You ready to start Mr.

13:58

Mitchell?

13:59

Okay.

14:05

The Monday, August twenty-fourth, two thousand twenty-six meeting.

14:36

Okay, we'll have the first illusions by that.

15:02

Okay.

15:03

We'll hear from the city attorney.

15:06

Yes, good afternoon.

15:07

We're here for the first matter regarding Shamrock.

15:11

And I believe they're here.

15:12

I don't know if you'd like for them to speak first.

15:14

Since they didn't file.

15:15

I don't know if you'd like for them to speak first.

15:17

They filed the appeal, or if you want us to go first.

15:20

Okay, well, we're here because they are appealing the loss of their ABO.

15:25

And it's due to the loss of non-conforming use.

15:28

And unfortunately, this board does not have authority to deal with zoning matters here.

15:33

There are legal remedies here.

15:34

They're two different boards that they can actually reach out to and appeal to to deal with their conditional use uh laws here.

15:41

So as right now, we think that this board is not the appropriate place to uh be hearing this matter.

15:48

Okay.

15:50

I understand that the uh chamrock has legal counsel.

15:54

We also have some comment calls, so you can decide if you want your attorney to go first, or if you want to respond to the comment calls.

16:05

Yes.

16:06

Mr.

16:06

Chim, I could I couldn't quite hear you.

16:08

Were you speaking to us?

16:10

Yeah, you have the option of you speaking first.

16:12

Uh the uh persons who are listed on the comment call speaking first.

16:17

Is your option?

16:18

Uh yes, sir.

16:19

So I'd like to have Mr.

16:20

Colvay, who is the owner of the premises, uh speak first, and then uh the owner of the real estate, Mr.

16:27

Uh Heeby, and then I'd like to make some comments if necessary, if they can't tell the whole story, which I believe they probably can.

16:33

Thank you, sir.

16:33

Thank you.

16:46

Hi.

16:47

Um when we came uh June 30th, they uh asked us to make progress on the the code violations that they had shut us down for.

17:01

So when they shut us down, they cited us for 48 code violations.

17:07

And they came and did a reinspection last Thursday.

17:13

It was uh four four inspectors from the New Orleans Fire Department and two inspectors from the State Fire Marshal's office.

17:22

And they were inside Shamrock for two about two hours measuring doorways and uh fire capacity and looking the whole place over for about two hours.

17:33

And they have gotten us down to from 48 violations.

17:36

We just have eight violations left.

17:39

So we've knocked out forty of them.

17:43

Uh the eight violations left were had to deal with uh exit doors and entry doors, uh fire hardware and handrails.

17:53

And today we already have have had a handrail company come out today to give us an estimate on the the handrails, and we had um a door company come out today to give us an estimate on on the doors.

18:07

So hope hopefully all these last eight just things will be taken care of uh within as soon as two weeks, or it could be up to four to six weeks.

18:17

It really just depends on the these companies getting doing their work.

18:22

Thank you, sir.

18:24

Next we'll hear from Mr.

18:26

Do you have anything additional to say?

18:28

We'll hear from Mr.

18:29

Heeby.

18:32

Uh I'm the landlord and I don't have much more to say besides we've been working with Brian to get everything addressed, and I think he's done a good job.

18:40

Young man's trying to get his business back open.

18:42

It's a super impressive business, 17,000 square foot.

New Orleans Alcoholic Beverage Control Board Meeting - August 24, 2026

The Alcoholic Beverage Control Board (ABO Board) met on Monday, August 24, 2026, at 1:00 p.m. to hear two appeals regarding alcoholic beverage permits and to ratify the results of a sales tax hearing. Both appeals involved zoning issues that the city attorney argued were outside the board's jurisdiction. The board voted to refer both matters to the Board of Zoning Appeals (BZA). The meeting lasted approximately [duration not specified in transcript] and included statements from business owners, their attorneys, and city officials.

Public Comments & Testimony

  • Shamrock Bar & Grill Appeal: Brian Colvay, owner, described progress on 48 code violations that led to the city shutting down the business. He stated that after a reinspection by four NOFD and two State Fire Marshal inspectors, violations were reduced to eight, and he had obtained estimates for handrails and doors within two to six weeks. He also noted that the city renewed his ABO permit in 2025 despite the closure, and that a city official later admitted that renewal was a mistake. The property landlord, Mr. Heeby, and attorney David Halpern expressed support, stating the business had 30 pool tables and was an asset to the community. They argued the closure was due to city actions, not voluntary renovation, and requested additional time to reopen.
  • Numbers (Tranica Tobias) Appeal: Tranica Tobias, owner of Numbers at 3735 Ulloa Street, stated she had spent six months going back and forth with Safety and Permits, following all instructions, but faced repeated obstacles. She noted that previous tenants had obtained permits without issue. She was referred to a contact named Chris Young but had not yet resolved the zoning matter.
  • Nancy M. Green: The agenda listed a communication from Nancy M. Green, property owner and landlord of 1535 Basin Street (Frital, LLC), but she was not present at the meeting; no testimony was taken.

Discussion Items

  • Shamrock Bar & Grill (Item 1): The city attorney argued that the board lacks jurisdiction because the permit denial was based on a zoning issue—loss of non-conforming use after 180 days of closure (per CZO Section 25.3.C). The city maintained that the proper venue is the BZA or CPC to reinstate non-conforming use or obtain a conditional use permit. Board member and former CPC chair Clifton Davis questioned the process, noting that the board cannot bypass BZA procedures and community notice requirements. Colvay countered that the city misled him by renewing the permit in 2025, causing financial losses exceeding $400,000, and that he was directed to the ABO board in June without mention of BZA. Safety and Permits representative Philip read the relevant CZO section. The board ultimately concluded it could not grant the permit and voted to refer the matter to BZA.
  • Numbers (Item 2): The city attorney explained that the ABO application was denied due to an unpermitted deck built across lot lines (3735 and 3731 Ulloa). A permit for the deck was submitted in May 2020 but closed out without approval. The business currently holds a temporary ABO valid through October 28, 2026, allowing continued operation as a restaurant. The city recommended going through BZA or CPC for either re-subdivision or removal of the deck. Board members noted that both the business owner and property owner share responsibility. The board discussed that the owner could still appeal to BZA within the window.<br>- Ratification of Sales Tax Hearing (Item 4): The board heard the recommended judgments from the August 24, 2026 sales tax hearing and voted to ratify them unanimously.<br>- Communication from Nancy Green (Item 3): No discussion due to absence.

Key Outcomes

  • Motion to Refer Shamrock Appeal to BZA: Passed (unanimous: 4-0 as recorded; full tally not specified). The board determined it lacked authority over zoning matters and directed the appellant to pursue relief through the Board of Zoning Appeals or City Planning Commission for non-conforming use or conditional use permit.
  • Motion to Refer Numbers Appeal to BZA: Passed (unanimous). The board denied the appeal of the ABO denial and referred the matter to BZA for resolution of the deck and lot line issues. The temporary ABO remains in effect until October 28, 2026, allowing the restaurant to continue operating in the interim.
  • Ratification of Sales Tax Hearing: Motion carried unanimously, approving all listed judgments and continuations.
  • Adjournment: The meeting was adjourned after the consent agenda.
