3:01

Like the call to order, PBD Planning Board meeting agenda for October fifteenth, two thousand twenty-six, held at seven PM, PB City Hall, Wigan Auditorium, Twenty Four Low Street, PBD Mass.

3:15

At this time, I'd like to suspend the public the planning board meeting and enter into a public hearing.

3:22

Notice is hereby given that the Planning Board City of PV will conduct a public hearing on Thursday evening, October fifteenth, two thousand twenty-six at seven PM Wigan Auditorium, City Hall, twenty-four Low Street, PB Mass to consider the revision of Chapter Forty Eight, Section Five, Massachusetts General Laws to consider amending the zoning map of the city PB as follows.

3:53

Section One that the zoning map of the City of Peabody entitled PB zoning map adopted twelve twelve of twenty-four as amended hereby further amended as follows.

Speaker 2

5:00

And uh we uh originally came here seeking uh uh an R4 zoning designation.

5:09

Uh we had uh indicated to the planning board and uh uh at that hearing that uh what we wanted to yield was whatever the lot area and frontage uh would yield uh without uh the construction of a roadway.

5:27

If we take this matter to the uh planning board, we have a um uh plan that would depict that we've got to build X number of feet of roadway, get to the top of the hill, put a cul-de-sac, brings us closer to uh uh the vernal pool area uh and uh utilizes in uh uh a fashion almost all of the uh acreage of this lot.

5:52

Uh it was suggested uh that uh my R4 zoning, which I had initially asked for so that we could do multifamily.

6:02

Uh it was suggested that the R4 zoning would allow commercial, and that's true.

6:07

I think it was uh counselor Hartman uh that uh pointed out to the city that uh uh a change to R4 would allow there to be mixed use.

6:17

Um that was uh not amenable, I think, to this board uh to the city council and uh so I amended uh since what we want.

6:28

If we went to uh if we filed this definitive subdivision plan, is our uh expectation uh and we've done the engineering to determine uh mathematically that we would get four lots uh under the current zoning, and we would need to build the roadway to frontage.

6:47

That would entail uh a major uh uh uh concerns uh by the neighbors with respect to blasting uh uh and uh in order to get that hillside down to the grade uh that the planning board could uh approve.

7:06

The um it was pointed out that we would get the same yield with an R2.

7:12

There would be no possibility of uh of uh having uh mixed-use zoning.

7:18

And so uh we amended our request to the City Council land to this planning board.

7:24

We amended it to uh seek R2 zoning.

7:28

Uh that would yield two uh two lots uh and each of them could have a two-family uh duplex structure uh and uh we're perfectly content fine with that.

7:42

I do know that uh there is some concern on the part of the neighbors.

7:46

I believe that if the board uh makes a recommendation this evening and it moves on to the city council, uh I would be able to have a development plan available uh to address issues that have arisen uh such as uh impact on neighbors.

8:03

Do we are we gonna provide any kind of landscaping?

8:06

Uh we hadn't really uh engineered that yet, but it's very, very possible the two uh the two R2 lots would be would provide uh plenty of space to uh uh to plenty of space to uh provide landscaping fencing, whatever it uh may be.

8:25

Uh we've also been asked to consider uh whether or not uh we will make utilization keeping uh the vernal pool that's between us and the high school.

8:36

Uh years ago, there was a small parcel of land donated as part of the uh subdivision that runs up the hill a couple of doors down.

8:46

Uh and uh there's an area where there is a bench, and I think that bench is uh dedicated to uh Dr.

8:54

Perezian uh and uh former chair of the conservation commission, and it affords uh the opportunity for the high school uh kids to come out.

9:03

I think the doc himself actually used to uh bring a class out and sit and learn to appreciate the nature of uh a vernal pool.

9:13

So we will consider there will be uh extra land that uh uh is uh covered by the vernal pool, so we will consider uh dividing that off and uh uh things of that nature.

9:27

There is no uh risk of uh commercial development if we go to the R2 zone, and uh I'm happy to answer questions uh that the board or uh the public may have uh for you this evening.

9:42

Where request has changed to change us from R1 to R2 rather than our earlier requests R1 to R4.

Speaker 1

9:56

At this time, any questions from the board?

9:58

Yes, sir.

Speaker 3

10:01

Through the through the chair.

10:03

Jack, uh why does your proposal not include rezoning for all of that neighborhood?

10:09

They're all the same zone currently.

10:11

Why aren't we making a proposal for that whole neighborhood to be rezoned?

Speaker 2

10:16

The use of the land by uh uh the our neighbors uh we're proposing a teardown uh and um the other neighbors haven't approached or haven't asked to be in involved in it.

10:31

I think if there were other neighbors that wanted uh this zoning, uh we would uh happily let them tag along and request the zone change, but we've had nobody approach us asking for that zone change.

Unassigned speaker

10:45

And

Speaker 2

10:46

of course, our immediate uh neighbors uh the temple, which is exempted uh under zoning and uh they can be located in any zoning district.

10:58

Thank

Unassigned speaker

10:59

you.

Speaker 1

11:00

Any other questions for it?

11:02

Yes, Judy.

Speaker 4

11:03

Yes, do we have a map or a plan that shows this parcel?

Speaker 5

11:09

Just put it on the screen.

Speaker 4

11:11

Thank

Unassigned speaker

11:11

you.

Speaker 5

11:29

Just to orient my mouse is on top of the high school.

11:32

This is Lowell Street and the intersection right here where my mouse is is the rolling hills entrance.

Speaker 2

11:50

Uh that a shared driveway between the two duplexes yielding one curb cut uh would be uh uh more desirable than two curb cuts for each

Unassigned speaker

12:01

unit.

Speaker 2

12:03

So the house that shows that'll come down.

12:06

There'll be a uh line essentially uh centered uh in the middle of our frontage, and uh that line would create two lots in excess of 7500 square feet each.

12:19

And in the upper left hand corner, that uh sort of tomahawk section, that's where the vernal pool

Unassigned speaker

12:25

is.

Speaker 1

12:29

Any other questions from the board?

12:31

Yes.

Speaker 6

12:33

Jack, a couple of questions.

12:35

Um where would the uh the access be for this lot?

Peabody Planning Board Meeting - October 15, 2026

The Peabody Planning Board convened on Thursday, October 15, 2026, at 7:00 PM in Wigan Auditorium, City Hall, 24 Low Street. The agenda included a public hearing on a zoning amendment for 495 Lowell Street, a discussion on a recommendation regarding AI data centers, a site plan withdrawal, and a bond release.

Public Hearing: Zoning Map Amendment for 495 Lowell Street

Attorney John Kelty, representing the applicant, presented an amended request to rezone the property from R1 to R2. The initial request was for R4, but was amended to R2 following board and city council feedback.

  • Applicant's Position: The applicant stated that under current R1 zoning, developing the property would require building a roadway and cul-de-sac, necessitating significant blasting and grading that would impact the hill and vernal pool. The R2 change would allow for two duplex lots (yielding four units) without a new roadway, minimal soil removal, and preservation of the wooded area around the vernal pool.
  • Board Questions: Members questioned the applicant about access points (confirmed solely on Lowell Street), lot dimensions, grading impact, and potential "spot zoning" concerns. The applicant argued that the R2 development would be far less impactful than a standard subdivision.
  • Public Testimony:
    • Jared Hockman (52 Ellsworth Road, congregant of Temple Tiferet Shalom) recused himself from deliberation or votes due to a conflict of interest. He spoke as a neutral resident raising concerns about the lack of a detailed plan, security buffers between the property and the temple, noise, and lighting. He requested a natural buffer zone and fencing.
    • Dr. Ed Weiner (Vice President, Temple Tiferet Shalom) expressed deep concerns about security, privacy, and noise, noting the temple requires armed security for all events due to the current climate. He requested a survey of property lines, review of the vernal pool, and a continuance to allow for negotiation of reasonable conditions.
    • Fatima Magatear (497 Lowell Street) expressed concerns about the shared driveway, increased traffic, blind driveway conditions, deforestation, and the changing character of the neighborhood from single-family to multi-family. She requested a traffic study and expressed concerns about the speed of the process.
  • Board Deliberation: Board members Roy Simos, Thomas Battancourt, and others requested a preliminary plan showing lot lines, driveway location, building footprints, and a strong buffer to the temple before supporting the zone change. They urged the applicant to work with the abutters.
  • Motion and Vote: A motion to recess the public hearing until the November 5, 2026 meeting passed unanimously.

Consent Calendar

The minutes of the October 1, 2026 meeting (the agenda item mistakenly referenced a December date but the motion was for the October 1 minutes) were approved by unanimous roll call.

Discussion Items

1. Site/Building Permit Plan Review: 81 Prospect Street

  • A withdrawal request from the developer was received and approved unanimously without prejudice.

2. Stonegate Subdivision - Surety Bond Release

  • The board considered a request to release the remaining surety bond. Department of Public Services conditions regarding mylars and digital plans were fulfilled. Board members confirmed the site was in good condition. A motion to release the bonds passed unanimously.

3. AI Data Center Zoning Recommendation

  • The board considered a memo from the subcommittee proposing a definition for data centers and two potential zoning districts. Members expressed strong opposition to data centers in Peabody, citing energy, water, and environmental concerns. Some members wanted specific dimensional requirements. The discussion was continued to the November 5 meeting for a formal draft recommendation.

Key Outcomes

  • Zoning Amendment (495 Lowell St): Public hearing recessed to November 5, 2026. Applicant to file preliminary plans and meet with neighbors and Temple Tiferet Shalom.
  • Stonegate Subdivision: Surety bond approved for release.
  • 81 Prospect Street: Site plan review withdrawn without prejudice.
  • AI Data Centers: Discussion continued to November 5, 2026 meeting for drafting a formal recommendation.
