2:56However, in accordance with NJSC 10 colonel 4-12, nothing in this act shall be construed to limit the discretion of the public body to permit, prohibit, or regulate the active participation at any meeting.
3:09Therefore, please be advised that the council will not entertain any comments from persons who communicate a seal material mixed statements which are considered biased intimidation, in which a person attends to intimidate any individual or group because of race, color, religion, gender, handicap, sexual orientation, or ethnicity, or makes comments intending to harass and speak any offensive language.
3:30The person who makes these statements will relinguish their allotted five minutes for public discussion.

3:45My name is Renee Griggs.
3:47I live at 23 Aspen Place Apartment 6C.
3:50I was unable to make the November meeting, but I wanted to come because I do report bad things, and sometimes I like to report good things.
4:00On October the 31st, the residents of Spare Village hosted a Halloween event.
4:06And I wanted to say that we saw a positive shift in the new policing order that we have.
4:13First, uh the security coordinator for Carol came out, made his presence known to all the residents.
4:23And also the supervisor of the officers that's stationed at Spear Village.
4:33They set up a station.
4:35They gave out candy, good candy too.
4:40Um they tried to uh familiarize themselves with some of the children and adults that participated, and I saw that as a positive move because we have been complaining about policing and asking place.
5:00So we saw that as a first step to make it a positive change and community policing.
5:04For my understanding, these officers still come around, make try to make themselves familiar with the residents that live there.
5:13Um to reassure them that uh our safety is paramount and they dearly work.
5:20So I just wanted to uh highlight that since I was unable to make the meeting in November.
5:27I thought I would come tonight and um let you know that to uh Chief Guzman, he said that um the guys that were coming on that he uh work closely with them and that they are about the community, and I want to thank him for that tonight, because they certainly have shown themselves to that and makes the residents feel a little more secure, a little bit more safe because they we see them, they visible, and they they're letting us know that they out there for the community and happy holidays to everybody that's sitting on the dias, and who can hear my voice?
6:10However, and whichever way you celebrate the holidays, I hope it's a happy and blessed one, and to uh assembly men congratulations on being re-elected um again, and uh I'm gonna say that uh I am not a newly uh what you call the counter committee person again at um four or two and it wasn't hard to join them out as you can see Spear Village 42 did a good showing in this uh last election and we only look forward to do better.

12:38An ordinance amending the redevelopment plan for Market Street redevelopment plan area.

12:59We're adding another lot to this redevelopment plan.
13:03So and I tried to make it as clear in the in the backup.
13:09If you look at it, right behind the building off of uh Monroe Street is an old pre-existing non-conforming mechanic shop.
13:20That doesn't really fall in line with the overall development of that Market Street redevelopment plan.
13:27Um and it's it happens sometimes when you do these sweeping um remountment plans that there may be a parcel here or there.
13:34So the owner of the parcels, because they own the the one owner owns a few of the parcels, is kind of requesting for that to be uh added so they can make a bigger overall redevelopment project.
13:46But they have to still meet the same criteria from the how many minutes per eight, whatever it is.
13:51The plan doesn't change.
13:53All we're doing here is grabbing that lock and putting it into the plan, which was not in the plan in the original plan because of the way the lots were laid out.

14:28On 59, please, and ordinance amending chapter 317-30 B sub eight, affordable housing mandatory set aside.
14:37I'd like to have the uh is there a maker of the motion first?

14:45What are we changing here?
14:46Okay, so um in the original ordinance that currently stands, whenever there is a fraction of an affordable housing unit, you round up to the highest number.
15:00When we did the 20% density bonus, we never made it round up to the highest number.
15:06So what this will do is any fraction point five or higher would round up any fraction point five.
15:16There was no other changes to the plan.
15:18The is a one-liner um that changes.
15:23Now the one question, I guess, for the attorney, just for the record to make it clear is there a necessity for that one change to go back to the planning board for their consistency review?
15:36Because if not, no, and I agree.
15:40That's why I'm looking at the ordinance.
15:42If there was if we can just make that for the record so that the council can vote on it and we take out the be it further ordained.
15:50So with the council's permission, I just wanted to verify that before we took any action.
15:55If we just remove the be it further ordained, which refers it to the planning board, the the city council can take action in first reading, and then it can be right out our next January meeting versus the January 20th meeting.
16:08So for the record, that's acceptable.
16:11Affordable set aside.
16:16Well, when the whole when the whole plan was done for that set aside, it's a land use ordinance.
16:23And what happens in the municipal land use law of the state of New Jersey, any land use ordinance dealing with any zoning or land use has to be referred to the planning board for what's called a consistency review with the master plan.
16:36So basically, what we would do is we would submit this to them.
16:39I would go over how it's consistent with the master plan, and then they would send it back to the council with the recommendation.
16:46But in this case, you're really not changing the essence of the something we would have intuitively done.
16:52Right, we would have intuitively done anyway.
16:54So I just wanted to clarify that so make sure that we're not in any legal having any legal issues.
16:59So but normally if this was the full plan, it would have to go to the planning board for that's done by the state of New Jersey and municipal land use law that requires it.
17:08It's there's no um that's why I wanted to make sure it was clear.
