The Peabody Planning Board met on November 6, 2025, at 7:00 PM in the Wiggin Auditorium at City Hall. Lot Line Adjustment (Map 75, Parcels 174 and 174A): Attorney Jack, representing two LLCs owned by Michael O'Hara, proposed moving lot lines between two lots to enlarge Lot 4A. Board members noted that the plan omitted existing utility easements and underground electric lines. Roy observed that the easement would shift entirely onto one lot, requiring permanent easement adjustments. The board requested an accurate plan with easements shown before approval. The matter was continued to allow the applicant to edit the plan. (Motion to continue approved unanimously.)

103 Foster Street – Site Plan Review: Jean Christie (Tighe & Bond) presented a proposal by William and Robert DeNero to demolish existing industrial buildings and construct a single building with 17–18 contractor storage bays, eight parking spaces, and full asphalt capping to address an Activity and Use Limitation (AUL) due to historic contamination. The site abuts Goldthwaite Brook and is within Conservation Commission jurisdiction. Discussion included: entrance width concerns for tractor-trailers and fire trucks (board recommended widening), lack of landscaping due to AUL restrictions (board strongly recommended landscaping, possibly with hard infrastructure), need for architectural elevations and photometric plan, and differentiation between site traffic and access easement to rear properties. The project is under concurrent review by the Conservation Commission and peer review. The board continued the matter to the November meeting to allow for updated plans and peer review responses.

13 West Dane Road – ZBA Re-application: Attorney Kelty requested board authorization to refile a variance application with the Zoning Board of Appeals, correcting errors from a prior denial. The original plan incorrectly labeled a proposed deck and stairs as a “new addition.” The corrected plan shows only deck and stairs requiring side yard and front yard relief. The board voted unanimously to allow the petitioner to refile.

Like the call to auto PBD planning board meeting. November sixth, two thousand twenty five, held at seven PM PBD City Hall, Wigan Auditorium, Twenty Four Low Street PvD Mass. First item on the agenda is the approval of the amendment of the ten sixteenth two thousand twenty-five meeting. Uh Mr. Chairman, I move that we accept the minutes of the meeting for the ten twenty-five meeting. We have a second. Second. Dr. Otto second. All those in favor? I'm present. Uh map seventy-five parcel one seventy-four and one seventy-four A applicant. This property is located in our two zoning district. Applicant is proposing to move lot lines of original lot three, uh plus or minus uh seven thousand six hundred and ninety eight square feet and original lot of four of eleven thousand seven hundred and sixty-two feet. I'm an attorney, I have offices at Forty Low Street and Peabody Mass, and I'm representing uh two entities, both of which are uh owned and managed by uh uh a client of mine, Michael O'Hara. Uh the first uh unit uh the first deed is to M B O H L L C and the second piece of property is uh owned by I gave you that deed two and that's uh that's C M O H uh L L C. This is simply a matter of uh the um owner of the two properties wants to uh move the lot line uh that exists between uh between the properties. Uh we've put the former uh property line in uh dotted lines uh so that you can see what the lot was shaped like and look like before. Uh and now if uh you endorse the uh this uh approval not required plan, uh the line would be where you see it as a solid solid line. The uh both lots will uh have sufficient area and fretage uh in their zoning district such that they will not become any more uh non-conforming. Uh I don't know the exact purpose of this zone change, but um judging from uh a little bit of past history, uh it would seem to me that we're trying to make uh what shows is lot 4A as big as possible, uh and there is now some open space uh to the right, and it would not shock me if there was a proposal uh, but that would require a variance and would not be before this board until such time as uh a variance was granted. But that's speculation on my part. Uh and uh I'm happy to answer any other questions uh the board may have. Any questions from the board, Dr. Otto? Thank you, Mr. Chairman. Do both the lots to be created have uh frontage that complies with current zoning? Have the required frontage in the zoning district, yes. Thank you. Any other questions from the board? Go ahead. Uh through through the chairman to the applicant. Um you may not know what is going in there, but I know what is going in there. Uh maybe you can explain why they would need to go to ZBA. Is it for square footage? It's certainly not for frontage. Can you explain? You said they if they tried to put another duplex in there, they would need to go to zoning for relief. Can you explain what the reason for the relief would be if they were to get to try to put another house in there? Is it for sm not lacking square footage? It's not lacking uh frontage. Uh is required for the duplex. Right. So it's not a good one. I have 11,922. If I try to take any away, I'm not I don't have 15,000 combined. Right. Right. So it's not it's not frontage, it's square footage is the problem.
