Right, they reply.

0:20

Okay.

0:23

Okay.

0:28

All right.

0:29

We're going to start.

0:34

I'd like to call to order the planning commission meeting for today of September 9th.

0:40

There's a lot of people here.

0:41

I know who want to speak on a couple of projects probably.

0:44

So let's we're going to get into it.

0:48

If you're here for the solar project, they asked for it to be adjourned until next month.

0:54

So we will not be discussing uh the floating solar array tonight, um, which is listed as a first item on the agenda.

1:02

Um we had left the um you you should vote uh chair to adjourn.

1:07

I was gonna do that, yeah.

1:09

So can I if I can have a motion to adjourn this to move to the October meeting?

1:13

Second.

1:14

All in favor?

1:15

Aye.

1:16

Okay.

1:17

All right.

1:18

Uh the next item on the agenda is a continued public hearing regarding final site plan approval um for the proposed construction of a single family home on property located in the R1B one family residential district located at 527 Union Avenue.

1:35

Uh the applicant is Mark Picchucci, he's the contract vendor from us, and then he's also the owner.

1:42

Um last month we asked them to go back.

1:47

There was a number of inconsistency inconsistencies between the renderings, their um drawings, and we asked them to sort of clean some of that stuff up.

2:00

Um so I will uh um public hearing still open.

2:04

I'll ask the applicant to sort of update us on what was some of the concerns that we had raised at the last meeting.

2:12

Uh state your name.

2:13

Good evening to everyone.

2:14

Mark Pacucci.

2:15

Can you lift it up a little higher so that we can hear you better?

2:18

Thank you.

2:18

How's that?

2:19

Better?

2:20

Yeah, just speak.

2:22

Uh good evening to all.

2:24

Uh I have my engineer and architect on the uh zoom.

2:29

I don't know if there was something maybe that that got misconstrued, but the the upgraded plans were submitted.

2:38

And um I don't know what what happened there.

2:43

So Megan, would um would you be able to speak a little to that?

2:50

She's here she is.

2:53

Are you asking Megan?

2:54

There yes, Megan.

2:55

Can you guys hear me?

2:56

I'm sorry, my computer's having some issues tonight.

2:58

Yeah, speak speak a little bit louder if possible.

3:01

Sure.

3:02

So we received the site plan, the revised site plan um today.

3:08

We received an updated plot plan and renderings um last on the 27th, and then we received some additional renderings uh last week.

3:20

So it's it's been an ongoing um I guess stream of submissions.

3:27

I don't believe Christian has had a chance to review the site plan that was received today.

3:32

Um I did review the architectural um elevations and renderings that we received this morning.

3:40

Um and many of the comments that were outlined in the staff report have since been addressed.

3:48

Okay.

3:49

And Christian, did you Megan said you said Christian might have some questions or good evening, everyone.

3:58

Uh the only comment I really have remaining is how the infl or how the uh the concrete chambers are intended to function.

4:07

It it seems are from the elevations that were provided on the something that they plan that that I have revised 826.

4:19

The bottom of the chamber is below the elevation of the pipe that's going into the street.

4:25

So from it looks like these chambers are gonna be half you know, with two feet of two or you know, one or two feet of water in them all the time.

4:33

I wanted to understand if that's how they're intended to work.

4:38

Because if there's if they're gonna be full of you know partly full of water all the time and there's no real water moving through them like you would have for a septic tank.

Summary of Proceedings

Peekskill Planning Commission Meeting – September 9, 2026

The Peekskill Planning Commission met on September 9, 2026, at 7:30 p.m. in the Common Council Chamber. The meeting covered continued public hearings, a new public hearing, and a recommendation to the Common Council. Key items included a floating solar array (postponed), a single-family home at 527 Union Avenue, a 24-unit cluster development at 1130 Frost Lane, and a 158-unit mixed-use affordable housing project at 418 North Division Street.

Public Comments & Testimony

  • 527 Union Avenue: A letter from neighbor Mark Fitzpatrick requested the Commission evaluate the proposal based on engineering drawings rather than conceptual renderings. No other public comments were made.
  • 1130 Frost Lane: Multiple residents spoke in opposition, raising concerns about water runoff, the proximity of the 20-inch city water main, potential rodent issues, traffic safety, parking shortages, and the project's scale relative to the existing single-family neighborhood. Residents also highlighted a tax arrearage on the property and questioned the developer's track record. A petition with 63 signatures opposing the project was submitted.

Discussion Items

  • Continued Public Hearing – 527 Union Avenue (Mark Picucci): The applicant reported that revised plans had been submitted, but the Commission noted that architectural renderings and engineering drawings were not fully coordinated. Staff reviewed the submissions and found several remaining comments, including tree removal details and detention chamber elevations. The Commission tabled the item to allow review of all materials.
  • Public Hearing – 1130 Frost Lane (Peekskill Views, LLC): The applicant presented a revised 24-unit cluster development (reduced from an initial 33 units) with two access points, preservation of 8.5 acres of conservation land, and a 50% density reduction from the as-of-right 45 units. Discussion focused on:
    • Water Management: Concerns about groundwater and an existing 20-inch water main. The city engineer prohibited blasting near the main; chipping may be allowed but with vibration monitoring. The applicant agreed to no blasting.
    • Traffic Study: Commissioners requested a technical memorandum updating the 2023 traffic study to reflect the new access configuration and current conditions.
    • Phasing: The applicant sought phased construction and COs; the Commission expressed concerns about incomplete development scenarios and requested a performance bond or restoration plan.
    • Architecture: Commissioners requested varied building colors and additional pedestrian-level renderings to assess visual impact.
    • Conservation Easement: The Westchester Land Trust is re-engaged; the Commission stressed that the easement must be finalized before final approval.
  • Recommendation to Common Council – 418 North Division Street (418 North Division Street LLC): The applicant presented a revised design for a 158-unit affordable housing project (4% low-income housing tax credits) with a daycare and community arts center. Key discussion points:
    • Building Scale and Shadow Study: Commissioners noted the six-story building would be significantly larger than surrounding structures. They requested a shadow study comparing the as-of-right four stories with the proposed six stories, and pedestrian-level renderings for Constant and Highland Avenues.
    • Traffic Study: Concerns included the use of ITE codes, lack of analysis on Harrison Street, and timing of counts (November 2025, possibly during Thanksgiving week). A detailed memorandum was requested.
    • Parking: The Commission debated whether the code-required parking is appropriate for an affordable development, noting underutilization in similar projects. (Parking reduction would require Zoning Board action.)
    • Daycare and Community Space: The daycare's proposed outdoor play area (covered but open to the street) drew questions about drop-off logistics, security, and sunlight. The community arts center concept was welcomed.
    • Brownfield Cleanup: The former White Plains Linen site requires remediation; the applicant confirmed a Track 1 cleanup to unrestricted use standards.

Key Outcomes

  • Floating Solar Array: The public hearing was adjourned to the October 15, 2026 meeting at the applicant's request. (Vote: unanimous)
  • 527 Union Avenue: Continued to October 15, 2026, to allow the Commission to review coordinated architectural and engineering plans. (Vote: unanimous)
  • 1130 Frost Lane: The public hearing remained open and was continued to October 15, 2026. The Commission scheduled a site visit and requested: an updated traffic memo, alternate architectural renderings with varied colors, a geotechnical report on rock type, and further details on water management and phasing conditions.
  • 418 North Division Street: The discussion was continued to the October 15, 2026 meeting. The Commission was not ready to make a recommendation to the Common Council. The applicant was asked to provide: revised shadow study (4 vs. 6 stories), pedestrian-level renderings, an updated traffic analysis, and consideration of scaling down the building's massing. The Common Council's public hearing on the project is scheduled for September 14, 2026, but may depend on the Commission's feedback.
