Um the primary issue, I believe here is the uh current interpretation of uh 21.6.a uh specifically um it notes that uh although uh porches aren't permitted uh within that two feet range on the side yard, does say in uh 21.6.2.

However, when an existing dwelling is elevated, side stoops and steps may encroach into the entire width of an interior side yard.

This building is an elevated building, it is a typical uh existing, it's a typical uh duplex elevated on piers.

The zoning uh the staff of these uh zoning administrators have uh uh interpreted this to be uh if you're elevating it beyond what is currently elevated, which I I think is a uh arbitrary interpretation of this.

In fact, the the staff uh member at the zoning uh administrator's office uh said, quote, I agree that it doesn't seem to correlate with the historic development of structures in the city.

If I were to elevate this building a half of an inch, then it would meet the letter of this law and it would be okay, even though that side porch and the stairs on either side would be the exact same as what I'm proposing.
