uh schedule, you know, we're still we're on schedule, but you know, that's a struggle every day until we get completely dried in.

There's always a risk of of weather issues.

Uh, we have had to grant them some weather days already.

Uh so but but we are on budget.

We're at this point, we're approximately 50% complete.

Uh all of the uh structure, other than the last couple of roof trusses are done, and those are in process.

The uh all the precast brick panels are going on the building.

Uh they've wrapped uh approximately three sides, uh they're now working on the Clayburn side.

The upper level cement tissues wall panels, uh that construction started yesterday.

Uh so you'll probably see some of the other panels.

They've got to build the backing wall for those, but you'll see some of those decorative uh cementitious panels probably going up the next couple of weeks.

Uh, interior, uh we're starting to uh set all the mechanical equipment, which is why this commissioning contract is on the agenda now because Alabama Power has set all of the transformers and switch gear.

So we are now powered up and we can start uh you know energizing and testing mechanical and electrical equipment in the building as it gets installed.

When I talk to people about the arena, I'm you know, I've placed a couple friendly wagers with some friends to say uh that we will be in this building for Mardi Gras of 27.

Do I get a cut of that?

They no definitely not to get one.

Uh they um they say that finishing the project, the interior work is really the thing that is hard to finish a project, you know, to get it all buttoned up.

Are y'all on a 24-hour schedule now?

And if not, when will y'all move to a 24-hour schedule or is that necessary?

We are not on a 24-hour schedule.

We are on a seven-day week schedule.

Okay.

Uh hopefully we won't have to go to a 24-hour, but and and that's true.

When you get to the point of finishes, paint, you know, tile, trim, it always seems like that takes an inordinate amount of time.

But uh, you know, I mean, we'll do what we have to do to get it to get it ready.

So y'all are equipped if in the event that it's necessary to go to 24 hours, you can do it.

Yeah, I mean, that can be done.

We of course we don't want to because when you start working people that many hours and multiple crews that you get into safety concerns, and you know, so we don't we don't we won't want to get anybody hurt for the sake of speed, but thank you, Sam.

Sam, I have go ahead, Matt.

I have a follow-up question.

Um, you know, you talked about the fact that we are on budget, but are we having, you know, when you look at this uh almost 50% saving, are we under budget?

I'm not prepared to make that commitment at this point since we're only 50% done.

But yes, I think we we are under budget and we will probably remain under budget until we're done.

And and I think that's great.

I think that's great.

There's lots of things that could still happen.

Absolutely.

But I wanted to point that out because you know there's all these perceptions out there that that we're out of budget and all these things are happening.

So when we can bring that to the forefront so that they can see that we're probably going to end up under budget.

Uh council, y'all want to um join in as a sponsor on this one also.

And Mr.

President, uh again, I want to join in with my colleagues and say how excited we are, you know, when we can recognize our own and have a process for doing that so we can celebrate them, which will inspire other young athletes to do the same.

But I do have a question regarding the uh payout.

Uh in the payout, it states that it's a single payment of $500,000, but yet it goes on to say for the evaluation, they're going to submit, I want to say quarterly activity reports in terms of um the status.

And if so, then what role is the quarterly report activity in terms of that right now?

It is a one-down payoff, but since we're using city and county money, um, our goal is to continue to report to the city and the county the status of the the the whole not just the finished project, but the the operation as it's run.

Um I mean it's it's as much your facility as it is ours because you're paying for it and uh the citizens of Mobile need to know that the money got spent well.

So uh our reports to you are going to show our our uh foundational money that we're raising and everything else, just so that everybody we want to be very transparent.

And and I ask that question because I would like for us to consider when we're doing these payments that if we can align the activity report with the payments so that when you go on in the contract, it talks about withholding payment if we're not getting the results that we're expecting, and that's why I'm asking, you know, if there's a way to alignment align the payment with the activity report for that.

I would assume there's a way to manage that.

The we don't even have the payout schedule with the contractor yet.

So that's that's the reason we it's just it's it's stated as a lump sum, but we may not necessarily need it all as a lump sum if we if depending on the payment schedule with the um the contractor.

Uh I know the county is is doing theirs as a lump sum up front.

The only thing they're waiting on is approval today to transfer their money so we can get started.

Uh we were gonna frankly get started with their money and not even come back to you guys until we got to the point that we needed it for the contract.

So that's that's the goal.

But but we we have no like I said, we're we're a very open society in that sense.

We want everybody to know where the funding's coming from, where it's being spent in the future.

Um, even even our money.

I mean, you your your money is gonna get spent on the build out, but we intend to since you paid for the facility, show you the day in, day out operation of the facility.

Okay, well, again, uh, you know, this is exciting for all of us because it allows us to recognize our own, just trying to make sure that we are getting our evaluation reports aligned with that so that you know we can uh have that transparency.
