Our dear Father in Heaven, we pause at the beginning of this city council meeting to express gratitude for this day for each day that we're blessed with to live and to learn and to grow.

We pray for a blessing upon us as decision makers and as elected officials that we may make decisions and wisdom guided by the desire to do good and to help the most people we can help.

I pray for those that are worshiping and celebrating Lent and Ramadan at this time that we have gratitude for the religious freedoms we have to exercise our beliefs and grateful for the community that we live in.

I pray for a blessing upon our public safety, our police officers, firefighters, and those that put themselves in harm's way.

All righty, moving on to council items.

We're gonna start on the other end today.

So let's start with councilwoman Garcia Anderson.

Okay, thank you, Mayor.

Um, let's see.

I've got a few items.

Some of them are really exciting.

All of them are actually.

So on February 5th, I had the opportunity to tour the Pearson Pine Senior Apartments.

They're located in Ward 2.

Um, and this is an affordable housing community.

They're going to provide quality housing for our residents for our seniors who are in a fixed income.

Um and I gotta say, I was blown away by how beautiful they are.

Um they were built by Nevada Hand, and so I want to thank them for their partnership.

And also I want to thank our team, our neighborhood services team, Rick Damien and his team for all their hard work and um for their commitment to bring, you know, supporting some of these projects that are really great for our community.

The address is 2530 Morton Avenue.

So if anyone wants uh full details on how to apply as far as uh income requirements and our current leasing units, uh the number is 702 6474734.

And then also on February 10th, I was able to uh go into uh Soren Health Center.

And they are a comprehensive primary care, and they offer personalized integrative care, focusing on prevention, chronic disease management, and nutrition.

And I was also blown away by um just the care that they provide.

Um, I think a lot of the their patients are also seniors.

And I learned that all of their doctors are MDs and they are bilingual.

And they're also located in Ward 2.

They just opened their doors, I believe, last October.

The address is 3860 West Lake Mead Boulevard in North Las Vegas.

So we want to welcome them to our uh to our community as well.

And then on February 12th, I, along with MPT, we went and uh participated at the farmers market at the Dolores Huerta Resource Center, and it was an amazing experience just seeing how many um you know grateful and smiley faces uh were there.

And um, it was you know, it was great to be a witness uh and then to witness how our city is um answering the call to promote health and uh support the efforts of reducing hunger in our community.

Um the quality of the food was amazing as well.

Uh the setup, everything just went so smoothly.

Um and so I just want to thank our entire team at the Dolores Huerta Research Center for their hard work and for the partnership that we have with the Just One project.

Um and I believe MP MPT, you learned a lot of Spanish that morning.

He now knows all his vegetables.

So I taught him and all the fruits.

So that was really fun.

And then um this morning, I along with our court enforcement team, we went and knocked and talked in preparation for um next week's Ward II um our cleanup, our neighborhood cleanup.

And I must share that my mom joined me because she was here.

She's she just left to back to Reno where she lives, and she was so impressed with all the things that we we are doing for our residents here in the city of North Las Vegas.

She she took a flyer and she took um uh you know some of the paperwork that we provide residents for information, and she's gonna reach out to her local representative so they can do that where she lives because they've never done it.

She didn't even know that that's something that um you know that residents can request or that their local representative cancel for and so this was it was just a great experience.

And so I just want to thank our um court enforcement team and everyone involved in this.

Also the partnership that we have with Republic Services.

Um, and I am supposed to mention that that I will be, let's see.

The streets where we are going.

Oh, it's right here.

Um the cleanup will be next Wednesday, February 25th from 7 a.m.

to 1 p.m.

Um, and so if any of the any neighbors that live on Cartier Avenue to West Avenue to Kerry to Clinton, back to Cartier, that's the whole area that we're going to be cleaning.

And I will be um you can about the tent that will be on West Avenue between June and Cartier from 9th to 11 a.m.

for coffee, donuts, and lots of information.

On February 7th, I had the privilege of joining Mayor Goines Brown and Councilwoman Garcia Anderson at Silvermace Rec Center for an amazing Black History Month celebration luncheon.

Uh the decorations that our uh Parks Erect team put out, and the attention to detail is just absolutely amazing.

Every event is awesome.

This one was so good.

The food was great, the entertainment was great, the company and just the ability to be together as a community and celebrate the amazing diversity that we have was was really a great and enjoyable event for me.

Um also on February 11th, I attended the Simmons Elementary School Family Culture Night, and uh that was really, really a neat event.

I learned how to make uh tamales.

I saw several different dance groups from different cultures.

Uh I wouldn't eat the tamales I make, but I learned how to make them.

Let's just say that.

But um one thing that was really neat that I would like to point out is that event occurred as a result of our education initiatives and efforts through our education advisory committee and our microgrant program.

Um Miss Oppenheim, the school counselor, wanted to make sure that I saw in the back of the program a big thank you to North Las Vegas for our investment in their school and facilitating that awesome community uh culture event for those uh school uh students and their families.

Um last evening I had the privilege of speaking at the NLV Alliance meeting.

It's a meeting that happens every other month at the Aliante Library.

It's been going on for about 20 years.

I think Councilman Churchill was the founder of that with uh Mr.

Bob Mercerow.

But last evening we had a great conversation.

I want to thank uh Jomel Yamato, our utilities director, and Marie Maurice Solis, the operations manager, as well as Bronson Mack from SNWA.

We had a really good conversation about water in our region, the Colorado River, and also how we handle water and uh sewer services in North Las Vegas.

That was a really great conversation, and I think the people that were there learned a lot.

Uh lastly, I'm launching the uh the fourth read to ride challenge.

That's all the Ward 3 elementary schools.

There are seven of them.

It starts on March 2nd in connection with Nevada Reading Week.

It goes until March 31st.

Students all grade levels who read at least 400 minutes during the duration of time uh will be eligible for the raffle and a chance to win three awesome BMX bikes, three uh per school.

Um, first let me just um piggyback on what the MPT mentioned about the alliance.

Uh Jeff Albert has been running that alliance um almost single, single-handedly for quite some time.

He does all the scheduling and he's so proactive.

Um we got a communication that his brother isn't well.

Uh and uh I guess I just want to share that information to you.

And uh if you could just put uh his brother in your prayers, uh, we would all appreciate that very much.

Um we had our annual Valentine Bingo again at Skyview, YMCA on February 12th.

Um I kind of took that over uh after our friend Tyrone Thompson, Semiling Thompson passed away.

And every year it's growing and it's growing and it's growing.

And it's amazing how uh the people who attend that, mostly seniors, uh, they just look forward to being over there and my calling bingo and uh our staff upstairs on the ninth floor, whether be Mariam, Kantasha, Claudia, they do an amazing job.

And this year we had my wife Gloria up there too.

Uh she was calling back the numbers.

Uh, but I want to make sure I mention um uh pink box donuts, Judy Siegel once again as a good community partner, donated a whole bunch of amazing donuts to the people over there.

And uh uh um Joe Alma from uh from what is that human being?

I'm sorry, human being on uh Camino Norte, he provided uh some amazing coffee.

Uh I think uh I think well we recognize him as the business of the month.

I did just recently last uh this council meeting.

But I want to thank them as being uh you know special partners for our events over here.

Um Monday, if you thought Monday was the holiday, it was, but not for me.

Um I was uh invited to uh be one of the judges at the TSA State Conference judging contest at the Northeast Korea Council tech now uh technical academy.

And uh it was very uh very enlightening.

Um the students that came in.

We had several judges over there.

I think I was the only council person there.

Uh, but the students would have only uh uh 15 minutes to pick out a card ahead of the uh the judging to decide what they wanted to speak about.

And then they would come in and they would have five minutes in front of the judges to uh just explain why and uh just be as articulate as they can.

And uh I could tell you uh I don't know what I was doing at that age, but it definitely definitely wasn't that.

Uh so I have a lot of confidence in the future of uh our young people, and uh that was uh a great experience.

And thank you to all of those people who uh amazingly put that together.

It was a lot of work in doing that.

And thank thank you, of course, to the students who participated.

It feels like a long time since I've been here, but uh of course I've been taking care of some busy over uh some business over at the city uh I'm sorry, at CCSD.

Um I'm happy that uh, of course, we're making a lot of progress over there.

But I I miss being here with uh my colleagues and of course uh the people that we work with.

Uh so it's that's nice to be back for for this meeting.

Um first thing I want to say actually, uh I uh I attended a fantastic uh uh Chinese New Year event, uh You're the horse at the NRC.

And I again I because of I've gone out to a couple other events in the in the city.

I just wanted to again express my uh my appreciation to our uh NRC, the neighborhood recreation center staff for putting that together on this side of town.

We don't see that many types of events, you know, uh Asian type events because we're so Latino, but happy that to see that we're bringing, you know, uh culture in all forms here to Ward One and uh NRC, they're doing a fantastic job, and we had a lot of fun.

Um that being said, uh I also want to give a great shout out to our police department and of course uh our our uh our the team at the community engagement.

They put on a fantastic pandulce con la policía.

Uh, for those of you who are standardly challenged and can't read the thing over there, it's a uh sweet bread uh with the cops, right?

Uh that was uh here on February 11th.

Uh what we should also thank La Bonita for hosting that right.

Um we had uh uh a great chance to have you know our city's finest, the thin blue line engage with members of our community, uh which it did uh uh uh great.

And um I'm looking forward, of course, to the next one.

And um I I'm kind of hoping, I don't know, I guess it may not happen, but man, I sure love to have another pancakes with our firefighters where I'm out there cooking Toristo with Webwood and the pancakes.

Uh maybe we can do something over here in Ward One.

Um, maybe before it gets too really too hot or something.

But and if not, I'll figure out a way to do that to do this.

Um and then um if you noticed, um, I don't know if you didn't notice, we have a whole bunch of art uh in front here in our uh kind of like growing and growing stone soup art gallery.

Um, our friends at City of the World Art Gallery who have participated with us at many times, they put together this uh this gallery here in honor of uh Black History Month.

And I can't for life of me remember what the name of the uh of this gallery is.

So if anyone uh wants to go ahead and text it to me, I'll I'll announce it.

And then if I don't get it, well well, we'll figure it out later.

But there's a couple of great exhibits out there that the one that I'm gonna actually put dibs on to purchase because it just so imaginative.

Yeah, but but every gallery, every uh every every presentation has a name, like you know uh art in the park or uh midsummer uh nights.

No, that's um I'll be ripping off a uh a play.

Yeah, I'd be ripping off a play.

But you get the idea.

So if we if anyone knows the name of this art exhibit, I would really appreciate you know, just shouting it out.

And uh I will beforehand ask for it for permission.

Well, not permission, my um I'll ask for uh absolution from our uh from our mayor uh uh for interrupting our our business meeting here.

Good afternoon, Liz Olson 1980 Festival Plaza Drive here on behalf of Graystar Development.

Um, for those of you that may not know, Graystar is one of the nation's largest multifamily developers.

Um, in fact, I learned today that they were voted number one for the last six years in a row.

So I'm pretty impressed to hear that.

Um, we're honored to be in front of you this this evening to represent them, and they're grateful for the opportunity to hopefully become part of North Las Vegas.

Um, so the site that is before you this evening is located here along Commerce, directly across the park, uh dress directly across the street from the Craig Regional Park, just north of Craig Street.

Uh the site is currently zoned for commercial, but it's master plan for mixed use development.

So we are requesting a zone change to PUD to allow for a mixed use development, which would include 227 multifamily units and a coffee shop as that commercial component.

So as you can see here on our layout, we have two buildings up against the street here with all of our parking in the back, which allows for a more beautified frontage rather than just looking at those parking spaces there in the front.

Access to the property would be to the north here.

We have gates pushed down into the site, which allows for our cross-access easement over to our adjacent parcel.

This here is for exit only.

We went back and forth on potential commercial uses.

We believe based on the fact that we're across from the park, a coffee shop would be appropriate.

Folks and kids could come and go while they're at the park for different uses outside seating and close to, of course, the residents as well.

One of the questions that did come up at your planning commission hearing was how would folks go across the street from commerce for safety?

There is an existing flashed crosswalk just to the north of this site where the bike uh trail is.

So I just wanted to bring that to your attention and put it on the record.

Um, like I said, we think this is a great opportunity for Graystar.

We think it'll be um a great development for the area, and appreciate uh staff's recommendation and all of their work.

They've been working with us for a long time on this one.

So uh shout out to them.

You have a really great staff that you're working with.

Uh with that said, I'm happy to answer any questions.

Um, before we open the public hearing, Alfredo, I'm gonna ask turn it over to you for a second.

Yes, um, uh mayor and members of the council and working with the developer, like like she said, uh, we've come up with um one more condition for the the ordinance, and I'll just read that into the record, it replaces number seven on the existing ordinance, and that is that the applicant shall install four mature trees at a minimum of 36-inch box or larger, in addition to the required landscaping the proposed 20-foot landscape buffer adjacent to the north property line.

And that was in response to some feedback from team members and and council members as well.

And then the rest of the conditions just fall in in a subsequent numerical order.

I had an opportunity to visit, I think it's called Marlowe.

The Centennial the project level be similar to this, and it's up in Centennial.

Um, I think this is a great development for this area.

Um, it will be well suited for this location.

I I do have a question.

Um, I know we have the park across Greg Ranch.

We plan on having a lot of loud and big events.

Um, and so are you guys?

I think we discuss perhaps notifying future residents.

Uh, can you maybe tell us a little bit about that and where we're at with that?

Yes, thank you.

Um, we would be putting that in all of our leases that just a notification that we are across from the park and that there will be events.

Um happy to add that as a condition if you'd like, but we are committed to that.

That would be great.

Actually, if we can be added to the as a condition.

And um, let's see.

Yeah, I don't I don't have any concerns, Mayor.

I've been to all the community meetings and I we I've spoken to residents.

I think um, I think they like this project.

I think their concern was traffic, which um which is understandable.

But I I want you know, we have any residents here in the room.

We want them to know that we are gonna work on you know any issues that come up.

I mean, we have great staff, um, and so we're just going to tackle those as they as they come.

But I don't foresee any issues.

I think having families come and join our community will be really great, especially in that location across from the park.

I had a question, I don't think I asked you.

Um, where the coffee shop is, I know you're you're gonna have a lot of foot traffic, but are there because it's it's you know it's it's cafe style, you walk in, you sit down, you have your coffee or picture, whatever, then you leave.

So, how many parking spaces do you have to have designated just for the coffee shop alone?

Um, our coffee shop is 400 square feet.

Um staff may correct me, but I believe it's 1.5 every uh hundred square feet.

Um, but we have uh parking spaces all along the top here, and then also spaces over here as well.

But that's so they won't be able to come into the gate for the park.

Is that or the gate?

This these parking spaces are outside of the gate here.

Right.

Um, folks coming in this way, yes, would have to go through the gate.

There's also some handicapped spaces here in front.

Um, I I uh I really like the design here.

It's uh nice to have uh, I think eyes on the road.

It actually promotes a lot of safety for people who are walking.

Um what we know is we like to have lots of eyes wherever you have a trail, um, because uh again that that promotes a lot of you know uh public safety, you know, when you have people watching, you know, um it just prevents a lot of the uh things.

Now the the only safety, the only slight safety concern, and by the way, I'm very happy that you're putting in lots of uh kind of almost mature trees, uh, the more trees the better to combat you know all that asphalt, you know, heat uh index rising and stuff.

But the only little minor concern that I have is with safety, and just you know, with so many people who drive in the area, they they tend to drive at a slightly higher uh uh sp rate of speed.

You didn't mention that there's a flash thing here on on one side, and of course, at the other intersection, we do have uh uh uh a light, but just knowing you know uh people's uh human nature, there's like an uh if I uh correct me if I'm wrong uh for the park, there are some entrances, um like kind of like in the middle of your uh of the site there that lead you know into the uh into the uh uh sports fields.

Um I'm wondering uh if there uh if uh if you would be willing to talk to our uh public works department to maybe um ahead of time come up with some idea because there's gonna be there's gonna be people you're some of your residents who are gonna want to not go all the way down one way or the other, they might be tempted to cross there.

And I know I know we have our uh we we have our uh standards to where you know you could put devices right, but uh uh I would be just asking if if uh if your team would want to work with our uh public uh works department to figure out uh ahead of time some sort of a uh a safety measure, uh a crosswalk, something right uh that might promote people to use that and not charge across the street because again, I know we have children on on on e-bikes and well, not just children, adults on every kind of e-thing you want.

And by the way, um MPT, I'm very happy that you're doing a real bicycles and not electric bicycles.

I I'm I'm a big fan of you know uh old school stuff.

But um getting back to this, anything that you could do to work, uh uh I just wanted for the record that you'd be willing to work with our uh with our public works just to have safety for you for possibly for your uh future residents there because this is a really uh that's a really nice project, it's really needed, and you know, um I uh I'd like to make sure that that's always gonna be built with those safety in mind.

Uh we are moving forward with our final development plan as well, so we can speak with public works in between um that time.

And of course, there will also be the traffic study as well.

Fund ZOA 02 2025 and ordinance number 3270, an ordinance amending Title 17 of the municipal code of the city of North Las Vegas relating to zoning ZOA02 2025 by amending the permitted use table, the use specific standards to allow mixed use with a residential component of property zone for commercial use and providing for other matters properly related there too.

I'm gonna turn it over to you first.

Yes, um, Madam Mayor, members of the council.

Uh, this ordinance before you today is in response to recent.

Sorry about that.

This ordinance um is in response to a recent legislative mandate uh requiring jurisdictions to allow multifamily or mixed use development in commercial districts, and so the deadline for compliance is March 1st, and this ordinance ensures that we meet that requirement.

Uh the city's updates to Title 17 and in the ordinance before you are designed to establish clear development standards that allow residential use to be integrated into commercial areas in a manner that is compatible with surrounding development and consistent with local planning objectives.

The proposed updates are intended to promote high quality mixed-use residential development.

The upstates uh the updates are structured to ensure that the multifamily housing requirement in AB 241 occurs only as part of a mixed-use project and is not permitted as a standalone use on vacant commercially zoned land.

The planning commission has reviewed and recommended approval of this ordinance.

This recommendation reflects careful consideration of community needs and legislative requirements.

Um, the adoption of this ordinance will position us in full compliance with state law, and it supports housing diversity and mixed use opportunities, contributing to a more vibrant and sustainable community.

Once again, we stand in opposition to item 21 ordinance 3270.

And the uh uh because it does not allow for multifamily development.

AB 241 specifically requires uh the ordinance to contain an option for multifamily housing.

This does not.

Um the legislative council bureau has authorized me to read their interpretation, which agrees with mine.

That's not just my opinion of 35 years as an attorney.

The legislative council bureau also states that AB 241 requires municipalities to adopt an ordinance that authorizes multifamily housing.

The city of North Las Vegas cannot adopt an ordinance that allows only mixed-use development, which this does.

This is inconsistent with the statute's plan language and legislative intent.

So if you approve this, you are violating uh Nevada law.

Uh Majority Leader Alargi, who was the sponsor of this bill has also authorized me to tell you that uh passage of this is a violation of Nevada law.

The law was passed, it was signed by our governor.

The intent is to allow more housing to bring the housing cost down.

Multifamily is one component of that.

This bill fells in that.

Um my question would be uh staff, uh actually, and in particular, our city attorney.

Um, Mr.

City Attorney, um, is there already uh something, uh, an ordinance that didn't pass by a citizen municipality or any other uh uh municipal government in the state of Nevada that it's kind of like uh it's kind of like this.

Um Andy Moore, city attorney for the record.

Um yes, I know Henderson had a similar ordinance that was uh up for introduction last night, and it's gonna be up for final approval March 3rd, and it's in line with the ordinance that we have proposed for council to approve and Clark County at its meeting today.

I believe the zoning board had a similar ordinance that I believe was voted on and approved, that's in line with us where it's essentially allowing multi um mixed use by right because the statute says uh multifamily development or mixed use.

Uh to to clarify, mixed family uh uh uh uh um uh multifamily or mixed use, and mixed use of course, it refers to the fact that of course that's uh on the first level, you have to have uh some uh some type of commercial.

Uh as we just approved a uh development just a little while ago.

And then the other the other however many uh stories you're gonna get would be uh of course, you know, uh a a type of uh higher density, possibly uh um possibly market rate, or it could be affordable housing.

Is that correct?

That's correct.

Yeah, the the ordinance that we have proposed is uh multifamily use with commercial on the first floor, the entire first floor, but obviously above that would be multifamily residential.

So so by definition, um mixed use does not necessarily exclude um uh uh uh a uh a higher density housing.

Is that correct?

That's correct.

Um so um I I guess uh by using that uh that uh that um consideration, uh we actually are in line with uh with um AB 241.

Yes, I agree with that.

And I'll just second that because I think that I guess just to clarify, you don't have to clarify, but the and the or part to me um however you were interpret that, but we still have to follow what what AB 24 spec um says, and to me it's we're in compliance with what what the language is, correct?

Yes, this was reviewed by uh city attorney's office prior to going for planning commission.

And we reviewed it to make sure that we were in compliance with AB 241, and it's the same ordinance of being presented to city council.

Item 22 status check on city council review pursuant to section 11.03 of the second amended and restated development agreement for the villages of Thule Springs regarding closure of villages at Thule Springs Regional Park and Master Developers alleged non-compliance with requirements in the villages of Thule Springs Parks and Trails Agreement.

Good afternoon, uh members of the council.

My name is Bob Gronauer, 1980 Festival Plaza Drive.

I'm here representing the uh master developer for the Tooley Springs Master Plan community.

Um first, I would like to start by mentioning this was an item that was uh heard 30 days ago.

Um it was a very long meeting.

We have a lot of discussion.

Um, although it was uncomfortable at times representing the matter standing before you I respect the fact that we were able to go through because as I mentioned, this was a good thing 30 days ago because 30 days ago we didn't have the progress that we actually have made in the last 30 days that we didn't make in the last year and a half.

So, that being said, um, as I mentioned last time, uh unfortunately uh we did file a lawsuit with against the uh HOA who's supposed to maintain this park and pay.

Uh, the good news is since that time we were in settlement uh talks with them, but that's a separate matter.

But I did want to at least mention that part.

But the main part that is interest to you is where are we with the uh maintenance and the cleanup of the park?

Um we made a commitment to you on record that we would be meeting with your staff on a weekly basis.

Uh we have done that.

Uh matter of fact, um, with your management team, they've as I said uh a month ago, your management team has been terrific to work with over the last year and a half.

Uh as nothing to do with them, it's just unfortunately it's between an HOA and the master developer, and we got some progress.

Um, your management um team has been out to the property twice.

Um, we were out there last week, last I think it was last Wednesday, and uh we were out there at eight o'clock this morning.

And I got some pictures to show you where your parks director showed you last time some of those pictures of things that were broken, trash all over the place, and I'll show you where we are today.

And the good news is even with the winds and the rain and the storms that we've had over the last 48 hours.

I was afraid going to that park this morning as I told your management team, I was like, I didn't know what I was going to see uh with the sand and everything around.

And the good news is uh the sand actually held well.

A lot of the stuff that you see covered.

Uh, this looks like snow, as you can see here, all around here.

As I'll show you, a lot of this stuff has already been picked up and cleaned up and uh and and tidied.

It's still a long process to get a few of these things done.

Um, but I want to go through the before and after fairly quickly here, and then tell you where we're gonna go from where I hope we can go from here.

So quickly from the exhibit that was submitted back in January when we were standing before you.

This is the field area.

And actually, I should show you.

In this area, in this area here, this is the picture that was shown at your last city council meeting um uh 30 days ago, and then the picture here, which isn't as clear, uh, but this was a picture taken this morning.

And what I'll show you at the end is we had eight workers already out there this morning working on the grass area here.

Uh Brightview is a contractor, and as they've mentioned to us, is they were doing intense raking today and taking out all the weeds.

And so hopefully, next week, if the weather permits, the temperature is gonna be somewhere around 70 degrees or whatever, they're gonna be able to seed and then start watching, and they're gonna carefully main watch to make sure that the grass grows accordingly to see if as long as it's gonna take.

So that's a game plan of what we're looking to do to clean up this area here.

But your staff was out there and they saw the dumpsters and everything that was being cleaned up with the team that's already been out there for that about the last two weeks.

Um, this is a picture of the before and where we are.

Uh, as you can see, a lot of the sand was all over the place, and we've been cleaning everything up in here, and um, as I'm showing you on the overhead.

This picture is a little bit more clear.

This is the picture that you saw at your last meeting.

You see all the sand that was collected here and in this area.

If you take a closer look here today, where the trash can is, you can see all this stuff is actually cleaned up in in this area here.

So there's been some significant progress in this area.

Um, one of the directives that we took from you from the last meeting was remove the signage that's located there because the city's getting a lot of calls because it's called, you know, it's the city emblems on there.

So for now, we took away that emblem in that area there.

Uh, we did that.

That was one of the first things that we're able to uh to get done.

And as you can see, this was date stamped on February 11th.

In this area here, what this uh shows you, this is one of the coverings in the area with some of the picnic tables.

This is the pictures that you saw back on January 21st.

As you can see, the differences of things being trimmed up.

We've had power washes come through, um, and I think they're power washing earlier this morning, also again.

So we've been cleaning up the areas uh that you see that's located there.

Uh, this was to the entryway.

This is how we uh come in off the street in this area.

This is where it was in January.

This is where it is today, the condition that you see.

Again, the condition that you saw, some trash thrown around in the area, condition that you can see as of 215 when we were out there last week uh taking a look at the property.

Uh a month ago, you saw this ugly picture of the uh backboard that was uh disconnected from the poll.

As you can see, that's the same one that's located here.

This was done.

Uh this is date stamped February 11th.

Uh that was done prior to, but when we were out there taking a look at the property a week ago, actually, it would have been February February 11th, if I'm not mistaken, is that is what you see there.

Um, I do want to mention we have ordered all the new nets for all the basketball rip rims.

And uh we've also ordered that's on on order is the nets, new nets for the volleyball courts also.

So those will be coming.

But this is in operational shape.

If you've played uh basketball, street basketball 21 or whatever you played with with um uh the nets or not the nets, but uh uh at the end of the day, we're gonna make sure they're all gonna be having nets in the area.

Yeah, and this is as you can see, progress from this morning.

Um initially, when we walked with your parks director and city attorney, you had about 12 inches of sand up in this area here.

As I said, it looked like Christmas and in the city of North Las Vegas.

And as you can see though, today all this stuff has been cleaned up.

So overall, when you take a look at the park here, um, as I try to wrap everything up, uh, we believe we made substantial progress.

Uh the cleanup and maintenance started on the south side of the property and is come all the way up to the northern part.

We're not completely done.

Um we're still waiting for the test to come back for the uh uh for the bathroom.

That's that's located.

I want to make sure the these are the bathrooms.

So yeah, where the bathrooms are located.

We just put in, we repaired the water line, or when I say we, the construct the landscape company repaired the water line.

Uh everything's working well for the irrigations within the property.

Uh they were supposed to do testing yesterday in for the restrooms.

We're still waiting to get the information back from the uh contractor to ensure that we're able to finalize and and everything's working in the bathroom.

Uh the area here that I showed you, this is going to take a little bit of time in these areas.

As I was showing you, we had several workers out there today doing the intense raking and prepping for the planting of the seating.

And in the next 30 days, plus or minus, we'll have a better idea of where that grass is going to be.

Um, and then in this area here, we're still cleaning everything up on the volleyball courts.

Um, but however, um we've been out there twice in the last month with your staff.

There's always someone or some people using either the uh uh the playground equipment that's located here on the property or walking their dog through the area because you have nice walking areas through here, it's pretty peaceful.

Uh so what we would like to do as we continue to move on.

We're gonna continue to work with your staff.

Um, this isn't see you later uh you know you know after this hearing, and we're done.

There's still work to be done.

Uh Brianna Martinez, my partner, and I have both been tag teaming this from both ends, and she's here tonight also.

But um, what we would like to do, our plan is is kind of start opening this park up in phases because even though you have some blockading that located here, people are still using the park uh to serve to some form of an extent.

Um, and our game plan is is like any other park that you have in throughout the valley, not just North Las Vegas.

When you do some type of maintenance or construction in a certain area, we could rope that area off and put signage in there to say that this is under, you know, under repair.

So everybody knows that this stuff is actually happening.

Uh, we're gonna continue to work with Doug and and the rest of your management staff as we go through this and as we also balance the other half of dealing with the HOA as far as maintaining and so on.

So we have an active contract, it's gonna be maintained and continue to be maintained.

So I think the good news here is where we'd like to go as we're moving forward with the other other improvements, as I mentioned, is to allow, you know, to we're gonna remove the barriers here at some point in time so we could start letting everybody use the park because people are using it anyway, so we might as well make sure we open the open the door, so to speak, and let them use it as we have maintenance here and as we're doing the repairs, as I've mentioned.

Um so um that being said, um, I could turn it over to you to ask any questions or your management staff if they need to add any additional input.

But again, I want to thank everyone.

This has been a long process, very frustrating uh on all sides.

Uh, but we got to stand up here and deal with this and make sure it gets done, and that's what we're doing.

Well, good e good afternoon, good evening, uh, Mayor Goines Brown City Council members.

Doug Guild, director of parks and recreation.

And we were there at eight o'clock this morning, and it was cold.

We had our heavy jackets on, but we made it through it.

Uh Mr.

Gronauer's report is consistent to what we saw this morning.

Um and I have some pictures too that I can show you, but the the City of North Las Vegas logos have been removed.

Uh the all the debris has been cleaned up.

The the trees have been pruned, the shrubs have been pruned and all cleaned up.

The parking lots are clean.

Um the backboard, as as he shown, has been replaced or repaired.

Um the playground is working in good, it's in good condition.

There's one swing that needs to be replaced, but they've committed to replace the swing.

The splash pad is working and ready to go.

Uh the restroom building is we're unsure about that.

It has not been opened, but if if it needs to be opened and making sure that the toilets flush before we open the park, I just want to emphasize that.

There's still the doors are still closed today.

Um the turf is being worked on, the weeds were being removed, it was being groomed for this grass seed.

Um we do prefer sod, but if they are gonna seed the area, this is the perfect time of year to do it.

We should see growth, germination within three to four weeks, and a good stand within eight.

The volleyball sand um is being cleaned up, and I have some interesting pictures to show you that how um effective the cleanup has been so far.

Um, and with that, I will show you some pictures if you have a minute.

I just have a few.

And as Mr.

Gronauer said, the landscape maintenance contractor was on site this morning.

Now, in these pictures, there's no icicles, but there could have been.

This is this first picture here is of the of the main park sign with no the city of North Las Vegas logo has been removed.

Here's a picture of current condition as of 8 a.m.

of the volleyball court, the volleyball sand volleyball area, and right in that foreground is a planter area that a week ago was filled with sand, and um the shrubs were and the and the rock material had sand all over it and has been removed.

This is a picture Mr.

Gronauer mentioned that along the sidewalk edge, there was a like a 12-inch raised area of sand that has been removed.

It's nice and level now.

Here's another picture a little closer.

This is a picture of current conditions.

As you can see, they're they're um removing the sand.

Um very pleased to see that.

Um, not only the sand, but also the rock material and the shrubs.

So it looks like I'm very pleased to see the progress here.

Picture of one of the planner areas that was had shrubs, and you can see there's a little bit of sand left, but this was the decomposed granite and the shrubs that have been removed.

Another picture showing that, and you can kind of see in the parking lot that uh the sand has been removed also.

Here's another picture from this morning.

You can see the uh the trash containers, the dumpsters.

And a month ago, this was just filled with sand, so really good progress.

Here's one of the piles that they've made just from the debris removal.

So excellent progress.

And here's a here's a picture of the they're grooming the turf area, uh the removing the weeds and getting it ready for the seed.

And here's here's kind of a wider picture of it.

So um they were on site this morning.

Um I again I am pleased with the progress.

Um, where the basketball courts, the the perimeter around the basketball court, that's gonna stay as is, or will that be seated as well, or that will be seated also.

They're working on the big area first, and then they'll go over to the two other areas.

And I know you're gonna fence off the big area while that's yeah, we're gonna yeah, we're gonna let rope it, rope it off.

Same with the basketball area.

You can you I don't know how you can use that.

Yeah, we can do those areas.

Yeah, that's where the turf areas are.

You you'd be looking at turf area in here.

Oops, I'm sorry.

Can I yeah?

Okay.

So, yes, those areas would be what we would call roped off, along with signage there that they're under repair or being seated, which is no different that you'd probably see in other parks throughout the valley.

Okay.

And then one picnic area that you showed they took the sign off the pole.

Will that just stay there for the future use or what is gonna happen with that pole?

Um that's a good question.

I mean, we could look to disable the pole that because the intent is to put that sign back up there at some point in time when we're able to.

While the excuse me, that'll be a while though, correct?

Yeah, I I'll look into that and see what we can do.

Okay.

Um absolutely.

And can that sand be repurposed?

Or I know they're removing it, but uh I know how you know sand is so fine, but um will they I don't know, tail it in the dirt that's still there, or I don't have I don't have that answer.

I I would presume they would have to, yes.

They would have to re uh well they would have to use something with the dirt that's the sand that's already there to clean it, but let's just say they're removing it right now and in the in the condition that it's in.

Let's start with you, Councilman Churchill.

Well, I'll go first, Mayor.

Well it's unfortunate that this has been going on so long.

Um and perception being reality, I'm glad that sign was taken down because we attended two meetings, two community meetings there, and and there was uh quite a bit of dissension between the HOA board and the residents there.

Um and I got I got the impression at the time that they felt that this was a uh uh a city park that was already turned over to the city, and thus we weren't maintaining the park uh appropriately.

Clearly, that's that wasn't the case, and that still isn't the case.

And one of the things that um that Bob and I spoke about the last time we uh he had a briefing was meet with me was what uh with myself and the mayor had brought up at the last meeting here is that we didn't want anything opened up to to look piecemeal.

Uh and that's why I had brought up the issue of uh you know roping that area off and putting a sign like under remediation, whatever it is, so they know when they go in there that that isn't the way it's going to look.

That's not a finished product now.

Um so I mean, I'm fine, even though I was the one that said don't open it up until it's all done.

But it seems like you know, yourself and Doug feel comfortable with uh with the progress you're making.

Uh I would have no problem supporting that, but I do have a question.

Do you do you have a timeline that we're looking at when um when some of those roped off areas would be complete?

I don't have a timeline standing up here outside of being told it's gonna be about 30 days from the seating date that they'll have a pretty good idea if this is going to take.

Um, but uh so I could give you some more information um after this hearing and your management team, so they're aware of what that timing would be from the seating.

Okay, and you're developing a good reputation or relationship with the HOA, so we don't all of a sudden start sliding backwards again when it comes to maintaining that park when it's turned over to uh the community to the board.

Yes, um we have a couple of items that we're ironing out, but nonetheless, uh let me put it this way.

We have been in the best position to get to a resolution um in the last 30 days than we have been in the last year and a half.

Okay, and no city funds have been expended or will be expended on this.

No, this is all on private private development money.

Okay.

Umless somebody else has a question.

Huh?

Well, uh, you know, keeping us oh, okay.

Have one real quick question.

The uh the park was part of the Tuele Springs development agreement with uh an approved design plan between your team and our staff.

Uh I just would like to know if the uh the trees that have died and the shrubs that have had to be removed from the median islands or the you know throughout the parking lot and in the uh planter areas around the park, if those will be uh replaced back to the development plan that was approved.

That is absolutely correct.

So one of the things that we did with your management team, we all thought alike after the last hearing, we got the plans and specs.

Uh both Doug and I and I and our teams have talked about it.

Let's get the plans and specs that are approved to make sure as this park is being rebuilt or maintained again that we are meeting all the specs that have already been approved and signed off by the city.

So that is the intent.

That's great, because it makes sense to do it now while you have the contractor out there doing this remediation and improvement work to bring it back to that uh design spec that was approved.

Yep.

I just have one question.

I'm concerned, I have concerns about the bathroom.

How long will it take for the bathrooms to as I mentioned is I will have hopefully I was hoping to have a report from the contractor before we came in here, but we'll let your management team know.

Um it's not gonna open if it's not um in a working condition.

Um so and we'll work with your your management team.

They could we could go back out for another tour.

Um that's fine.

Um, but uh and in all due seriousness, that will be addressed as we I'm hoping sooner than later.

I mean, as we got good news on the water line um for repair.

So I'm I'm hoping that we get good news on that too.

And if not, I mean we'll give you a schedule that needs to get done.

That has to get done.

We understand that.

So are you saying it that the park will not open unless the restrooms are fixed?

No, I'm not necessarily unless that's the direction that you're going, because I don't know if that could be another week or two.

Because what's happening is what I've noticed the last two times I've been out there in the last month, people are using the park anyway.

There's nothing that's prohibiting outside of the barriers that are here in the barrier is moved in the morning for the construction company to come in the last two weeks, people are still using the park.

So, you know, walking your dogs or somebody had their kids, you know, at the playground.

So I, in working with your staff offline and even working with the councilman, would like to have certain areas open um i as we get it get everything else done.

Now, uh, like I said, I don't know what the re the report's gonna come back.

So I don't want to tell you I it's good news or bad news.

I don't know yet.

Okay, I I guess that's a mother of four, you know.

If I might go to a park, like the restrooms is the first thing I look for.

So I if we do open the park, I I just wonder if it could maybe have a sign on the on the restrooms, letting you know residents know that they're you know, under construction or something, or they're gonna be repairing give them a uh absolutely that's a great point.

Yeah, that's a great point.

That's no different than what we're gonna do with the SOD in the area the of the turf areas of signage, signage in the uh volleyball uh court area, and we can do the same thing on the bathroom if that's the case.

Council mayor, based on uh based on the fact that it sounds like you know, we as a council are kind of confident that we could move forward on this based on what what Bob and Doug has told us, then I wouldn't have a problem uh going ahead and approving uh item number 22 regarding the park to open up the way we discussed.

The agenda items drafted where obviously you can make recommendations as warranted.

It was uh originally contemplated when it was first on the agenda in January, that it might be like recommend for filing of litigation.

Um we ended up getting progress reports from uh Bob and his client at that first meeting and just continued this out for a status check.

So it's more or less like I don't know if we can't really approve anything.

There's not really like a pending, it's just one of those where if you want to direct staff just to continue to work with the developer to get the park into condition so it's ready to open.

And obviously, with I mean, I can talk to staff and the mayor and city manager about if there's a need going forward to put something on the agenda uh as a status check related to this.

But it sounds like I mean, based on the conversation today that uh council as a whole is fairly content with where things stand right now.

So I don't know, like a motion to approve.

I don't know what we're really approving.

I don't know if you just want to maybe direct staff just to continue to work with the developer.

Well, I uh are we just making it.

Yeah, can I just make a comment?

I I would recommend that we come back in 30 days because what we want to see the condition of the turf is germinating and the results of the sand, because they're not quite done with that yet, and the restroom building.

Okay, so what are we doing here?

Are we keeping the park closed for 30 days?

No.

Or we're just opening up the area that will not be roped off.

I think what um what is uh Doug's mentioning is that we would come back in 30 days for another status check to tell you where we are, and I think that's where it is, and then we give more directive, yeah, or more direction from you because another 30 days, I don't mind coming to see you every 30 days.

We miss you too.

But uh, but I think at some point in time, I think we're you kind of know where we are, right?

And I think in 30 days, unless something really goes south on us, um, I think we're pretty much done.

We could work offline with your staff um in getting whatever else we need.

And as Andy has said, is if something really needs to be put back on the agenda, that's not good for me, more than likely.

But if something, if uh your city manager and city attorney want to put something on the agenda again, they can.

But I think a lot of this stuff now is pretty much we were we got a good rhythm and cadence going on what needs to get done.

So that's good news.

Um is Greg Sitar.

Um I am the president of the HOA of the uh Aries and Over Point uh subdivision.

And um I'm here to say the DR Horton the Builder um is now trying to get their bond back, and they've been ghosting us for about two years already.

We have a lot of safety issues that have been developed in the in the community, and trees, palm trees that have died.

We have proper documentation so far to repair make these repairs is 175,000.

We have our attorneys involved.

Um we have a um 21-page report from an outside uh contractor that reviewed him and myself into the whole community, and we have documentation of stuff.

Walls have not been waterproofed.

Uh underlayment bricks have openings where water can get in penetration.

We also have one homeowner that the water is running by into her house almost.

So again, um, I'm coming to you.

Um, you know, as a homeowner and um a president of the HOA um to hopefully not let this bond release until we speak to somebody about getting these items resolved.

The the community is only three and a half, four years old, and this stuff should not be happening at this stage, early stage.

I'm sure there's other developments having issues, but I'll speaking up from our for our community.

Again, I am a volunteer here in town.

Again, I dedicate my time.

Like I say, I think in four years, these issues should not be happening at this stage.

Twenty years down the road, I would say yes, but not in four years.

And uh, once the bond is released, then the homeowners are stuck with the with the burden of straddling it with the with these uh with these costs, and we don't have the money in our funds.

To do that, we would we almost be bankrupt.

And um school buses included, school buses.

Um I've talked to the neighbors, the neighbors are complaining that the stop signs that are there, school buses will just breeze right through them, that make their turns, whatever they gotta do.

They don't stop at the stop signs, and they have kids on the buses.

Um I'm just saying this is something that's still going on.

Um the 15th of this month from 10 p.m.

to 1 a.m.

We've had uh people doing drag racing.

We had the motorcycles.

I don't know what else to call them other than what my school old school is as we call them rice rockets.

They're going up and down drag racing up and down, not one by one, but in pairs, as it's a drag race.

My name is Tom Gobin.

I'm president of Sedona Ranch West.

We were informed by the city that we have a water leak somewhere in our common area 10 months ago, April 2025.

A landscaper spent 50 hours trying to find that leak to no avail.

I then called three companies specializing in leak detection.

The Nevada leak detection Matthew Henderson came to the property.

He needed irrigation planes from the city for the whole common area before he can put his expensive equipment to work.

The city did send us planes, but they're all for the wrong community.

They sent us a second set of planes for a different wrong community.

Uh we still don't have any planes.

We still get notices of late fees and fines.

And the next one I'm told is 1280 for something we have no control over.

It's not right that we have to pay fees and fines, plus pay for the lost water.

And now we are told there is no guarantee we're gonna get those planes.
