The Special Committee on Environment and Resiliency (Ordinances and Law) met on September 30, 2026, at 5:41 PM with four members present (Chair, Vice Chair Sanchez, Councilor Royus, Councilor Davidson) and one absent (Councilman Espinall), establishing a quorum. The committee discussed and voted on two ordinance amendments: one strengthening flood hazard mitigation requirements for building permits, and another aligning city parking restrictions near intersections with state law.
The special committee on environment resiliency order and German and law. This is our regular meeting on September 30th and is 541. Can we use call chair and blog? I hear Vice Chair Sanchez. Councilman Espinall is absent. Councillor Royus. Present. Councilor Davidson. President. We have the four present and one absent. We have a quorum. Awesome. Can we please item number one into the record? An ordinance amending chapter five, building and structural acquaintances, amending section five through 121 entitled Administrative Provisions. Awesome. So it's a task. We have the um sponsor here with us, Council Davidson. You can share anything evaluated. Yeah. I think that the main impetus for this ordinance is to strengthen the regulations that we already have to ensure that as we're dealing with rising water tables and increased flooding risk combined with our current challenging infrastructure that developers do everything that they can or we require anything they can to keep you from home safe. I mean, that's sort of the bottom line. That's why we are asking for this change. And it's not an introduction of the idea, but it's a strengthening of a permit idea. Yeah. I think I'm happy to answer any questions, but we certainly can hope that is floor and more. But that was the this was inspired by the recommendation of constituents that I have whose homes were flooded with sewage. Um and when I sat down with them to learn more about their story, they said please make sure that doesn't have an idea. And so that's really sort of the basis for a lot of records. Anyone have a question? When we are ready, I do want to mention uh further amendments that we'd like to propose tonight. And if we are going to pass this past the 30 amendment that I'm going to mention. Um, thank you, um, Aaron, for considering this piece. So when we talk in the ordinance about um proposed construction of development within a special flood hazard area requiring a permit, we need to make sure that we are complying with state zoning laws and um state particularly right island state building code, state planning code, near Hanson Bay regulations as well as so we're adding that piece to make sure that we are also acknowledging that state law could prevail and at least needs to be adhered to meetings. So that we have that language in front of us. I'm happy to let people want to be able to be developed. Yeah, like what we'd like to change the language debate now. Um so the amendment that I'm gonna read the sentence and then I'll say when the amendment starts. So all proposed construction or other development within a special flood hazard area shall require a permit. And now the amendment starts as a condition of such permit, the building official in consultation with the department of public works and the department of planning and development shall evaluate proposed work and site conditions to determine whether measures are necessary to prevent or mitigate sewer backup, groundwater intrusion, or other related flood damage, where such measures are determined necessary, appropriate protective measures, which may include backwater valves, some pumps, sewer ejector systems, or other approved measures shall be incorporated into the proposed work in accordance with the Rhode Island State Building Road, Rhode Island Flooding Road, Nair Gasset Bank emission regulations and other applicable law. And that is what this one is perhaps who has any questions or comments. Then if there's no questions or comments, do I have a motion to approve as amended?
