The Board of Zoning Adjustments (BZA) met on Monday, October 2, 2023, beginning at 10:30 a.m. in Council Chambers. Due to the absence of two commissioners (Candace Forrest and Jose Alvarez), the board lost quorum at noon and recessed for approximately one hour, reconvening at 1:00 p.m. The meeting adjourned around 3:00 p.m. The board heard 17 agenda items, including variances, appeals, an extension request, and election of officers. Several items were withdrawn or deferred.
Consent Calendar
- Adoption of Minutes: The minutes from the September 11, 2023 meeting were approved unanimously (4-0).
- Withdrawn Items: Item 3 (BZA069-23, 1423 General Pershing St.) and Item 10 (BZA090-23, 3725 Sabine St.) were withdrawn.
Public Comments & Testimony
- BZA087-23 (2517 Tulane Ave.): The applicant requested a deferral. Councilmember Harris submitted a late comment (accepted by board). Mary Howell (316 S. Gregory Richardson (representing the owner) countered that the permit was properly issued and the home was rehabilitated from blight.
- BZA086-23 (1120 Lowerline St.): Appellant Deborah Howell spoke at length, alleging misrepresentation of scope, failure to enforce the IZD, and previous violations. Gregory Richardson, the permit applicant, stated that the work was limited to cosmetic repairs and that code enforcement inspected six times. No other public testimony was offered.

- BZA093-23 (1923 St. Charles Ave.): Staff recommended denial of height (11 ft, 1 story) and buffer yard (5 ft) variances. Applicant requested 30-day deferral, stating the project is a hotel with rooftop amenities and that the height variance is for non-visible elements. Deferred unanimously.
- BZA094-23 (2678-2680 Myrtle St.): Staff recommended approval of variances for front yard setback and build-to line. Approved unanimously with three provisos.
- BZA095-23 (1940 N. Rampart St.): Staff recommended denial of parking variances (excessive compact spaces, backing out into traffic). Applicant argued the need for off-street parking in a dense neighborhood. Board expressed safety concerns about vehicle maneuvering and blind spots, and moved to defer 60 days to allow redesign.
- BZA069-21 (1515 Poydras St.): Extension request for an open space variance (additional 12,549 sq ft of open space). Good morning. I would like to call the Monday, October 2nd Board of Zoning Adjustments meeting to order. We will begin with roll call. Candace Forrest is absent. Todd James. Present. Tamara Eggens. Present. Jose Alvarez is absent. Ramiro Diaz. Present. Alfonso Gonzalez. Present. Due to the loss of a quorum, the board will recess for approximately one hour around noon and reconvene after the recess. We apologize for any inconvenience. Staff will be on hand to answer any questions. At this time, would the board make a motion to adopt the minutes for the September 11th meeting? So moved. Second. We have a motion and a second on the floor to accept the uh minutes from last month's meeting. Uh roll call vote. Commissioner Diaz. Yes. Commissioner Gonzalez. Yay. Commissioner Eggins. On the minutes. Yes. And Commissioner James is a yes and that motion pass. As a reminder to applicants, action that the board takes today will be released in the form of a disposition notice by October 12th and sent via email and mail to the applicant as well as posted on the one-stop app for other interested parties. Requests that the board votes to approve must show compliance with any noted provisos before the case is finalized and granted final approval. Two items on today's agenda have been withdrawn. Item number three, BZA 069-23 for the property at 1423 General Pershing Street, and item 10, BZA 090-23 for the property at 3245, 3285 Sabine Street. We will begin with the unfinished business for variances. Will the Vice Chair please read the rule the hearing rules for variances? Thank you. Rules and procedures for the variance requests. Each speaker shall give their name and address prior to speaking on the proposal. The applicant or representative will speak first. The presentation shall be limited to a maximum of three minutes for each applicant or representative speaker, but in no event shall the cumulative presentation total by applicants or their representatives exceed 10 minutes. Proponents or persons in favor of a proposal will speak next and be allowed two minutes per speaker. Opponents or persons in opposition to the proposal will speak next and be allowed two minutes per speaker as well. The applicant or representative will be allowed a rebuttal. The rebuttal will be limited to a cumulative time of three minutes. Additional information. The board of zoning adjustments shall not authorize a variance from requirements of the comprehensive zoning ordinance unless it finds based on the evidence presented to it that each case has satisfied the nine criteria listed in Article 4, Section 4.6F of the Comprehensive Zoning Ordinance. After last month's deferral, staff reached out to the applicant for elevation plans. However, staff has not received those plans at this time. Therefore, we are requesting another 30-day deferral.
