At this time, would the board make a motion to adopt the minutes from the December 4th meeting? So moved. Oh second. It's been moved by Commissioner Gonzalez, second by Commissioner Diaz to ex to adopt the minutes from our last meeting. Roll call vote. Jose Alvarez. Yay. Ramiro Diaz. Yes. Alfonso Gonzalez. Yay. The following procedures shall be observed during the hearing. Thank you. The first item on the agenda is BZA 09923. This is a request for variances from the provisions of Article 21, Section 216A7 of the comprehensive zoning ordinance to permit the construction of a pool house cabana with insufficient distance from the interior side and rear lot lines. Due to the encroaching structure on the neighbor's property in the rear that abuts the current shed, the placement of the pool house will result in deficiencies in Article 21, Section 216A7. There is also an existing neighboring structure to the side of the shed that also triggers a second waiver request. According to Article 21, Section 216A7, a detached accessory structure may be built on the interior side and rear light lines, provided there is no existing structure on the adjoining lot located within three feet of the common interior side. The reconstruction of the shed will close the existing distance of about 2.521 feet to zero feet, as there is an existing structure on the adjoining lot. The proposed shed will require a waiver of three feet. Staff surveyed the square in which the property is situated, the continuous lots on either side of the subject property, and the four surrounding squares, analyzing a total of 123 properties, not including the subject site. Out of the 123 properties surveyed, 73 properties or 59% do not contain accessory structures, and 42 or 35% do contain accessory structures. When comparing the totality of the surrounding property surveyed, however, it is less common for properties to hold an accessory structure.
