Today's a public hearing to consider the proposed rezoning of property located at 4630, 4700 4960 Dolphin Island Parkway from B3 to B3 to remove a previous condition of the rezoning.

They are looking to put in a used car lot with some light mechanical.

The I watched the planning commission meeting on May 21st to, you know, just get a little bit more background.

The building that they are looking to use because he said they wanted to remodel the building that's there.

It's been vacant since 2000.

There apparently was some kind of an attempt by the city at one point to maybe put it on nuisance abatement.

Something happened.

But at any rate, the building has been sitting there and it's it's pretty much a blighted condition.

So they say they will come in, they will clean up the lot, and they will remodel the building for an office, three roll up car bays.

And then they will have the cars that they want to sell parked out.

I'm not sure exactly where.

When I watched the meeting, it was really unclear uh exactly what they were going to do with the site, but at any rate, they're going from asking to go from a B2 to a B3.

This sits it's a small strip of I say small, but it's a strip of property that uh Moffitt is on one side and overlook is on the other, because you kind of can cut through from Moffat to Overlook and get to university from that area.

So everything around it is primarily a B2 across Moffat, and there is a daycare center and residential.

So the planning commission recommended denial.

Didn't really have much to say about it when you when you watch the meeting.

So I'm sure we'll hear from the applicant today to see what they you know have.

We can ask some questions about exactly what it is they're looking to do, exactly what the site plan will look like because again it was kind of unclear um during the meeting.

Public hearing to consider the proposed rezoning of property located at 5361 Moffat Road from R1 to B3.

And this is another one.

It's like, you know, you get two in a row.

Um, this one is an R1, surrounded by R1 on the east side, the west side, and then back of it on the south.

If you remember some time ago, there was a subdivision that was um planning to go in, and the uh applicant wanted to put in a street that cut through a neighborhood and went to this subdivision, and the neighbors were opposed to it because it would go through their neighborhood.

And at any rate, uh the planning commission denied it, we denied it, but they went to court and it was overturned.

So just giving you some background on the on the area there, but um the applicant here uh wants to put in a realty office.

Um a realty office in and of itself would be kind of light, light impact.

The problem is that she is applying for a B3 because of what she wants to do on the site, which would include some moving vans and also putting in a storage building in the back.

She also wants to increase the size of the the house by over another thousand feet plus.

So um, there's just a lot of questions about that.

And the neighbors who I've talked to said they went to the neighborhood meeting, um, thinking it was about the subdivision next door that they had been opposed to what was happening there.

So at any rate, um, I think there was some confusion about that.

Um the neighbors did not understand what a B3 was, what it means, uh, or the fact that you know she wanted to park these big moving vans and build a storage building and back.

So I think there's some learning going on within the neighbors.

Um the woman is very, very nice.

Um certainly putting in a realty office with the everything she would need to stage a house and help her clients is a great idea.

It's just going from an R1 to a B3 is not necessarily a good idea, in my opinion.

So anyway, we'll hear from everybody today and be able to ask them some questions.

I I do have a uh quick question.

Um it looks like that this is a change order of 115,691 dollars and 44 cent.

And first of all, let me just thank uh Miss Smith and Mr.

The work that's happening with the repair and maintenance and storm drain structures is is to be commendable.

But I do have a question regarding the change order and the specifics.

What which change order is that?

So if you look at it, it's saying that um first it shows that it's an the contract was originally 1,300,000, but then it shows that there's a task order form where it's changing to an additive of 115,691 dollars.

So is it just separated out or the total is just one million four hundred and thirty?

It's it's 1.4.

I'm not sure what that 1.3 would have been because there I think their bid came back in at 1.4.

So I'm I'm not entirely sure what that change order would have been.

Maybe it was something that happened during the bid process, but it was originally budgeted for like 2.1 or something, so it came in way under budget uh either way.

Well, that's great news.

And then lastly, is you know, when you look at this, it shows like um the different um the different be it quantities, but is it possible for us to get the actual because this is repair and maintenance?

So wouldn't you have a list of which uh ditches and and um storm drains that are going to be repaired?

Yeah, I sent that to y'all yesterday afternoon.

The the the initial uh initial priority list is what I sent to y'all.

It includes the things that we found during the vegetation removal process over the last few months.

Uh several of them are are very large.

Uh in the document, you'll see the comments next to the locations or the ditch.

Yeah, some of them have different ditch names or specific locations.

Uh those comments came from uh staff out in the field uh regarding their assessment of the condition of of the ditch or uh in some instances a collapsed outfall pipe or a collapsed stormwater inlet that uh is causing some severe issues.

So that's what the initial list is going to be.

The contract is organized in such a way that it can be renewed in future years so we can continue to progress down the list.

Um this originally was part of a contract.

The same company that was contracted to um create the exhibit, deploy the exhibit was also in charge of the marketing as they got into the process of actually you know creating the exhibit, they realized that the marketing was going to be too much for them.

So this was a combined contract that was previously approved.

They decided to peel that out of the original contract and enter into a separate advertising contract with uh FIN partners to take it off of the installer.

Are we expected to have this marketing sort of contract every year?

I think this is primarily for the opening, the the grand opening.

Okay, yeah, coming up September 11th.

All right, and on 21740, I have this for you, Mayor.

Uh, this is regarding the study for uh permitting fees.

Um I've read this contract, they're they're doing a lot of things, as Ms.

Bico described last week.

You know, they're they're doing a comprehensive evaluation, which I think is likely necessary.

But I'd ask that before y'all put something in front of us to raise these fees, that there are some measurable results that we can see that you know it's an easy sell to a contractor or to someone buying a permit when they're paying a little bit more, but it's moving twice as fast.

You know, if you could bring some measurable results to us before you ask for additional money, I think that would be ideal.

Well, you know, I think it I think that this study is going to show us some of the things that we can do to bring measurable measurable results.

I think we have our own suspicions and ideas of what those things will be.

Uh, but in the end, to deploy them to bring measurable results, we will have to have the funding to apply, you know, to hire the people on the customer service end.

So, you know, I I do think that this is a necessary step.

I won't say it's a first step.

I think it's at this point a second or third step, but um in talking to the public, I think there's an appetite for this.

There's no reason to raise permitting fees without giving increased service.

That that doesn't make sense to me or them or anyone else.

Um, but I think that this will back up the suspicion that we have.

Uh, and then they're gonna they're they're gonna have their own findings.

Uh, but I think we're gonna see that we have funding gaps, uh, that we have personnel gaps within our permitting process that uh if we fill them using permit fees, uh, you know, the increase from permit fees.

This is not money that's gonna go into the general fund based on you know the law and the restrictions of permit fees, it all really has to go back into the process.

Uh, this is not the city trying to make more money, this is the city trying to improve the process for contractors, for engineers, for everyone uh looking to to develop mobile.

Um I think they're gonna come up with some recommendations, some of which we expect liaisons, direct points of contact within the city uh for each individual applicant.

I think that's something that's needed.

I think that we've seen success with that in other areas of the country.

13:59

Uh and and at the moment, I don't think build mobile's budget could really float uh a large number or really any number of these liaisons.

I think permitting fees can really cover that.

I think there are other areas that we need to fill in gaps, inspections is something we've talked about.

Um, and frankly, uh, I think it's going to take more money and from our communications with contractors, engineers, and others, they're happy to pay that extra little bit if they know it's as you say, you know, uh is it if it's going to result in better increased speedier service.

Yeah, my I get it, right?

You want to get the money first and then make the improvements, hire the people you need, which we know that they've got vacancies currently, right?

So we know we're not working at full capacity.

14:49

And I just don't want there to be a promise that is not able, you're not able to make happen.

Like, hey, we're going to improve this.

If you give us the money, trust us, we're the government, we'll get it done.

I just don't want to get into that situation if we can say here is the measurable impact that we know by having all of our positions filled or whatever, that we've seen these improvements that you bring those to the table when you come and ask for additional funds to maybe grow or expand you know the improvement that you see in the near term.

You know, I I might be confused, but you know, I I certainly think that the findings that we'll find under this services contract will be shared with the public.

We will talk with our partners and stakeholders in the public prior to implementing these changes.

And uh, but you're saying we need to make the improvements before we have the money to hire the people to make the improvements.

I guess that's what I'm saying.

And we've got a budget that's coming up now, and I suspect that the budget you put forward is going to include at least cost of living raises.

And you know, they may find that you know you can't have an inspector for $35,000 a year.

You know, you gotta pay them $50,000 a year, you know, and there's wiggle room in the budget currently with positions that are not filled that you know, let's try to work within what we got before we start and and realize an improvement and then put forward some suggestions of how you want to expand on it by adding additional revenue.

And I I just don't want it to come to us just with an ask and say, hey, give us more money, and we're we'll promise you we're gonna do better.

You know, the only ask we have right now is 60, 49 for a contract.

And they're gonna evaluate it, right?

But the result, the product that's going to result from this is going to be these are the areas you should uh increase your permitting fees in.

Okay, and I'm just asking that when you come and make that request to increase your permitting fees, that you have some real results that you can produce to show that you've already started making some improvements, uh whether it's hiring the positions that you don't have filled, or you know, you you show that you move permits at you know a faster rate where there's some momentum going into it, not just now we got all this money, now we got we bought ourselves time to sort of figure it out later.

It's been it's really lingering all yeah.

I think as the mayor said you turn the turned it off.

The city is not trying to make uh make money off of these permit fees.

I mean, we're trying to cover costs, and so when we're talking about the upcoming budget, I think we have to think when is the last time that we raise these permit fees?

And a comprehensive raise didn't didn't occur.

I mean, it was 20 years ago.

17:55

And so when we're talking about about raising the permit fees, it's about covering costs.

And the reality is is that if we do not raise the permit fees, those costs are still being incurred.

Again, it's been 20 years.

So you've had increases in salaries.

I mean, think about how much everything, how much more everything costs now than it did 20 years ago, right?

And so if you look at our current cost uh for set for staff, um, that's something that's going to be borne by the taxpayer if it's not borne by these applicants and the increase in permit fees.

So that's just I think something that we need to remember is that the cost are coming either way, and so I think we just have to remember when we look back um over all of this time period.

I mean, this is this is something that we've got to address now, uh, or else the cost is going to be borne by the taxpayer.

I look, I I totally get that perspective, right?

That there is likely an adjustment that it's needed to in order to cover our cost, no question about it.

But whether or not you ask for you know a 50% increase or a 500% increase, you know, based on your future additions of positions or you know, increasing capacity, whatever it is, I think that's important.

And if we're going to be asking for 500% increase, then we need to show some real measurable results in a plan where that's justifiable to the people buying permit.

Without question, we agree we will have measurables in this study.

Um first of all, thank you for the evaluation and review.

And you said it's been 20 years since we've done this, so that's definitely a step in the right direction.

But uh, similar to um what Mr.

Reynolds um has shared.

My my justification would be, you know, when you look at the uh review of the permitting process, I realize that they've excluded the fact of peer um fee comparisons.

So for example, when we when you do bring to us what the new price uh the new fees are going to be, will we have some type of comparison?

Because I think that's going to be a strong justification.

But in this contract is showing that that's not going to be a part of this.

Yeah, and that's I mean, that's information that we already have to a large extent.

I mean, we can I think we can get you that now, right, Shelly?

Yeah.

Well, at the at the end of the day, we we are constantly um measuring our uh user fees, procedural process, all of the things that we do within our department against peer cities of a comparable size so that we can understand where we rank in a number of cat categories.

So that that is definitely information that we can share.

And I think, and thank you for that.

So I think that again, you know, like you said, it's been 20 years, and I think that if we can share that when we bring it forward to see where we are compared to others, that is strong justification in itself.

I mean, there's there's no doubt there are people that are much higher than us, you know, and there's no question that it's low, but um so you know, they're justified in making requests.

Well, let's make sure that we're going to get the results, not just raise fees and then everybody relax and say, well, we'll we'll figure it out at some point.

You know, let's use this as the sort of provocation to make it better.

Um, I did have a couple questions just from the public standpoint.

Can you just share everything that this contract like what would they be looking for in this service?

And how long would it take for us to receive that information back?

So um we expect within um a hundred and twenty days, and that's in their scope, that we will get a final report um that offers recommendations.

Um in our communication with the consultant, um, it will be recommendations that could be phased over a period of time.

We're not suggesting that there will be a radical increase in permit fees all at one time.

Um the other piece um within the contract is helping us to understand as they're evaluating cost recovery, um, reviewing our processes how we can prioritize around the types of things that we need to focus on within the within the process um to make to enhance greater efficiency in terms of uh what we do.

Um, but the the generalized steps in the uh process, they'll go through a period of evaluation uh with the Bill Mobile staff to understand our fee structure.

That's just that's not limited to bill Bill Mobile.

There are other departments that participate uh in the permitting uh process, so their fees will be evaluated evaluated uh as well.

Um then they'll move to a cost for service analysis, um, the number of hours spent based on the uh professional that's involved in that process to determine where there may be any gaps.

Um they will develop a model uh for us to utilize.

So once this contract is complete, we'll have a template in place so that we can use to re-evaluate um uh our our process as well as the associated fees um over time.

Uh they'll submit a draft for staff to review and then the final report will come to us.

And at that point, um, it is not our plan to come to you all and ask for a fee increase.

It's just to simply say uh the fees are their findings and these are their recommendations to give you an opportunity to evaluate that for yourselves.

And we'll also be um communicating with stakeholders within the industry to get feedback throughout.

With any um changes, uh um, I guess 120 days, like three months.

Well, four months, yeah, four months.

And so um with the but was this affect anything with your department dealing with the budget with any recommendations?

So because of course the budget cycle is we we're we're in the the budgeting um process, and so um as um the mayor uh indicated, there we we're constantly looking at to see where our salaries compare across the region, making sure that we're right sizing our salaries so that they can be competitive and also to help uh to retain the professionals uh that we need, but we're also evaluating the positions themselves to ensure that we have the right structure of professionals within that process.

So that's just a natural part of our budgeting um process, and and it's it's it's not limited to the time period in which we develop the budget.

We're constantly evaluating that um throughout the year.

Um so there many of the uh priorities that I think that you all have highlighted, it it is our goal to factor those into the budget planning process.

Now the fee will not likely go into place until I anticipate based on the fact that it needs to be uh adopted and voted on by this body.

Brittany about to ask about these then well yeah okay sort of the same thing Shayla and you you answered a portion of it um since we are in the budget cycle right now um I think the question was will there be funds set aside once we get this information back to put it in motion or do we have to wait till the next budget year in order to do this and and I guess you got to have some wiggle room in your budget in order to make something happen in this budget cycle.

So I I think the good news is that um once approved the budget that we've presented albeit very preliminarily um has contemplated a number of positions with the goal of filling vacants vacancies right sizing those positions in terms of making sure that we have a good competitive salary um but also thinking through the implementation of a a number of initiatives that we're focusing on so I can say preliminarily those things have been factored into the uh current budgeting process um albeit not complete but those are things that we we've presented for review which would be some of those liaisons that the mayor has talked about correct essentially yes yeah okay on this subject defined so you expect the revenue line to be higher for this upcoming budget in your budget request the revenue line now that's that's where I'd have to lean on the finance department with regard to the revenue line we've had we've had some preliminary conversations with them about the current revel revenue line um but that that's a discussion that we've only just begun to have with finance.

Okay but in anticipation of this um request to increase the fees that would go into an effect in January it should be a higher revenue line right based on my read and I'm not the finance guru here but I think that that's a sound thought process.

President I do um because I know we kind of moved pretty quick I had a question regarding um the drainage um at um the streets that we receive I I appreciate you putting a repair list and label each district um and these some definitely areas that I truly need in my area but what my question um is based on the bid is this only the amount that we can do those streets that we had that you shared with us on yesterday.

We don't have quotes for each one of the items you know so some of those might come in 10 or 15 thousand dollars some of them might come back 30 or 40 thousand dollars.

So part of it depends on uh you know how much each job is going to cost we're really aggressive in getting value out of our contract so I think that we can do virtually everything on that list for the money we have if not it'll be done early next fiscal year when the contract renews.

And then I think last week you said that um we can send some more suggestions of being able to look at areas okay I mean it my estimation is that the things that I've sent to you all will be completed probably by the end of the year in the worst case scenario.

So that means I'm gonna I'm still gonna need stuff for the second half of next fiscal year anyway.

So regardless of how you chop it up I'm still going to need more inputs as we expect we're gonna find more as we continue to do vegetation removal.

You know we've done over 25 miles of vegetation removal on our ditches already uh we've still got a lot to go and every time we go into a ditch and start removing vegetation we find a washout or we find a ditch panel that's failed or a crushed outfall or whatever.

So we're gonna continue getting those inputs from the field but some of those we can repair in house so that's a relatively staggered flow of of locations that we can use this contract for so anything you see in your district that is a suitable drainage infrastructure project we're ready to do it.

All right thank you Matt y'all spray as well the hand spray yeah we we have uh we have two in-house spray technicians that do herbicide application and we also have a spray contract that does large bulk sprays so everything that's been cut this year has also been sprayed with herbicide and the idea really for these ditch contracts is to get up to get rid of the legacy growth like a like a tree that's there and you would remove the tree and now you just have to deal with your your new growth therefore yeah so a lot of the a lot of the ditches that we've done vegetation removal for haven't been cut at all in the last 25 years.

Uh that is to say, within the living memory of the people in the department that have been doing this work.

We've not done it internally at all.

So what the contractors are doing, they're going in with some equipment we don't have, and they're doing it very aggressively, mulching a lot of stuff down.

Some of the bigger trees they're not messing with because of some risks that are involved with that.

So we're having to go back systematically and remove, you know, medium-sized trees as well.

But this contract also can include tree removal.

So if they're going in and they're doing sediment removal, you know, some of the sediment islands you see in our bigger dishes also have trees growing in them.

They can remove the sediment island and take the tree out as well.

Yeah.

So I know that was kind of a complicated answer to a simple question.

I was supposed to that's what we were after.

But I still see some where we've done the vegetation removal where there are trees still.

And I guess that's because roots have gotten into the infrastructure and they're holding it together.

Unfortunately, unfortunately, some of the dishes that have gabian baskets, the roots of the trees have gotten into the Gabian, so that's a lot more intensive.

So you can remove that tree, but you're going to tear your basket up in the meantime.

So we're also having to repair that Gabe in after we do that, otherwise, that whole wall could fail.

So I know that's uh unsatisfying, but the really the worst, some of the worst you see are actually ditch panels that are now being forced apart by trees.

So you see those some of the ditches that are getting very buckled and kind of losing the natural geometry that you would expect because of the trees that have been unattended for decades.

But the this contract will alleviate that.

I mean, it's it's really amazing what a difference it makes.

We have approval of minutes from July 7th. Any issues anyway. No, sir. Okay. Appeals, we have requests for wave the noise ordinance on October the 18th from 10 a.m. until 4 p.m. on McGill Avenue. Okay. Public hearings. This a public hearing to consider the proposed rezoning of property located at 2609 and 2651 Spring Hill Avenue, 152, 157, and 159 Mobile Street and 144 Highland Avenue from R1 and B3 to B1. Public hearing. Today's a public hearing to consider the proposed rezoning of property located at 4630, 4700 4960 Dolphin Island Parkway from B3 to B3 to remove a previous condition of the rezoning. Public hearing to consider the application for the rezon of property located at 5101 Moffat Road from B2 to B3. Vice President. Yeah, these these next two are mine. This one, 5101 Moffat Road. They are looking to put in a used car lot with some light mechanical. The I watched the planning commission meeting on May 21st to, you know, just get a little bit more background. The building that they are looking to use because he said they wanted to remodel the building that's there. It's been vacant since 2000. There apparently was some kind of an attempt by the city at one point to maybe put it on nuisance abatement. Something happened. But at any rate, the building has been sitting there and it's it's pretty much a blighted condition. So they say they will come in, they will clean up the lot, and they will remodel the building for an office, three roll up car bays. And then they will have the cars that they want to sell parked out. I'm not sure exactly where. When I watched the meeting, it was really unclear uh exactly what they were going to do with the site, but at any rate, they're going from asking to go from a B2 to a B3. This sits it's a small strip of I say small, but it's a strip of property that uh Moffitt is on one side and overlook is on the other, because you kind of can cut through from Moffat to Overlook and get to university from that area. So everything around it is primarily a B2 across Moffat, and there is a daycare center and residential. So the planning commission recommended denial. Didn't really have much to say about it when you when you watch the meeting. So I'm sure we'll hear from the applicant today to see what they you know have. We can ask some questions about exactly what it is they're looking to do, exactly what the site plan will look like because again it was kind of unclear um during the meeting. Okay. All right, now Clark. Public hearing to consider the proposed rezoning of property located at 5361 Moffat Road from R1 to B3. And this is another one. It's like, you know, you get two in a row. Um, this one is an R1, surrounded by R1 on the east side, the west side, and then back of it on the south. If you remember some time ago, there was a subdivision that was um planning to go in, and the uh applicant wanted to put in a street that cut through a neighborhood and went to this subdivision, and the neighbors were opposed to it because it would go through their neighborhood. And at any rate, uh the planning commission denied it, we denied it, but they went to court and it was overturned. So just giving you some background on the on the area there, but um the applicant here uh wants to put in a realty office. Um a realty office in and of itself would be kind of light, light impact. The problem is that she is applying for a B3 because of what she wants to do on the site, which would include some moving vans and also putting in a storage building in the back. She also wants to increase the size of the the house by over another thousand feet plus. So um, there's just a lot of questions about that. And the neighbors who I've talked to said they went to the neighborhood meeting, um, thinking it was about the subdivision next door that they had been opposed to what was happening there.
