North Kingstown Planning Commission Meeting - June 5, 2026
North Kingstown Planning Commission Meeting - June 5, 2026
Note: The meeting transcript and agenda indicate the meeting actually took place on Tuesday, June 2, 2026. The date provided for this summary is June 5, 2026, per instructions.
The Planning Commission convened to address three major agenda items: a public hearing and decision on a unified development review for a mini-storage project at 915 Ten Rod Road, a pre-application review for a major residential redevelopment at 6828 Post Road, and a discussion on establishing a surety bond amount for a solar energy system off Firwood Drive. The meeting also included approval of minutes and administrative actions.
Public Hearing & Decision: 915 Ten Rod Road Mini-Storage
- The commission held a joint public hearing for both a dimensional variance application and a combined preliminary/final plan review for 915 TRR, LLC (Richard Storti) for three mini-storage condominiums at 915 Ten Rod Road in the General Business zone and Groundwater Recharge/Scenic overlay districts (continued from April 7 and May 5, 2026).
- Commissioners reviewed the draft decision and noted a typographical error (“E interpreted” should be “misinterpreted”) on page five of eight, which staff were to correct.
- The decision included ten conditions addressing vegetation buffer maintenance, stormwater plan recording, prohibition of floor drains, coordination with utilities and emergency services, prohibition of vehicle maintenance or hazardous material storage, and submission of revised landscape plans.
- A motion to approve the unified decision was made, seconded, and carried unanimously (voice vote).
Pre-Application: 6828 Post Road Major Land Development
- Patriot Builders Inc. presented a pre-application for adaptive reuse of an existing three-story commercial building (12 units) and construction of a new five-unit townhouse building, totaling 17 residential units at 6828 Post Road (Assessor's Plat 146, Lots 131, 205-210) in the Post Road (PR) zone.
- Staff noted the site is a flag lot of approximately 1.5 acres; the project requires dimensional relief for two additional units beyond the base density of 15, which could be addressed via inclusionary housing provisions or a variance.
- The existing building will be converted into 12 one-bedroom apartments (approx. 377 sq. ft. each); the new building will have two-bedroom units with garages. A sidewalk along the driveway was added per TRC comments.
- The applicant has obtained septic approvals, a wetland permit, and is working on water modeling and fire department requirements.
- Commissioners generally expressed support for the reuse concept and noted the units are unlikely to generate school-age children. No formal decision was made as this was a pre-application stage; the applicant will return for full review.
Discussion & Action: Solar Energy System Surety Bond
- The commission discussed establishing a surety bond amount for the decommissioning of a 4-megawatt solar energy system by NKGM I, LLC (Green Development) off Firwood Drive. The submitted decommissioning plan estimated a current cost of $62,063.86 (2024 dollars).
- Staff recommended a cash bond mechanism (as used for the Dry Bridge Road project) and suggested considering inflation rates (2–5%) over a 30-year horizon. The finance director favored a 5% inflation assumption but was not yet certain.
- Kevin Warren of Green Development presented the cost estimate, noting labor, salvage, and site stabilization costs, and proposed revisiting the bond amount at years 11 and 21 to adjust for actual inflation or cost changes.
- Commissioners debated the adequacy of the initial estimate, noting historical construction cost increases far exceeding 2.5% (over 200% in 22 years) and concerns about soft costs and labor rates. They expressed support for periodic reviews and for allowing staff and the finance director to finalize the bond amount and mechanism (cash bond or alternative financial instrument) with the goal of ensuring sufficient funds for decommissioning if the project is abandoned.
- A motion was made and seconded to authorize staff (with the finance director and solicitor) to finalize the decommissioning plan, price, and mechanism, and to include provisions for at least two reviews by the Planning Commission over the 25-year lease term. The motion carried unanimously.
Administrative Actions & Minutes
- Staff reported approval of an administrative subdivision for the Moravet property (wetlands adjustment).
- The minutes of the May 19, 2026 meeting were approved as presented.
Key Outcomes
- 915 Ten Rod Road (Mini-Storage): Unanimous approval with conditions.
- 6828 Post Road (Pre-Application): No decision; conceptual support expressed; full application expected.
- Solar Bond (NKGM I, LLC): Staff authorized to finalize bond amount, mechanism, and review schedule.
- Minutes: Approved.
Meeting Transcript
The microphones aren't working. I'll speak as loud as I can. And if you don't hear something, ask, and we'll try and repeat it. Okay. Good evening. Has everyone had a chance to see the decision that was emailed, and we've got printed copies today. Any well, I'll go through page by page if we have any comments, corrections, anything else, and then we can get to the decision. Anybody anything on page one? Page two of eight. Page three of eight. Page four of eight. Page five of eight. In the middle line, it looks like there's a typo that says E interpreted. I don't know if that should have been misinterpreted or reinterpreted. I think it might just be an error. Should be deleted maybe. Maybe it's the determined plan for the E the E should be stricken. There's an E all by itself in the middle line of the zoning. Misinterpreted, I think it's supposed to be. Okay. That's I'm going to guess for Jennifer, but I'll confirm with her, but I think it's supposed to be misinterpreted. Okay. Yeah. Okay. Anything on six of eight? Seven of eight. And page eight of eight. And then again, Richard, just one vote. There's only release, so even though it was unified, there's still just the one. There's still, yeah, there's no zoning relief being granted. So based on the findings from the meetings, the testimony and the documents presented and as outlined in this decision. Uh along with the following conditions. One that the application is approved with the preliminary and final stages combined. Two, the vegetative buffer shall be properly maintained by the property owner consistent with the final landscape plan to ensure screening and noise mitigation. Number three, the stormwater operations and maintenance plan shall be recorded and a checklist shall be submitted annually to the town engineer. Four, all tenants, owners, or renters of any unit shall adhere to section 21-186. Groundwater recharge and wellhead protection overlay districts of the North Kingstown zoning ordinance. The structures shall have no floor drains. Prior to issuance of a certificate of occupancy, the applicant shall provide draft legal documents that will be utilized for the project to the planning department. These documents shall include all restrictions on the property, including the requirements of section 21-186 groundwater recharge and wellhead protection overlay districts.
