2:33

Therese Egner with the city's planning services team.

2:36

DEV 00172026 is a request submitted by the petitioner for approval of a variance to allow a deck to encroach into the rear yard setback at 501 Larksburg Court.

2:49

The subject property is zoned R1A, low density single family residence district, and is approximately 13,001 square feet in size and is improved with a single family residence and existing deck.

3:02

The property is a corner lot located on the northeast side of Braymar Avenue and Larksburg Court.

3:08

Per the R1A zoning district regulations, the property has a rear yard setback of 25% of the lot depth, which need not exceed 30 feet.

3:17

Based on this provision, the subject property has a 28.65 foot required rear yard setback.

3:24

The code provides an allowance for patios, decks, and porches to extend up to 10 feet in the required rear yard setback.

3:32

This results in an 18.65 foot permitted setback from the rear property line for attached decks at the subject property.

3:41

An attached deck currently exists on the subject property in the rear of the home, located in the same footprint as the proposed deck.

4:02

The petitioners and property owners are proposing to remove the existing deck and replace it with a composite deck, triggering the need for a variance.

4:10

The petitioners and property owners are requesting approval of a variance to allow the proposed deck to encroach 12 feet four inches into the 28.65 foot required rear yard setback, two feet and four inches further than permitted.

4:24

If approved, the deck will be replaced to remain in its existing location on the subject property.

4:30

Staff is in support of the variance due to the unique lot configuration and finds the purpose of the yard requirements is to prevent the overcrowding of land and to preserve sight lines and the open nature of the rear yard.

4:42

The proposed on roof deck maintains an open rear yard and will not exceed its existing footprint.

4:48

Staff now request you conduct the public hearing, and I will remain available for questions.

4:53

Thank you.

4:54

Good evening.

5:12

Sir.

5:13

Is there a full view?

5:20

Oh, there we go.

5:22

We can do it from this, I guess.

5:23

Is there a person presentation?

5:29

There you go.

5:30

Okay.

5:31

So this is a deck.

5:33

Again, I'm Vince Papillardo.

5:35

Um I own the property.

5:37

Thank you for coming because you came just for me, right?

5:39

I appreciate the time.

5:41

I really do.

5:41

Um while I joke, you know, we're trying to replace the deck that was there when we bought it.

5:48

Um we moved into the house 2022, so it's been there for about 24 years.

5:53

I think it's 25 or 30 years old.

5:56

Um, obviously I tell you we've never had a complaint.

5:59

What's really interesting about this, and so I put this up here and I wonder if I can point.

6:04

So the part that is at issue is actually just this little corner here.

6:08

The two feet is this direction, and because the angle of the the house to the back property line, it's not even, you know, it's that amount, kind of in the in the back.

6:22

So it's really not a lot.

6:24

The reason we're we're sitting here you'd have to change your landscaping and have a uh the deck people want a design fee if you change the way that how big the deck is because now they have to figure out where the footing's go and stuff like that.

6:37

So um it really, you know, it's not a lot of space, but it ends up being more cost than coming here and passing you guys for an evening.

6:46

So appreciate it.

6:47

You know, this is the deck.

6:48

This is the part that we're talking about that actually overlaps, and then you know, the the sidewalk view is over here, and we're talking about this area right here.

6:59

But you know, again, we didn't build this deck.

7:03

We're here because we get permits.

7:05

Um, apologize if the prior owner didn't or if it got lost or what, but uh it apparently given the lot size and the angles, it means that it's two feet at the corner a little bit beyond where it should be.

7:18

I think that's about all I've got for you.

7:20

So if you've got questions, love to handle them.

7:23

Alright, thank you very much.

7:24

Um I'd like to hear from any members of the public present tonight to speak on this case, Secretary Wright.

7:29

Please call our first speaker.

7:31

No one's here.

7:32

All right.

7:32

Are there any members of the public that would like to speak on this case?

7:37

I don't think we do.

7:39

Um do any commissioners uh have any questions on the case?

7:43

Uh please note that questions may not be directed to the petitioner or members of the public after the closure of the public hearing.

7:49

Further comments should be saved for deliberations of which will occur after closure of the public hearing.

7:55

Uh, any commissioners have any questions?

7:58

Uh Commissioner Longerbaugh.

8:00

Well, thank you, Chair.

8:01

Um, so just to confirm, I went up there.

8:03

I mean, this is not going to be an issue at all, but you're basically just doing the exact same footprint of this thing, but just different material.

8:11

That's it.

8:12

Exactly.

8:13

That's what I thought.

8:13

It's 30 years old and it's starting to get wholesome.

8:15

Yeah, that's what I thought.

8:16

Good.

8:16

Thank you.

8:18

Okay.

8:19

Commissioner Wright.

8:20

Thank you, Chairman.

8:21

And and this is really more of an educational piece for anyone that might be watching.

8:26

Um, I just want to, because you you made a couple comments that I think are important.

8:30

Uh, the deck was already there.

8:32

That that doesn't necessarily uh mean that we would approve it.

8:36

And the fact that um there's additional potential additional construction costs that would also not be a necessary reason for us to prove.

8:45

We would approve it more because of the hardship that it creates in the sight lines and and the um overcrowding of land.

8:51

That that's what we would really look at as the hardship.

8:54

So I don't see any problems with this one, but I just wanted to educate the public that those are the things that we would be looking for.

9:01

Fair enough.

9:02

Thank you, Commissioner Wright.

9:04

Uh would the petitioner like to make any closing remarks?

9:08

I think we're good.

9:09

All right.

9:10

Okay, so now I'll entertain a motion to close the public hearing for DEV 0017-2026.

9:17

So moved.

9:18

Second.

9:20

All in favor?

9:21

Aye.

9:21

Aye.

9:22

Opposed.

9:24

Motion carries.

9:26

Um, do any commissioners have any comments on the case?

9:29

As a reminder, if you intend to recommend denial of the case, please state your reason why.

9:35

No.

9:36

Okay.

9:29

So I'd like to make a motion to adopt the findings of fact as presented by the petitioner.

9:42

And am I doing that?

9:44

I'm giving oh I don't want to see your thunder.

9:46

I apologize.

9:47

Uh Commissioner Longerby, would you please read the motion?

9:50

Thank you, Chair.

9:55

I would like to make a motion to adopt the findings of fact as presented by the petitioner and recommend approval of DEV 0017 2026.

10:04

A variance to allow a deck to encroach into the required rear yard for the property located at 501 Larksburg Court.

10:13

Can I have a second?

10:14

10:15

Okay.

10:16

Secretary Wright, please conduct a roll call.

10:19

Yes.

10:22

I agree.

10:23

Castingoli.

10:24

I approve.

10:26

Agree with the motion.

10:27

McDaniel.

10:28

10:29

Thank you.

10:36

Summary of Proceedings

Planning and Zoning Commission Meeting – May 20, 2026

The Naperville Planning and Zoning Commission met on Wednesday, May 20, 2026, at 6:00 PM in City Council Chambers at 400 S. Eagle Street. Vice Chair Derek McDaniel presided over a 7-minute meeting that included one public hearing on a variance request for a deck at 501 Larkspur Court and routine approval of prior meeting minutes. The meeting adjourned at 6:10 PM.

Public Forum

No members of the public signed up to speak during the public forum portion of the meeting.

Public Hearing: Variance for Deck at 501 Larkspur Court (DEV-0017-2026)

  • Staff Presentation: Therese Egner, Community Planner, presented the request for a variance to allow a proposed composite deck to encroach 12 feet 4 inches into the required 28.65-foot rear yard setback on a corner lot zoned R1A. The code permits a 10-foot encroachment for decks, so the variance seeks an additional 2 feet 4 inches. The existing deck occupies the same footprint and is approximately 30 years old. Staff recommended approval, citing the unique lot configuration and that the replacement would not exceed the existing footprint, preserving sight lines and open space.
  • Petitioner Testimony: Vincent Pappalardo, the homeowner, stated he moved into the house in 2022 and wants to replace the aging deck with composite material. He noted that the encroachment affects only a small corner of the deck and that modifying the deck’s size would incur additional design fees. He did not present additional witnesses or public testimony in support.
  • Commission Discussion: Commissioner Allison Longenbaugh confirmed the deck would remain in the same footprint with different material. Commissioner Mark Wright clarified that the variance would be evaluated based on hardship (e.g., preserving sight lines and preventing overcrowding) rather than the deck’s pre-existing condition or potential cost savings. No other commissioners voiced concerns.
  • Public Testimony: No members of the public registered to speak or attended to provide testimony on the case.

Reports and Recommendations

  • Minutes Approval: The Commission unanimously approved the minutes of the April 15, 2026, Planning and Zoning Commission meeting by voice vote, with no corrections offered.

Key Outcomes

  • Variance Approval (DEV-0017-2026): Commissioner Longenbaugh moved to adopt the findings of fact as presented and recommend approval of a variance to Section 6-2-3:3.2 (Yard Requirements: Permitted Obstructions) to allow the proposed deck to encroach 12 feet 4 inches into the required rear yard setback at 501 Larkspur Court. The motion was seconded by Commissioner Naumes and carried by a recorded vote of 7-0 (Commissioners Abubaker, Bansal, Castagnoli, Longenbaugh, McDaniel, Naumes, and Wright voting aye; Richelia and Robbins absent).
  • Acknowledgment: Vice Chair McDaniel recognized Commissioner Carl Richelia, who was absent, for his six years of service on the Commission (two terms), noting this was his last meeting.

Adjournment

The meeting was adjourned at 6:10 PM by a motion from Commissioner Castagnoli, seconded by Commissioner Naumes, carried by voice vote.
