0:21

Held at 7 p.m.

0:22

PBD City Hall, Wigan Auditorium 24 Lowell Street, PBD, Massachusetts.

0:29

First item on the agenda is the approval of the minutes of the meeting of September 4th, 2025.

0:39

Mr.

0:39

Chairman, I move that we uh accept uh and approve the minutes of September.

0:44

This is September 4th.

0:46

Is that correct?

0:48

Uh the meeting minutes of September 4th, 2025.

0:51

We have a second.

0:52

Second.

1:02

Judy, you tuned in.

1:06

Yes.

1:06

You in favor of the meet uh minutes.

1:09

Minutes.

1:10

Yes, I I I vote to approve.

1:12

I'm sorry, I can't hear Michelle.

1:14

Okay.

1:19

Next item on the agenda is ANR Land Court.

1:23

We have none.

1:26

Uh next item is site building permit plan review for Zero Hardy Street, Map 85 lot 001 continued from the meeting of 9 uh 94 to 918 2025.

1:43

Jack?

1:43

Uh Mr.

1:44

Chairman, just before Attorney Kelty gets up here, just to update the board.

1:47

We received uh a digital copy of this plan last week, but we did not receive hard copies of this plan until after the uh agenda deadline.

1:56

So attorney Kelly has brought plans this evening to the board uh and I believe he's handed them out to you.

2:03

So if Jack wishes to ask, these would have to be laid out and would have to be voted in.

2:09

Do be discussed.

2:12

So it sounds that simple, but it ain't um yeah, just before the board makes any motion to accept, I would recommend that the board listens to Attorney Kelty's explanation first before voting to accept these ones then.

2:28

So on uh approximately uh I uh Wednesday or so last week, I receive an electronic plan which I forwarded over uh to try to keep my place on the agenda.

2:43

Uh then was advised that I needed hard copies, had them by Friday morning.

2:50

That was now after the deadline, and we're attempting to give them out tonight.

2:54

However, if it was that easy, I wouldn't be standing here.

2:59

But the uh the plan you have in a larger copy shows concrete sidewalk.

3:06

Hayes made an error.

3:08

We do not agree to build concrete sidewalk.

3:11

There is uh a new electronic plan, which I have not shared, uh, which is uh under a different date.

3:19

Uh it has the date and that shows concrete Cape Cod in the same spot that we're showing the five-foot concrete.

3:29

We would replace the concrete with Cape Cod berm, no granite berm, and we would uh not pour concrete but would instead uh use asphalt.

3:41

Uh I believe that the Department of Public Services wants concrete and uh would uh uh and they want granite curbs.

3:49

We do not want to pour concrete.

3:52

We do not want to dig granite curb uh because we have an AUL, the essence of which is no digging.

4:00

Uh when we do anything out there, we're gonna have to have a uh LSP on site because of the AUL.

4:07

The property is uh entirely impervious now.

4:10

We would put layers over that which exists uh and try to uh keep we're going obviously we're gonna have to dig for some of the foundation for the building and the footings for the building, but we're trying to keep digging to a minimum.

4:26

And so the plan you have uh is not accurate with respect to uh the materials we intend to use.

4:35

Uh there are I think two choices to uh take a vote and uh vote on um the plan dated uh the well the the proper plan which you don't have in front of you uh is dated September 15th.

4:54

The plan you have is September 2.

5:00

Uh and um I don't know if the board uh would choose for us to uh it comes down once again to uh we have gone over the issue of uh MDC traps.

5:11

Uh I have spoken to a number of people that uh there is an uh operation, there is an apparatus that uh functions uh as an MDC uh uh trap does.

5:23

However, because we're in the floodplain, it's way more expensive and uh does more in terms of separating uh and keeping any kind of petrochemicals out of the sewer system or even out of the storm drain.

5:37

Uh that we would agree to uh the other conditions.

5:41

Uh the only condition that we're getting from uh the uh uh public services department is the issue of the sidewalk.

5:49

Uh now I think we've gotten it to a point where if you are happy with the uh number of curb cuts, which is one, two, three, they're aligned with our um uh we made one of the uh units, we changed the shape of the unit so it was kind of Siamese, and uh now three curb cuts give us the access we need.

6:10

Uh we are uh providing a sidewalk, although not to the materials that I think uh are desired.

6:17

If the board uh feels uncomfortable uh without the final plan under date of September 2 showing uh asphalt, I'll come back again.

6:29

Uh and you know perhaps this falls in the category of uh as said by the three stooges, wake up and die right.

6:38

So just to summarize the plan before us is not the plan you filed with the with the office last week.

6:45

It yes, it is.

6:47

However, they're not going to use the materials shown on that plan.

Peabody Planning Board Meeting – September 18, 2025

The Peabody Planning Board convened on Thursday, September 18, 2025, at 7:00 PM in the Wigan Auditorium at PBD City Hall. The board approved the previous meeting’s minutes, discussed a site plan review for Zero Hardy Street, granted an extension for 15 Sylvan Street, and addressed appointments. The meeting adjourned after unanimous votes.

Consent Calendar

  • Approval of Minutes (September 4, 2025): Unanimously accepted and approved.

Discussion Items

  • Zero Hardy Street (Map 85 Lot 001) – Site/Building Permit Plan Review: Continued from the September 4 meeting. Attorney John Kelty, representing the applicant, presented revised plans for a seven-unit contractor’s garage. Key issues included sidewalk materials and curb design. The applicant initially opposed a concrete sidewalk due to an Activity and Use Limitation (AUL) restricting excavation, instead proposing an asphalt Cape Cod berm. The Department of Public Services (DPS) required concrete. After discussion, the applicant agreed to a concrete Cape Cod berm (instead of asphalt), and the board addressed additional conditions: ADA accessibility, downward-facing lighting, no-parking signage, and compliance with DPS. The board voted unanimously (8–0) to approve the plan dated September 2, 2025, with these conditions.
  • 15 Sylvan Street (Map 30 Lot 49) – Extension Request: Attorney Kelty requested a two-week extension to October 2, 2025, to address peer review comments (outstanding soil samples). The board unanimously granted the extension.

Appointments

  • Paul DiBiassi (PB Living LLC): No update; still awaiting a meeting with DPS.
  • Adoption of City Planning Zoning Map: The map, previously endorsed following MBTA 3A rezoning, was ready for signatures. The board agreed to sign a large-format copy at the next meeting.

Key Outcomes

  • Approved minutes of September 4, 2025 (unanimous).
  • Approved site plan for Zero Hardy Street with conditions: concrete Cape Cod berm for all sidewalks, hooded/downward-facing lighting, no-parking signs, ADA compliance, and satisfaction of all DPS requirements. Vote: 8–0.
  • Granted extension for 15 Sylvan Street to October 2, 2025 (unanimous).
  • Postponed signing of the zoning map to the next meeting.
  • Meeting adjourned unanimously.
