The Payson Planning and Zoning Commission met on July 8, 2024, at 3:00 p.m. in the Town Council Chambers. - CUP22-008 Compliance Review – 104 West Phoenix Street: The applicant, Justin Garrett, requested an extension of the CUP because site improvements (grading, asphalt, sidewalks, landscaping) were not completed by the original deadline of May 24, 2024. The Zoning Administrator, Nicole Adams, summarized the background: the CUP was originally approved on December 5, 2022, with conditions, including completion by May 24, 2024, and a required compliance review if not met. A previous permit for the site had been revoked for non-compliance, but a new one was issued with conditions. Staff reported that a tenant improvement permit (PY2102-032) for the building interior is finished but cannot be finaled until all site improvements are done; that permit expires July 27, 2024, and would need renewal (at a reduced fee of 10% of the original).
- The applicant stated that the general contractor (Buddy Randall) has been occupied with multiple jobs, causing delays. We do have one hearing today on a conditional use permit. Would you like to the report? Yes. Thank you, Chairman. So this conditional use permit twenty-two-eight was originally approved on December fifth, twenty twenty-two with several conditions. The planning and zoning commission approved of these requests with the following conditions that construction be completed no later than May 24th, 2024, and that if it was not completed, the C UP would return to the planning and zoning commission for a compliance review, which is why we are here today. If the conditions have not been met, the commission shall notify the permit holder and shall set the matter for a public hearing. If at the conclusion of the public hearing the commission finds that the conditions have not been met, the conditional use permit may be modified or revoked. Previous use permit for this site applicant was revoked for non-compliance at one point and then re applied for and approved with the conditions that you had seen in the staff report. As far as the grading permits and the uh permits for improvements that the applicant is responsible for, they did receive their approval of the civil improvement plans is required with condition two within 90 days of that previous CUP issuance, and each grading permit issued by the town engineer when issued in conjunction with the building permit will run concurrently with and remain valid for the duration of that building permit. There is a current tenant improvement on site for the building there at City Storage. That permit number is PY2102-032. That permit work within the interior of the building is completely finished. However, it cannot be final out until the entire site improvements have been completed. That permit would be set to expire on 727 of this month and would need to be renewed so that that grading permit and the civil improvement plans would also be renewed. I will say that the applicant has maintained regular communication with town staff to provide updates on the project, and the applicant's contractor has been occupied with multiple jobs causing delays in the completion of the construction. I will also add that we did receive a email this morning from the general contractor for the applicant. I will read that now for the record. Nicole, the city storage project is finally going well. The Phoenix Street improvements have the sidewalks at 95% complete. The Cedar Lane has excavation started. The rough grading for the property is now complete. The base fill has been installed and compaction will start this week.
