It's located just north of 118 South in the Midas Crossing uh subdivision on the northern edge of the center of the city, and the house is a rambler with a basement and an attached three-car garage.

The applicant desires to um to have a home office, and uh this is a very simple home occupation.

Were it not for just one thing is he would like to store two work vehicles behind his screened gate, and that kind of kicks it up to the planning commission, so you guys get to take a look at this.

He was pulling a RV out of the driveway and had to move the vehicles, but behind that gate is normally where they where they sit.

Um the office is in the left of the house, right below the kitchen, and you can see it's less than 25% of the main floor.

So we wanted to uh give him the opportunity to to be approved for a conditional use permit now so that as he renews his business license in the future uh he'll already be in compliance with city code and won't be won't be flagged in the future this is the mailer that was sent out we got one comment from a neighbor that was in support of his business and then I took three phone calls from HOA members this Midas Crossing does have an active HOA and they uh called me with concerns and wanting to know more about the application and their concerns were increased traffic and keeping the neighborhood nice with a residential appearance and so when I talked to them about no customers no employees coming to the home and trucks parked behind the screened gate they said they may attend the meeting but the uh first two people that I spoke with said they would not oppose this the third person I spoke with was um willing to see what the city did the um what I told them is that the HOA has final say but the city can give the approval for a conditional use permit and if the HOA feels that it's not in their guidelines they can tell him he can't do it but um the with the conditions of just having a home office and vehicles parked um they the first couple people I thought I spoke with thought that would be okay and so um you guys do what you do and then the HOA will do what they do and see if it can work out somehow so that's uh my presentation Mr.

Austin is here tonight if you've got any other questions I'm happy to take them thank you Lisa do we have any questions for staff this time Commissioner Close this is probably not going to be particularly relevant but just a question as far as you know if if you had someone living in a home who is employed with the company and would take a work truck home there's no rules about where that would need to be parked correct is is that if it has um advertising on it then the code says it needs to be screened just an employee.

Oh a resident employee yeah like we have a neighbor and he brings a work truck home and it's got the company logo on the side and it's just in his driveway and that's fine correct so is it is it fair for the city to place a requirement on a home occupation to require that their vehicles be screened when you know if they were just employees they wouldn't have to it sounds like it won't be a problem here it just so one of the vehicles um has it's there are one ton trucks and one of the vehicles has um a little trailer on not a trailer a flatbed okay on it so it's it's kind of in that area where it's not like a commuter car it's not heavy equipment so we just wanted to bring it to you guys and let you make a decision about it.
