Item two on our agenda this evening is approval of the minutes from our last meeting.

0:25

And our last meeting was May 1st of 2025.

0:31

The minutes were in your packet.

0:33

Are there any additions or corrections?

0:36

I do have one addition, I guess.

0:42

Under uh hearing of visitors, not on the agenda.

0:46

Would you make a note in there that the chair did open that and heard no comments?

0:51

So then the period was closed.

0:55

That was the only thing that I would like to uh amend.

0:59

Then we'll have you sign an updated copy next month.

1:03

Are there any other additions or corrections?

1:06

So I'll make a motion that the minutes be approved as amended.

1:11

And a second.

1:12

We do have a motion and second.

1:13

All in favor say aye.

1:15

Aye.

1:16

Opposed, same sign.

1:18

Okay, the minutes are approved.

1:22

Item three on our agenda this evening is hearing of visitors for items not on the agenda.

1:27

Is there anyone in the room that would like to speak on an item that is not on the agenda speaking?

1:34

Seeing none, we'll close that portion of the agenda and move to item four.

1:42

New cases.

1:59

Before we move into that, I need to advise the group that uh for the record I will be recusing myself from this case.

2:07

I've had opportunity to speak to the applicant in a different forum in our uh HOA forum, and so it would not be fair for me to uh participate in this conversation this evening.

2:21

Uh I've had no conversations with any of the other board members, and so uh I'll recuse myself and I'll ask the vice chair Randy Duncan to run the meeting this portion of the meeting.

2:34

So, Randy, I'll turn it over to you.

2:37

Thanks, sir.

2:41

Staff report.

2:42

Yes, indeed.

2:44

Um this is application as a request for review and approval of a variance to code section 1147 14 uh to reduce the required rear yard and side yard setback in the grainshire subdivision for a recreational structure.

3:00

On the screen, you can see um the lot highlighted in uh turquoise color changes on the north side of Treehaven Avenue South, and um it is adjacent in the rear to a open space within that subdivision.

3:16

The subdivision was um established in 1993.

3:25

Here's a little bit of a closer view of the home.

3:29

Um there is a significant um tree stand to the rear of the of the or within the rear yard, and um the applicant has also indicated that there is a two-foot uh fall along the uh front where the um driveway is here.

3:52

Is a snapshot of the plat, so it's locked 1635 within Grandshire section three, and um part of the plat, the required front yard setback is 30 feet.

4:03

The required rear yard setback is also 30 feet.

4:06

Um however, the code does allow for recreational structures to be within 15 feet of the rear yard.

4:13

Each side yard has to be uh 10 feet.

4:23

Um the applicant provided these graphics um to show what is proposed.

4:28

It is a recreational structure, basically a basketball court in the rear yard and in the side yard.

4:36

Um the basketball court would come with the concrete pad, a hoop and lighting, and uh the request I am willing correct.

4:46

There's no request in the application for lighting.

4:49

Um you cannot talk right now, I'm sorry.

4:52

Sorry.

4:52

Um to reduce the required rear yard setback from 15 feet from recreational structures to six feet and to reduce the required side yard setback from 10 feet to three feet.

5:12

Another couple of graphics.

5:15

The lighting came from this particular graphic, so that's what the staff assumed was proposed as part of this of this variance request.

Powell Board of Zoning Appeals Meeting – December 4, 2025

The Powell Board of Zoning Appeals (BZA) held a regular meeting on Thursday, December 4, 2025, at 6:00 PM in Council Chambers. The board considered one variance request for a recreational structure (basketball court) at 292 Tree Haven Avenue. After discussion and a vote, the variance was denied. The meeting also included approval of prior minutes and scheduling of the next meeting.

Consent Calendar

  • Approval of Minutes (May 1, 2025): The minutes were approved as amended, reflecting that the chair opened and closed the hearing of visitors with no comments. The motion carried unanimously.

Public Comments & Testimony

  • No members of the public spoke during the hearing of visitors for items not on the agenda.

Discussion Items

  • Variance Case 2025-35V – 292 Tree Haven Avenue:
    • Request: Applicant Eric Ebbers requested a variance to Code Section 1147.14 to allow a recreational structure (concrete basketball court with hoop) to encroach into the required rear yard setback from 15 feet (allowable for recreational structures) to 6 feet, and into the required side yard setback from 10 feet to 3 feet. The property is in the Grandshire subdivision, zoned PR (Planned Residence District). The lot has no adjacent rear neighbor; it backs to an open space (Grand Shire reserve) with a sidewalk.
    • Staff Report (Revised): Staff recommended denial, citing that the variance is substantial (more than half the allowable encroachment), potential noise impacts, and the existence of alternative locations on the property closer to the house (though requiring tree removal). Staff also noted that the HOA requires a 10-foot setback, but that is not a city enforcement matter.
    • Applicant’s Testimony (Eric Ebbers): He clarified that the proposal does not include lighting (a graphic in the initial application was a rendering from a different product). He argued that placing the court near the rear minimizes noise impact on neighbors compared to alternative spots closer to adjacent homes. He noted the property has a two-foot grade change in the front and a large tree stand in the rear, limiting options. The diagonal orientation preserves existing trees. He also stated that the HOA has indicated they will abide by the city’s decision.
    • Board Discussion:
      • Members debated the seven variance standards. Some found the variance substantial but noted the unique lot configuration (no rear neighbor) and the applicant’s effort to minimize neighbor impact.
      • Others expressed concern about the degree of encroachment (from 15 feet to 6 feet rear, 10 feet to 3 feet side) and the precedent it might set.
      • The board acknowledged that the HOA’s separate 10-foot setback requirement would still apply even if the city variance were granted.
    • Vote: A motion to approve the variance was made and seconded. The vote was 2 in favor (Jim Hrivnik and Jonathan Freeman) and 2 opposed (Randy Duncan and Ryan Breckner). Because the board has five members and a majority (three votes) is required for approval, the motion failed. The chair (who recused himself) did not vote.

Key Outcomes

  • Variance Denied: The request to allow a recreational structure at 292 Tree Haven Avenue with reduced setbacks (6 feet rear, 3 feet side) was not approved (motion failed 2-2). The applicant may revise and resubmit.
  • Next Meeting: The BZA scheduled its next meeting for January 8, 2026, to consider a sign variance. The board also noted ongoing work on a zoning code update (targeting late spring adoption) and will share updates at public meetings.
  • Other Business: The board directed code enforcement to follow up on a previously approved sign variance on East Powell Road to verify conditions (occupancy threshold or time limit) were met.
