Today from City Staff, we have Nicole Rodriguez, the Harbormaster, uh, assistant city attorney, Karen Cratley, and uh city attorney, Christine Davy.

4:49

Chrissy, with uh Mr.

4:50

Abby, would it be best to start with the public comment verbiage?

4:54

Now, I think that's a good idea.

5:00

Oh, I'm sorry, we do need to acknowledge that uh the teleconferencing will not be taking place as um the board member um who was going to be teleconferencing in has um decided that he will not be able to make it today.

5:14

Okay.

5:15

So now we will uh I'll read the uh public comment uh verbiage.

5:23

Public comment and participation information is provided on this meeting's agenda, which is online at Monterey.org backslash agendas.

5:32

In-person attendees, please keep your electronic devices muted to prevent audio interference because consistent with the First Amendment and the Brown Act, individuals have the right to speak at public meetings, which includes the right to criticize or support city policies or actions.

5:47

The city encourages your uninhibited and robust feedback on public issues affecting the city.

5:53

Thank you for your participation.

5:55

Okay, and with that, we will go to the consent agenda, which um we have one thing on the consent agenda, which is the approval of minutes for August 20th, 2026.

6:07

Do I have a motion to approve?

6:12

Second.

6:12

A second.

6:13

Okay.

6:14

Let the uh record reflect that the uh motion has passed two to zero.

6:20

And now they vote.

6:22

Did they vote?

6:25

There was a motion in a second, but so um all in favor.

6:30

Okay.

6:32

No, it's approved.

6:33

I'm so glad you're here, Miss Abby.

6:37

Okay, now we will move on to um general public comments.

6:41

And let's see, do we have anyone online?

6:44

Seeing no one online.

6:46

Anyone in the chambers like to make a public comment?

6:50

None in the chambers.

6:51

We will close public comments and move on to our public hearing.

6:57

And I can go ahead if you want.

6:59

Okay, this is a public hearing.

7:01

The title is appeal by Eric Foster of Harbor Master's Revocation of Mooring License and Live A Board Permit in the Monterey Harbor pursuant to Monterey City Code sections 17-33 subsection K and 1743 subsection F3.

7:18

And at this time, the board, if you could indicate if there's been any ex parte contacts, meaning if you received any information relevant to this appeal that's not contained in the staff report that might be um relevant to this issue if you could disclose those ex parte contacts.

7:39

No ex-party contacts, great.

7:41

And then I'm gonna make a statement about the role of my office in this proceeding.

7:45

I'm the city attorney, I'm representing the board in this hearing.

7:49

I've had no um information or contact with city staff on this other than receiving the packet at the same time as the board and the public.

7:57

Assistant city attorney Karen Cratley is representing the department in this matter.

8:01

She and I have not discussed it, and we've um maintained an ethical screening wall.

8:06

And the reason for that is to ensure due due process so we don't have the same attorneys um intermingling and and advising both uh the department and the decision maker.

8:18

So we do that to ensure due process.

8:20

And so with that, the way the procedure works for these hearings is um each side may have an opportunity to do an opening statement if you wish.

8:28

Then we're going to hear from city staff first to do a presentation because the city carries the burden of proof, and um, if there's any witnesses, we'll swear in the witnesses, and the um appellant has the opportunity to cross-examine any witnesses.

8:44

Then we'll hear the appellants presentation and the same thing.

8:47

Any witnesses can be called and sworn in.

8:49

Uh, then we'll take public comment, and after public comment, there'll be an opportunity for both sides to issue rebuttal testimony um and comments, and then finally we'll have the deliberation and the vote.

9:04

So with that, if there's any opening statements, um, if you could let us know.

9:11

So we um the department prepared a PowerPoint presentation, which could serve as our opening statement if the board would like, and then um we could go from there.

9:23

Okay, okay.

9:24

That sound good.

9:25

Okay, great.

9:26

Okay.

Monterey Appeals Hearing Board Meeting – September 17, 2026

On September 17, 2026, the City of Monterey Appeals Hearing Board convened at 10 a.m. to hear an appeal by Eric Foster regarding the Harbormaster's revocation of his mooring license and liveaboard permit. The board voted 2-0 to deny the appeal, upholding the revocation effective October 1, 2026, due to Foster's non-compliance with the city's vessel insurance requirements.

Consent Calendar

  • Approval of Minutes (August 20, 2026): The board unanimously approved the minutes with a 2-0 vote.

Public Comments & Testimony

  • No members of the public made comments either online or in the chambers.

Discussion Items

  • Appeal by Eric Foster: The hearing centered on Foster's appeal of the Harbormaster's decision to revoke his mooring license (mooring 21) and liveaboard permit, effective September 24, 2026 (later amended to October 1). Staff presented evidence that Foster failed to provide proof of vessel liability insurance (minimum $300,000, with the city named as additional insured) as required by Monterey City Code Section 17-33M, adopted September 1, 2025, and enforced through multiple notices since December 2025.
  • City Staff Presentation: Harbormaster Nicole Rodriguez testified that Foster is the only recreational vessel owner in the harbor who has not complied with the insurance requirement. A small group of commercial fishermen (the "mosquito fleet") were granted a hold due to ongoing code amendments. Rodriguez stated that the city's revocation notice provided 30 days' notice as required by code and contract.
  • Appellant's Testimony: Foster acknowledged the timeline but argued that the city acted illegally by using its sovereign authority (police power) as a landlord to change contract terms midterm, citing contract law and California Civil Code protections against retaliatory eviction. He claimed that other tenants had not yet provided insurance without facing revocation, and that the revocation notice was issued just days after he raised legal objections. Foster stated he does not have insurance and has no intent to obtain it under the current framework, but requested a remedy through lease renegotiation rather than revocation.
  • Board Deliberation: Board members considered Foster's arguments but noted that the mooring license agreement (signed in 2015) allows either party to terminate with 30 days' notice. The board concluded that the revocation procedure was properly followed and that Foster's non-compliance was undisputed.

Key Outcomes

  • Motion to Deny Appeal: Board member Shell moved to deny the appeal, with a second from board member Fritz. The motion passed 2-0.
  • Revocation Effective Date Amended: At the request of the board and with city staff's agreement, the revocation effective date was changed from September 24, 2026, to October 1, 2026.
  • Final Decision: The board adopted the proposed decision (attachment five) as modified, upholding the Harbormaster's revocation. The decision is a final administrative order subject to judicial review under Code of Civil Procedure Section 1094.6.
