Speaker 2

0:25

Any discussion?

Unassigned speaker

0:27

We

Speaker 2

0:28

do have Jeff Nysitz who's online with us.

0:30

Uh he worked closely with uh Frank.

0:34

Yep, Frank.

0:35

So Jeff, do you have anything to say at the

Unassigned speaker

0:38

moment?

Speaker 2

0:41

Yeah.

Unassigned speaker

0:53

Well,

Speaker 2

0:53

either way, the applicant is um applied for a variance from the 20 foot or for a 25-foot rear setback to allow construction of a about 1300 uh square foot two-story addition to his existing property.

1:09

Um the hardship that is kind of presented before you is that there's not a whole lot of property back there.

1:14

He actually purchased property from his backside neighbor to put this addition on.

1:20

Um so with that being said, you're looking to reduce that setback so that he can put that addition on his property.

Speaker 3

1:29

So if you could just you know explain what you explained before and uh dealing with the neighbors in the north and to the neighbor to the west.

Unassigned speaker

1:42

Yes, it just pushes it.

Speaker 2

1:44

Yep, it'll light red on you.

Speaker 4

1:45

Okay, can you hear me?

1:47

Yep.

1:47

Um yeah, so the neighbor to the north and I shared a property, a driveway and a garage.

1:55

And it's just not a good idea to have that continue.

1:59

So I thought even if I had sold the property at some point, it's gonna be hard to sell a property with an attached um a shared driveway and a shared garage.

2:07

Luckily, all the neighbors I had in the past were you know very accommodating.

2:12

Um and then John had been asking John Carpenter, he's the neighbor to my north for a few years to purchase the property, and last year he agreed because he wants to do in a detached garage from his house and take that money survey it and buy some land from the neighbor to the north.

2:28

So um I agreed, but part of the agreement was that his garage had to come off of the property, and I was willing to like if I could have just bought it, but it would have been on his land, so there was no way to not tear it down and and get rid of it.

2:44

So

Unassigned speaker

2:44

and

Speaker 4

2:45

he was kind of anxious about like you know, are you gonna make a decision?

2:47

I'm like, okay, I you know, so

Speaker 3

2:50

that's where we're

Unassigned speaker

2:50

at.

Speaker 3

2:52

But there's no property from the west that you're taking that you're they bought either, right?

2:57

No,

Speaker 4

2:58

um Jeff Jeff, I I originally asked Jeff before this happened, I met with Jeff twice, and I even have an email stating like is there any um I said I don't want to do this unless I have a viable plan, you know.

3:10

I don't want to tear the garage down.

3:12

Well he met with me out there and said, Well, if you buy 25 feet of your of the neighbor to the south and to the west of me, which is Twitty, um, he said you could build a detached garage.

3:23

And I asked Jeff, and Jeff goes, well, I'm not one of sell you that, you know, and and I I've talked to other people, and they said if you have a chance to buy any property, you should take it because nobody ever sells any property.

3:34

So then Jeff came out there and we said, Well, he goes, probably your best option is to do an attached garage because your property is actually 85 feet deep, and I think there's a different variance for an 85 foot deep private property that's or that's under under 100 feet, so it's not quite as much.

3:53

Um, I don't I think the required setback is 18 feet or 17 feet versus 25.

3:59

So he he said that that's what we should do, and you should apply for a variance.

Unassigned speaker

4:08

So

Speaker 5

4:08

all

Speaker 6

4:08

your

Unassigned speaker

4:09

so

Speaker 5

4:10

all your neighbors are aware of what you want to do.

Speaker 4

4:12

Yes, both I mean I have a letter from my neighbor, um John.

Monroe Zoning Board of Appeals Meets October 26, 2026

The Monroe Zoning Board of Appeals met on October 26, 2026, to hold a public hearing and consider one variance request: Frank Meier's application for a rear setback variance at 1121 21st Avenue. After hearing from the applicant, city staff, and a planning consultant, the board approved the variance.

Public Hearing & Testimony

  • The board opened and closed the public hearing; no members of the public were present to comment.
  • The applicant, listed on the agenda as Frank Meier and identified as Frank Mayer in the transcript, explained that he and the neighbor to the north shared a driveway and garage. He purchased property from that neighbor to make the proposed addition possible, and the agreement required the shared garage to be removed.
  • Meier said he had informed the neighbors, had a supportive letter from one neighbor, and noted that two neighbors to the west could not see his property because of trees; one neighbor he spoke with had no objection.

Discussion Items

  • Staff: Jeff Nysitz, who worked with the applicant, said the variance would allow construction of an approximately 1,300-square-foot, two-story addition. He cited the limited depth of the property as the hardship and said reducing the setback would allow the addition to fit on the lot.
  • Setback details: The property is about 85 feet deep. The applicant referenced advice that an attached garage was the best option and that the required rear setback for a lot under 100 feet deep might be 17 or 18 feet rather than 25 feet, but a variance was still requested.
  • Drainage: A board member asked how roof runoff would be handled because the addition would replace open grass area. Meier said the area drained well, recalled an 11-inch rain about 30 years ago that caused sewage backup, but said later storms drained fine. He planned to re-grade and slope the driveway area to the street and would address any neighbor drainage concerns.
  • Precedent: A board member asked about the potential for setting a precedent. Shannon Eden of Bandwell and Associates said variances are intended as one-off remedies for unique lot conditions, that staff vets requests before they reach the board, and that the small lot here creates an unusual building envelope; this type of request is rare.

Key Outcomes

  • The board approved the variance for 1121 21st Avenue. The motion passed on a roll-call vote, with all responding members voting in favor.
  • No other business was conducted; the board adjourned after the vote.
