The Board of Public Works & Safety met on July 21, 2026, at 10:00 AM at New Albany City Hall. The meeting addressed several permit requests, utility repairs, a fiber optic encroachment permit, special events, and administrative items.
Public Comments & Testimony
- John Kraft (attorney for Al Cardoso) requested a second curb cut at 2700 Kaywood Drive to accommodate five vehicles. The Board of Zoning Appeals had tabled the variance and directed the applicant to the Board of Public Works first. The motion to approve included conditions: residential use only, not for storage, and installation of a hard surface within one year. Approved unanimously.
- Pat Hauersperger (Dave O’Mara Contractors) presented multiple IAWC water infrastructure repair permits: 619 E. Oak St. (sidewalk cut), 210 E. Elm St. (valve box repair), 730 Rolling Creek Dr. (hydrant/valve replacement), and additional items at 606 Captain Frank St., 608 Pearl St., and 4000 Melbourne Dr. All approved.
- Mr. Padilla (Your Home Roofing) requested a street and sidewalk closure at 302 Pearl Street to replace flashing using a 35-foot boom lift. Approved for Friday 8 AM to 4 PM and Saturday 1 PM to 6 PM with proper signage, avoiding the farmer's market on Saturday morning.
- Cecubly, a resident at 1926 Eakin Avenue, requested a dumpster drop-off blocking street parking for a few days. Approved.
- Tim Phillips (Lumos Fiber) presented the encroachment permit for fiber installation in the Klerner Lane, Rainbow Drive, and Mt. Tabor Road areas. - Larry reported on TARC route changes: the city requested data on decision-making but has not received it; TARC replaced signs on unchanged route segments without Board approval. Planning director Scott confirmed no consultation. The Board was informed but took no action.
- Mickey Thompson requested a dumpster at 18 Robin Road for Allen Moeller. Approved.
- The controller provided bank reconciliations for March and April 2026, noted for the minutes.

Curved cut request, K with Drive. Yes, please. For the record, John Kraft of the law firm of Young Lynnerson Kraft, 126 West Spring Street in New Albany appearing on behalf of Al Cardoso. I believe Mr. Thompson has been to this site, but uh ultimately the request is for a second curb cut. Uh and this lot, lot 33, uh 2700 uh is the address on Cape Wood Drive. The the reason being is the individuals currently have five cars. Uh and if you've been to the site, uh you'll notice that this sits on a call-de-sac. Uh the result tends to be that uh we apply for a variance through the Board of Zoning Appeals and appeared before the Board of Zoning Appeals on July the second uh to get the variance and certainly it's uh the chicken and egg routine. Uh uh Board of Zoning Appeals indicated, well, you need to go to the Board of Public Works first and then deal with it uh through the Board of Public Works asking for that second curb cut. Uh we are here today asking for that, and certainly uh what happened with the Board of Zoning Appeals on July the second uh is they tabled the matter uh in order to address uh us to appear before the Board of Public Works in order to get the second curb cut and then ultimately if that being approved and meeting the requirements of the ordinance as to paving that, meeting the requirements uh specifically as it relates to the definition of a driveway under the terms of the New Albany City zoning ordinance. Uh I'll take any questions you may have, but uh ultimately it's try to keep uh the number of cars. These folks have five, keep the number of cars off the street. Uh if you've been to the site, you'll notice that they're already there, uh parked cars. Uh I went to the site today that we're zoning appeals hearing, and there were two cars already parked there, and my clients were not part of those two cars. So we're here today asking for a second curb cut in order to uh for lack of a better way to say it, approve this uh second curb cut and then ultimately pay that uh pursuant to the terms of the zoning ordinance. And I did do a side visit and have photo for the board to look at uh the second driveway is requesting is the driveway to gravel driveway that has the white vehicle parks in it. So was he not aware that he needed permission to do this? No, ma'am, he was not it was only after Mr. Thompson visited that uh he became aware of that. Can it get Johnny if they get two cars in that driveway and not block that sidewalk? I've been there. Um I can't say depending upon the size of the car is going to make that determination, but when you have five, it's a little difficult to deal with it. That property has a garage as well? Yes, ma'am. One or two cars. Uh it's one car if I'm not mistaken. Okay. How far back's that go on? All the way around the house. All the way back here. Oh, shoot. Is that the new one that goes all the way back? The new one go all the way back, or is that a new one? Yeah, no, the the one for the house just goes to the garage. Uh and there's not room for a second vehicle in that driveway without blocking the sidewall.
