And I'm here on behalf of a group of golfers from Harbor Lynx that rely on rely on it as our public golf course.

And I was here last month, but without any resolve yet, on limiting these private golf outings.

And today I just want to focus on two things.

One is the actual contract, and the second one is the privatization of public park land.

It starts with the contract.

And I would like to review the contract because I'm not sure if everybody is clear on it because it's quite vague and doesn't say it allows unlimited golf outings after Labor Day.

During the RFP process, the golf um vendor asked the question can you clarify the language around golf outings?

Because we interpret this as before Memorial Day.

And after Labor Day, the co the course can host as many outings as the operator sees fit.

And the town's response was that standards have not yet been set, but that they need to be set and could include things like uh how many outings to date, revenues, demand for the course, et cetera.

And the key line in this contract language, this is part of the contract now, is that we are operating under the assumption that at max capacity we will approve a golf outing every week between Memorial Day and Labor Day on either a Tuesday, Wednesday, or Thursday, and that is in addition to the Mondays that are allowed.

So that says that we see a maximum number of outings of two a week in the summer months.

So what's actually happened now is that because the town has not acted to set standards, the golf operator is having as many outings as she sees fit.

And in an email to me, she said that her contract allows her to have four outings a week.

That's not true, and that is not what the contract language says.

So this is a town issue that needs to be handled by the town and actually voted in a discussion about what will the outings be after Labor Day.

Because what's happening now is that there's a public violation occurring to the public regarding their use of public parkland.

And because we're excluded more often than we are included after Labor Day, the majority of the time.

So I like to say that Harborlinks is not a private club that can have as many private outings as it sees fit for a week.

It is a public parkland that's owned in a trust by the town of North Hempstead, and you are the trustees of that, and it's governed by the public trust doctrine.

And under New York law, that is exactly what constitutes park alienation if we cannot be on the course when we would like to be on the course.
