Let the record reflect that all council members are present.

And we have no call to the public, special meeting.

Purpose of the meeting, A1 discussion and possible action, including consultation with the town attorney for purpose of discussing or considering of the town manager's employment, including but not limited to his response, not limited to his hiring practices, employee screening, and performance of administrative responsibilities.

The town council may vote to discuss this matter in executive session pursuant to ARS 38-431.03 paragraphs A one and three.

Uh we do all of these together.

Yeah, Mayor and Council, I suggest just one motion for all three items, just so you're not back and forth.

A two is discussion with the town attorney for legal advice regarding the town's personnel policies, including hiring policies, practices, and the use of background checks.

The town council may vote to discuss this matter in executive session pursuant to the same ARS that I just read.

A three discussions, possible action with the town attorney regarding any pending or contemplated litigation related to complaints involving the former economic development director.

The town council may vote to discuss this matter in executive session pursuant to ARS 38-4313, section A3 through and four.

Uh I would entertain a motion to retire to executive session.

I'll make a motion that we move to executive session for A1, E2, and A3.

Um all that we know some of us may know.

We go in the executive discuss uh uh session, it's gonna be discussed, and then we're gonna come out and regardless of what the vote is or what happens, actions, we're not gonna be able to talk about it.

But even though we know, I would like to think that maybe we ask Darren Caldwell since it's his, you know, the I think the attacks are the fronts are on him, he can decide whether or not it's a public thing or not.

As far as executive session, I do not want to go in there, and I may refuse to go in there because I don't want to be hamstrung order hamstrung, you know, with what I can explain and discuss later on.

So can I well I was gonna say mayor count so you have a motion and a second, so you can certainly vote no.

I mean, I think I you would probably want to take the vote, and then we can make a determination from there of how to proceed.

I get directive to what I can say in public since it is a personnel issue, and then I'll come out and tell you guys everything.

When we go in there, whatever's discussed, I can't I can't talk about.

Yeah, and I think it's important that these issues, these things need to be aired further at please.

What happens if all council members do not go into executive session?

What what's the some of its personnel and can't be discussed in public?

I mean, you are essentially putting the town in a precarious situation, possibly.

I mean, if we're going to be talking about explain precarious situation, can we please we have we're trying to hear legal advice?

We hear you.

So part of as the mayor read, this is about legal advice on the personnel matters, obviously the town manager's employment.

Also contemplated litigation.

We do not discuss that in public because that will expose the town.

So again, if you choose not to, and all of you choose not to, then I would also then entertain a motion for you to waive attorney client privilege because I cannot advise you in public without that.

You know, when we've had this come up before with the personnel issue, they were they had the choice whether or not you know their accusations against them were either in public or an executive session.

They chose public, and that's what happened.

Why is this different?
