Sacramento Community Police Review Commission Meeting - May 10, 2021
The Sacramento Community Police Review Commission met via teleconference on Monday, May 10, 2021, from 6:00 p.m. to 6:51 p.m. Chair Mario Guerrero presided with nine commissioners present; Commissioner Erandi Zamora was absent. The commission approved its April 12 meeting minutes, discussed the City Council's recent amendment to the Use of Force Policy, and voted to resend its original "last resort" recommendation to the City Council.

- Motion by Commissioner Basim Elkarra, seconded by Commissioner Richard Falcon, to approve the April 12, 2021 meeting minutes (File ID 2021-00490). Passed unanimously with nine yes votes; Commissioner Zamora absent.
Public Comments & Testimony
During discussion of Item 2 (Use of Force Policy), eight callers offered comments:
- LaMills Garrett, representing the Greater Sacramento NAACP, urged adoption of AB 392 verbatim and the additional "last resort" language, stating it would be tragic for another Sacramento resident to be shot by law enforcement.
- An unidentified caller said the commission should reject the City Council's changes and ensure officers exhaust all tactics before deadly force is used, arguing no one should be comfortable with police deciding who deserves to live or die.
- The Sanso Aboykin, a Sacramento resident, thanked the commission for its bold recommendations but said police should not have the power to decide who lives and who dies.
- Another caller said AB 392 is the bare minimum and stressed the need for last resort language, referencing a friend shot with a rubber bullet during protests.
- Marshall Arno, ACLU of Northern California criminal justice advocate, supported the commission's last resort standard and verbatim compliance with AB 392 (Stephon Clark's Law).
- Flojan Cofer, a Sacramento resident, encouraged thorough review of the council's changes to ensure all tactics are exhausted and to preserve the right to life.
- Ryan McClinton, program manager with Public Health Advocates, urged rejection of the mayor's amendments and strengthening the language to exhaust all efforts before force.
- Norman Nelson, League of Women Voters of Sacramento County Criminal Justice Committee chair, supported the last resort standard and asked that the city adopt AB 392 verbatim in a council resolution.
Discussion Items
- Chair Guerrero reported that the City Council met May 4 and adopted "last resort" language, but not the commission's exact language. The Mayor subsequently asked the commission to resend its original recommendation.
- Deputy Chief Lester said SPD will implement AB 392 verbatim; GO 532.11 was replaced by GO 110.01 for crowd and riot control; and mental health data requested by Commissioner Falcon is being compiled.
- Motion by Commissioner Michael Marion, seconded by Vice Chair Renee Carter, to resend the commission's original use of force/last resort language to the City Council for consideration and adoption. - Mental Health Alternative Response ad hoc (Commissioner Falcon) scheduled a meeting with Bridget Dean and the Department of Alternative Response on May 19, 2021.

When the item is being heard at the meeting, you will be placed into the meeting to make comments. You will have two minutes per item to address the legislative body and may speak on up to four items. So we are going to uh first go to the chair's comments. I'll be as brief as I can. Um wanted to share with uh commissioners and the public that the city council met on May 4th. I was uh once again uh present at the city council to discuss the last resort policy recommendation from the commission. The city adopted the last resort language, uh but not the commission language. We will talk further about this language after the consent calendar as we have been asked to provide feedback before the city and SPD implements this new language. We will have a uh pretty important update to share at that point. Uh at that meeting also there were there was a commitment to take up other um about a dozen or so recommendations that I presented on behalf of the commission. So that's the update there. The second one is that uh there it there is uh crowd control riot control questions that I was gathering. Um I have been collecting those questions and um I will be sending them to uh Dawood or staff.
