15:40

Thank you, Council President.

15:41

Just a couple of things.

15:42

16:26

He has been the fire service for 25 years and has been with Helen for 20 years.

16:31

He has extensive electrical background and is originally from Louisiana, but we won't hold that against him.

16:38

Um he's been one of our fire inspectors with Pellem for five years, and uh Andy works very well with the public, he is extremely knowledgeable and is a go-to for many people and uh in and around the community.

16:56

So we're very excited to uh to uh have Andy sir as our partner um weather held or it's also in the park uh yesterday, and attendance was right around 300, which was about the attendance uh for the previous year.

17:14

Um Jen Rev will be in attendance at the next council work session on October 5th to provide an update on the studies for the reap properties, so looking forward to that.

17:25

That's all I have.

Speaker 4

17:28

Thank you, City Manager.

17:29

We have no public hearings.

Unassigned speaker

17:31

Oh,

Speaker 4

17:32

I skipped over the report by the attorney.

17:33

Do you have any report from the city attorney?

17:37

No public hearings, no approved request to address the council, no old business.

17:42

That moves us into new business.

17:44

First on the agenda is 2026 zero nine two one zero six for an ABC license for applicant penson LLC operating under the trade name Pelham package store at seven nine eight four Heleno Road, Pelham, Alabama three five one two four.

18:03

Would any member of the council like this resolution read in its entirety?

18:08

I'll entertain a motion to approve or deny this resolution.

18:15

Motion and second.

18:16

Is there any discussion?

18:20

All those in favor say aye.

18:22

Aye.

18:22

Any opposed?

18:24

And that resolution passes uh unanimously.

18:28

That leads us to resolution twenty twenty-six zero nine two one zero seven in regards to the monthly residential garbage and recycling rate effective January first, twenty twenty-seven.

18:37

We talked about this at length in the uh in the work session, and all the council members seem to have had a lot of communication from the residents and and really some miscommunication.

18:48

So just wanted to try to clarify a point at any point in time.

18:52

This council has the power to raise or lower those rates and how the uh the the fund is looking.

19:00

So in other words, if there's a surplus, the council can address the surplus.

19:04

If there's a deficit, the council has to address the deficit in this case.

19:08

There was a deficit.

19:09

We are looking at we talked about in the um in the work session.

Summary of Proceedings

Pelham City Council Regular Meeting – September 21, 2026

The Pelham City Council met on September 21, 2026, at 7:00 p.m. in City Hall Council Chambers. The council unanimously approved a series of resolutions including the FY2027 operating and capital budget, an adjustment to residential garbage and recycling rates, an ABC license for a new package store, and a janitorial contract renewal. A proclamation declaring October as Domestic Violence Awareness Month was read, and several residents voiced concerns during public comments about a parking ordinance that resulted in citations for vehicles parked in their own driveways. The council acknowledged the issue and indicated it would be reviewed.

Proclamations

  • Mayor Rick Washer read a proclamation declaring October 2026 as Domestic Violence Awareness Month in Pelham. Mincy Cardin, outreach coordinator for Safe House of Shelby County, accepted the proclamation and thanked the council. She reported that Safe House received over 1,400 crisis line calls in the past year, provided emergency shelter to 180 victims and their children, and assisted nearly 700 victims through community services and their forensic medical facility in Pelham.

Public Comments & Testimony

  • Robert Manley (address not stated): Stated that his Ford F-150 (243 inches long) does not fit in his driveway (273 inches, minus 36 inches for sidewalk clearance gives 237 inches). He and several neighbors received $100 citations for violating ordinance 14-41 A2 regarding parking within driveways. He requested the council review and change the ordinance, noting that no warning was given before citations were issued.
  • Michelle Estus (519 Walker Road): Expressed frustration that residents were not warned before receiving citations, argued that the driveway dimensions are the fault of original builders, and stated that the $100 ticket is a significant hardship. She noted that many driveways are too short for any vehicle to fit within the required clearance.
  • Greg Watts (520 Walker Road): Has lived in the home since 2001, received three tickets for vehicles parked in his own driveway. He noted the sidewalk on Walker Road is continuous while other streets lack sidewalks, and suggested grandfathering existing homes or adjusting the ordinance. He plans to contest the tickets in court.

All three speakers asked the council to revisit the ordinance and provide a warning or modification.

Discussion Items

  • City Manager's Report: The city manager reported that staff met with ALDOT to begin mapping light activation for Highway 31, starting at the north end and moving south, with a shutoff/activation/decommission process beginning October 2026. She announced the promotion of Andy Fleury to Fire Marshal (25 years in fire service, 20 with Pelham, 5 as fire inspector). She also noted that an event at the park drew approximately 300 attendees, similar to the previous year. Jen Rev will provide an update on reap property studies at the next council work session on October 5.
  • ABC License (Resolution 2026-09-21-06): Approved unanimously for Pinson LLC (Pelham Package Store) at 7984 Helena Road.
  • Garbage and Recycling Rate Adjustment (Resolution 2026-09-21-07): Approved unanimously, effective January 1, 2027. The council clarified that the removal of the phrase “without the necessity of further action by the Pelham City Council” ensures the council retains authority to adjust rates in the future. A deficit in the fund necessitated the increase.
  • FY2027 Operating and Capital Budget (Resolution 2026-09-21-08): Approved unanimously after review.
  • Janitorial Services Contract Renewal (Resolution 2026-09-21-09): Approved unanimously with CDI Janitorial Services for certain city facilities.
  • Council Comments: Council members thanked residents for attending, commended city staff for budget preparation and responsiveness, and encouraged support for local businesses to strengthen sales tax revenue. Councilwoman Power noted excitement for Highway 31 lights and Pelham football homecoming. Councilman Harris acknowledged the parking ordinance concerns and assured residents the council will examine the issue.
