Riverton Planning Commission Meeting - December 11, 2025
Riverton Planning Commission Meeting - December 11, 2025
The Riverton City Planning Commission met on December 11, 2025, at 1:15 PM (local time) to consider several land use applications, including conditional use permits for short-term rentals and home occupations, a special development overlay for a private school, and a development agreement for a multi-family project. The meeting included public hearings, staff reports, and commission votes. Commissioner Rush was honored for his eight years of service.
Public Comments & Testimony
- Short-Term Rental (Reader): No public comments were made during the hearing, though earlier correspondence from neighbors expressed opposition, citing concerns about police activity, parking, and neighbor disputes. The applicant addressed these concerns, stating he plans to rent rooms in his primary residence and will comply with all conditions.
- Hypnotherapy (Blanchard): No public comments were made.
- Catering (Burr): No public comments were made.
- Wood Crafts (Anderson): No public comments were made.
- Utah Collective SD Rezone: Multiple neighbors spoke in opposition, expressing concerns about rodent attraction, animal waste, power line proximity, and the potential for future expansion to larger animals. One resident detailed past issues with a puppy farm. Some speakers supported the educational value of animals. The applicant argued the structures are low-profile and movable, and that pest control measures are in place.
- Timberline Development Agreement: Numerous residents spoke in opposition, citing safety concerns on Redwood Road, traffic congestion, loss of rural character, and the density being inappropriate for the surrounding R-22 estate lots. Some suggested quarter-acre lots as a compromise. The developer stated the project is less intensive than the current commercial zoning and that they are open to feedback on road connections.
Discussion Items
-
Reader Short-Term Rental (PLZ25-2042): Staff reported the applicant, Eugene Reader, applied for a conditional use permit to rent rooms at 4851 Murdock Peak Circle. The property is his primary residence. Conditions include a maximum of 150 nights per year, no more than one rental contract at a time, and a local agent available within one hour. Background checks showed no criminal record. The applicant confirmed his agent was present. Commissioners discussed neighbor complaints but noted the application meets code requirements.
-
Healing Parts Hypnotherapy (PLZ25-2046): Jill Blanchard seeks a home occupation permit to provide hypnotherapy from 12025 South Dove's Landing Drive. She is a certified hypnotherapist with 350 hours of training. She will have a maximum of three clients per day, with evening appointments until 9 PM. Staff recommended approval with conditions including no business activity after 9 PM. The applicant explained her scope of practice and screening process.
-
Vivian's Kitchen Catering (PLZ25-2048): Vivian Burr applied for a home occupation permit to provide catering services from 11752 South 1300 West. She specializes in Filipino and Asian food, serves events, and has a food handler's permit. No neighbor comments were received. Staff recommended approval with standard conditions.
-
Melbourne Lily Designs (PLZ25-2050): Tina Anderson applied for a home occupation permit to do design, cutting, and engraving in her garage at 3886 West 12380 South. She uses a CO2 laser (no sawdust). No neighbor comments were received. Staff recommended approval with conditions.
-
Utah Collective SD Rezone (PLZ25-4008): The applicant, Ben Mylar, requested a special development overlay for 2673 West 118 South to allow animal enclosures and a greenhouse for a private school. The property is zoned R-22 residential. The overlay would permit reduced setbacks (10 feet from 2700 West instead of 20) and non-standard building materials (cedar, metal, polycarbonate). Staff explained that the underlying R-22 zone allows animals, so the issue is architectural standards. Commissioners debated whether to approve the overlay, with some arguing it's appropriate for an agricultural community and others concerned about rodents and mismatched density. The motion to approve items 1–4 (allowing all requested exceptions) passed 4-3 (Commissioners Keel, Rush, Beck, Madison opposed; Chair Park, Clough, Cannon in favor). The recommendation goes to City Council.
-
Timberline Development Agreement (PLZ25-4009): Jared Payne (Filtstone Homes) presented a development agreement to rezone 1.28 acres at 13518 and 13506 South Redwood Road from CN (commercial neighborhood) and R-22 to RM-8 (multi-family, 8 units/acre) to build 28 detached single-family homes. The general plan would also be amended. The site is currently zoned commercial (CN) from a previous veterinary clinic application. The developer noted that the commercial zoning would generate 3,400 daily trips, while the proposed residential would generate only 300. Road connections to the north and south were debated. The commission voted unanimously to table the item to allow the city council to provide input on road connections and other external issues before a recommendation is made.
Key Outcomes
- Reader Short-Term Rental: Approved unanimously (motion by Commissioner Rush, second by Commissioner Clough) with conditions 1–7.
- Healing Parts Hypnotherapy: Approved unanimously (motion by Commissioner Clough, second by Commissioner Beck) with conditions 1–5.
- Vivian's Kitchen Catering: Approved unanimously (motion by Commissioner Mathison, second by Commissioner Keel) with conditions 1–6.
- Melbourne Lily Designs: Approved unanimously (motion by Chair Park, second by Commissioner Clough) with conditions 1–6.
- Utah Collective SD Rezone: Approved (4-3) as a recommendation to City Council, allowing all four requested exceptions (items 1–4). Commissioners Keel, Rush, Beck, and Madison voted nay; Chair Park, Clough, and Cannon voted aye.
- Timberline Development Agreement: Tabled unanimously (motion by Commissioner Cannon, second by Commissioner Beck) to await city council guidance on road connections, with the matter to return to the commission for further action.

Does that count? With the three, so they have to all relate to the use of the short-term rental. That's right. But um so if there's like an instance on property or something like that, where there's no tennis that are even there, if these calls are any problems that we would face it, that wouldn't count for it's the circular relationship there. There are no criminal convictions of record, there's no civil orders of record that are pending or applicable against them at this time. So any concerns about that that were raised by the neighbors or just on base. There was one thing several years ago, but it's no longer eligible. It was never a criminal conviction. Under City Code, excuse me, we have provisions, for example, in our business license that applied to other types of uses such as alcohol license sales, residential door-door solicitors, and um tobacco-oriented product sales where an applicant has to demonstrate that they have had no convictions within the last 10 years without the crime model term. That's not present in our code right now, but we'll be looking at whether or not that should be there. Uh I would also say, however, that um it would have to if that were the case, we might look at take a look at the improved that by code in the future, but it's just a non-issue here. There's just nothing to be concerned about with respect to script background. So I think that before we see another application over we'll look at basically putting in some additional requirements for VR BL applicant in terms of the background checking, but there's just no scores that you should not. So before there was a question, but somebody's being available at all times not verifiable. As that is that just a name on paper, or is it a verified individual that exists? Uh Tim isn't here tonight, but before he left and we spoke with him, I think he said that he had spoken with the agent and they had a short time. I guess they could within the same thing that they were on the call. I would respond immediately. We'll be looking at that more in the future. This is going to be a case. Thank you. Thank you. All right, seeing none. Uh we will invite the applicant to come forward and uh tell us what you'd like to know about your uh proposal here this year. Hello everyone. Gene Reader. Thank you. Yeah, I wanted to also let everybody know that uh my what do you call that word? Um my agent is also here at 19, she's present, so that was the one that's all that I had the last time I was here. And I just wanted uh really what I wanted to bring up, I didn't realize there was going to be so much um I wasn't expecting I didn't see any of the notes before coming here. I as I was watching on my computer before the last pop uh meeting I came to um and I had no idea that you know the guy across the street, the former, I guess he's the bishop or the former bishop, but anyway, he lives across the street from me. He made some sorry, he made a remark about my ID or whatever, and then there was the uh person that lives basically kitty corner from me, the end of the street. I guess it would be four eight four two. And her comment that I remember was uh the police activity, which she brought that up, which um and then she also I remember specifically hearing her saying that she is being forced to park on the corner out on the road. And I really want her comment on that one because there's no way I think it was forcing anybody to park anywhere around her house. In fact, if she has to park in the front, she wanted to park in front of her house, all she's got to do is either move the basketball booth or park nine or something like that.
