0:42

Anyone has any comments?

0:55

Okay.

0:55

If there's no comments, would anyone like to make a motion to approve uh this preliminary and final plan?

1:02

Uh you need to make the two motions.

1:04

You want the first motion for the zoning relief?

1:08

Okay.

1:08

So do we have a motion to approve the zoning relief?

1:11

Uh if you're looking for it, that's on page five.

1:19

I'll make a motion we approve the zoning relief.

1:22

Is there a second?

1:23

Second.

1:23

Motion the second.

1:24

Any discussion?

1:26

All in favor?

1:27

Aye.

1:27

Any opposed?

1:28

Okay, that's five.

1:29

Oh.

1:29

And next we have the development plan review plenary.

1:32

Sorry, who it wasn't Meg's voice.

1:34

Okay.

1:37

Uh so do we have a motion for the development plan review, preliminary and and final plan decision?

1:42

I'll make a motion for that.

1:43

Is there a second?

1:45

Second.

1:45

Any discussion?

1:47

All in favor?

1:48

Aye.

1:48

Aye.

1:48

Any opposed?

1:49

That's also five.

1:50

Oh.

1:52

Uh next item.

1:53

We have a surety reduction, hover view, which is Victor Wickford Harbor Estates.

1:58

And this was uh continued at uh the request of the Planning Commission.

2:03

Uh and we'll handle that first and then do you want to do you want to do the modification at the same time?

2:10

I think you can do both together.

2:11

Um Ali, I think has an update for you.

2:15

Okay.

2:16

So if there's uh no objection at the same time, item 3C is the discussion for the potential modification to Hobby View final approved plan for the property located off of bow line drive again for our request and continuance.

2:32

The status update.

2:33

Um pretty much all the physical items have been completed.

2:36

Um there they finished all the landscaping, uh I believe all that punch list is taken care of.

2:41

There's a handful of things that we're working on with the engineer to get a couple certifications.

2:44

Um that's pretty much it, but all the physical work aside from the wall, ignoring the wall issue, that's a whole separate thing.

2:51

Um the development is just about complete.

2:56

Or all yeah, all the physical work is complete.

2:59

Um do you want me to comment on the wall?

3:02

Um, I think maybe we'll handle them separately because one is a bond and the other is uh Yeah, so we're not recommending a bond reduction.

3:08

I would not I I don't know if I'm gonna get different guidance, but I wouldn't personally not recommend reducing the bond until the wall situation is sorted.

3:15

So whether it's approved with a mod a modification or whether it's not approved, I don't think it would be in the best interest to reduce the bond until that wall situation is sorted because if the wall situation if if it needs any work or if there are any improvements to be done where we wouldn't be holding any money or holding enough money to deal with that.

3:36

But we're already holding slightly less than 10 percent.

3:38

Correct.

3:39

Which that would also start the year clock.

3:42

Um I guess I don't I don't monetarily wouldn't make a huge difference, I guess that's a good point.

3:47

Um I guess that's my question, Ali is if if the list has been met or in and maybe there's a couple of administrative things that you need.

3:59

Are we in a spot where we could start the clock since this project is such an old project?

4:04

I guess the whole wall situation just makes me very nervous.

North Kingstown Planning Commission Meeting: June 17, 2025

The North Kingstown Planning Commission met on Tuesday, June 17, 2025, at 7:00 PM at Town Hall to consider several land use applications, including a kennel, a food pantry expansion, a major pre-application for a 66-unit affordable housing building, and a roadway surface modification. The meeting also addressed ongoing issues with a retaining wall at Harbor View (Wickford Harbor Estates) and approved bonds and minutes.

Consent Calendar

  • None. All agenda items were discussed individually.

Public Comments & Testimony

  • Larry Mandel (North Kingstown) raised concerns about traffic safety at the proposed Franklin Commons site, noting that exiting onto Post Road is already difficult and a stoplight may be needed. He also commented on the cumulative impact of multiple developments on Post Road traffic.

Discussion Items

  • Sean Wright Animal Kennel (3760 Quaker Lane): The Commission approved a unified development review for a preliminary and final plan and a special use permit to convert an existing building into an animal kennel with three fenced outdoor play areas. The property is in the General Business zone and Groundwater Recharge district. The motion for zoning relief and the motion for development plan review both passed 5-0.
  • Harbor View (Wickford Harbor Estates) – Surety Reduction and Potential Modification: The Commission discussed the status of a retaining wall built without prior approval. Town Engineer Allie expressed concerns about the wall's stability, lack of geotechnical detail, and potential impact on the underlying stormwater system. She requested additional technical information from the developer's engineer. The developer's attorney, Robert Donnelly, argued the wall has been certified as safe and asked for bond reduction and approval of the wall as a minor modification. The Commission decided not to start the one-year warranty period on bondable items until outstanding documents are received. The wall modification discussion was continued to the July 1, 2025 meeting pending responses to Allie's forthcoming memo.
  • North Kingstown Food Pantry (445 School Street) – Dimensional Variance and Minor Land Development: The Commission conducted a public hearing (no public testimony) and then approved two motions: first, a dimensional variance for buffering (25-foot variance) and parking aisle width (2-foot variance), and second, a unified development review for a 1,675 sq ft building addition and parking lot modifications. The project will reduce parking from 30 to 28 spaces, but still exceeds the required 8 spaces. The Commission also granted a waiver from curbing requirements. Both motions passed 5-0.
  • Franklin Commons (66-unit Apartment Building) – Pre-application: The applicant, Valley Affordable Housing Corporation, presented a preliminary proposal for a 5-story, 66-unit age-restricted (55+) affordable apartment building at 7255 Post Road. The project requires multiple variances: parking (86 spaces vs. 98 required), parking stall width (9 ft vs. 9.5 ft), aisle width (24 ft vs. 26 ft), number of stories (5 vs. 4), and height (57 ft vs. presumably less). The Commission provided feedback, emphasizing the need for a strong hardship justification for the fifth story, concerns about visibility from Post Road, school bus stop location, and traffic impacts. The Planning Department noted that some variances could be handled administratively but recommended the commission review the holistic project. The applicant will return for master plan approval.
  • Carriage Hill Farm (2860 Tower Hill Road) – Roadway Surface Modification: The Commission voted 5-0 to recommend approval to the Planning Director for a minor modification changing the roadway surface from gravel to asphalt, with the condition that the bond be updated to reflect asphalt costs. The change aligns with original permits and stormwater calculations.

Key Outcomes

  • Approvals:
    • Sean Wright animal kennel (unified development review and special use permit) – approved 5-0.
    • North Kingstown Food Pantry – dimensional variance granted 5-0; unified development review granted 5-0 with conditions (maintain vegetative buffer, use native plants, compliant lighting, waiver for curbs, annual O&M checklist).
    • Carriage Hill Farm roadway surface modification – recommendation to approve 5-0.
  • Continued Items:
    • Harbor View surety reduction and wall modification – continued to July 1, 2025, pending additional engineering responses. The one-year warranty period for bondable items will begin once outstanding administrative items are resolved.
  • No Vote:
    • Franklin Commons pre-application – no vote taken; feedback provided for future master plan submission.
  • Administrative:
    • Approved minutes of June 3, 2025 (5-0).
    • Noted that staff achieved a CRS classification improvement from 9 to 7, resulting in a 15% flood insurance discount for policyholders.
    • Commission agreed to suspend early-start meetings for July 2025.
