The agenda for tonight is follows.

0:50

We have only one item of old business that's young land holdings LLC site plan.

0:56

That's a public hearing for a 7200 square foot warehouse and office building with a conditional use permit for a reduced wetland and prime wetland buffer at 92 Lowell Road.

1:21

The abutters are as follows.

1:22

If you're here, please indicate by saying so.

1:41

Thank you.

1:48

Okay.

1:48

So you accepted this plan on March 25th of 2025.

1:52

Since that time, the applicant has uh received third party engineering approval.

1:57

They eliminated the second curb cut.

1:59

You'll recall at the last meeting, there were two curb cuts proposed, and they've uh since reduced that to one.

2:05

Uh they did go back to the the zoning board of adjustment and received a revised variance for the total gross floor area.

2:13

The initial variants did not include the uh mezzanine, so they've included the mezzanine, so it's 7,200 square feet.

2:21

They replaced uh the red maples on the uh on the uh western portion of the site with uh evergreens, eastern red cedars, and that was to provide screening for the residential abutter for the planning board's recommendation.

2:37

They updated the lot coverage calculation.

2:40

Uh they've added landscaping at the front of the site, and they provided lighting details and submitted a truck turn plan for a low bed truck.

2:48

Uh just to give a kind of a recap of the proposal here.

2:51

So uh this plan has since been updated, but this is from the slides back in March.

2:56

The request for the conditional use permit is still the same.

2:59

So you can see in green, this is the edge of the existing tree line, and then this is the area of the uh prime wetland buffer.

3:07

So this area within here was uh was disturbed, and they are seeking after the fact approval a conditional use permit for that that just um that just disturbance that was done.

3:19

This was again in May of 2022.

3:22

This was the site in 2024, a little hard to tell because it was taken in the uh winter, I believe, or no uh March rather early spring, but this was the area that's been disturbed.

3:31

You can also see that on street view here, and then uh this was the site in March of this year.

3:38

Uh they are proposing to put the building within that area of uh of disturbance.

3:43

So again, the tree line here, uh prime wetland buffer here, and then the building is in this location here.

3:50

There's a lot of discussion at the previous meeting about the request for the conditional use permit.

3:56

The board previously advocated for the applicant to explore alternatives, potentially relocate the building further from the wetlands.

4:02

Um minutes from that meeting in March were included in your packet.

4:07

So in terms of the rationale for why the building needs to be located to the rear of the site, the applicant did provide this truck turn plan that shows uh a low bed uh trailer or low bed truck, uh circumnavigating the site.

4:23

And uh you'll note here as I noted in your review form, and then also on the slide that our site plan regulations uh state that a purpose of the site plan regulations are to provide for adequate provisions of traffic circulation, and then also internal site circulation shall be designed to accommodate the appropriate design vehicle for the project.

4:45

When the applicant submitted this, the concern was that you know this this truck turn plan conflicts with the majority of their parking spaces.

4:54

I think they've got 14 spaces, and it conflicts probably with uh you know at least 10 of them.

5:00

I would imagine, you know, when you when you follow the uh the path.

5:03

So in response to the concern that was raised by staff, the applicant did submit a uh a three-point turn plan for the same low bed truck, and uh that's shown here, so it shows the truck coming in, and then doing uh you know a three-point turn without conflicting uh with the spaces or the building.

5:26

The board asked uh again for the you know the exercise to be whether or not the building could be located to the front of the site.

5:33

So when the applicant submitted this, I said, you know, is this the only way that this site can work and it only worked if the building is located in an area, or could you put it further to the south, further towards the front of the site, and could you still navigate the site with the low bed trailer?

5:52

Uh the applicant did move the they showed uh an exercise where they moved the building 10 feet uh forward, and there are conflicts with the building in that instance, and then also the parking spaces.

6:04

One thing that you know we didn't we don't have documentation of, and I think the applicant will speak to more is the exercise that if the building was located in the front and the parking was to be located to the rear, could it then function?

Summary of Proceedings

Planning Board Meeting on August 12, 2025

Chairman Joe Fiole called the August 12, 2025, meeting of the Salem Planning Board to order. The board addressed one item of old business—a site plan for a 7,200-square-foot warehouse and office building with a conditional use permit for a reduced prime wetland buffer at 92 Lowell Road—along with several public matters and proposed zoning amendments. The meeting included a public hearing, staff presentations, board deliberation, and a vote to continue the application.

Consent Calendar

  • No consent calendar items were noted.

Public Comments & Testimony

  • No members of the public spoke during the public hearing on the Young Land Holdings site plan.

Discussion Items

  • Young Land Holdings LLC Site Plan (Old Business): The applicant, represented by Kurt Meiser (MySub Corp) and engineer Ian Ainsley (ISO Brem), seeks approval for a 7,200-square-foot warehouse and office building with a conditional use permit for a reduced prime wetland buffer. The site at 92 Lowell Road has a history of disturbance: in May 2022, approximately 11,000 square feet of prime wetland buffer was cleared without approval. The applicant reported that the clearing was a contractor error, mistaking the 100-foot buffer for a 40-foot wetland setback. The building is proposed to be located in the disturbed area. The board previously asked the applicant to explore alternative building locations. The applicant submitted a truck-turning plan for a low-bed truck, showing a 180-degree turn that conflicts with most of the 14 parking spaces, and a three-point turn that avoids parking. The board discussed whether the building could be moved forward 10 feet or to the front of the site, but the applicant demonstrated that such moves would conflict with the required turning radius. The town engineer (August 7, 2025 letter) recommended no improvements in the prime wetland buffer and removal of the gravel parking area, and noted the site layout is inadequate for the design vehicle. The Conservation Commission recommended approval of the conditional use permit (November 2024) with conditions, including red maple screening (later revised to eastern red cedars). The board also noted that unregistered vehicles and commercial vehicles had returned to the site after being removed in March 2025. The applicant argued that the Conservation Commission's approval and the Zoning Board of Adjustment's variance for commercial use support the plan. Board members expressed concerns about the feasibility of the layout, potential parking overflow onto Lowell Road, and the permanent loss of wetland buffer. A motion to approve the plan with 15 conditions (including a berm, enhanced screening, and no unloading on Lowell Road) was made by Sean Lewis and seconded, but failed on a tie vote (4-4? The transcript indicates a tie, and the motion failed). The board then voted to continue the application for an additional 65 days, allowing the applicant to obtain a review from the town's traffic engineer (Steve Purnow) and explore enhanced mitigation. The continuance was approved.

  • Public Matters: Two items were presented:

    • 45 South Broadway (Citizens Bank): A temporary trailer in the parking lot during interior renovations (approx. 2 months). No concerns raised.
    • 26 Ermer Road: A request to install a 24x18-foot pad for a cooler for meat storage (non-retail, distribution only). The site is zoned limited commercial; the board found it acceptable under site plan exemption thresholds.
  • Zoning Amendments Discussion: Planning Director Jacob LaForte outlined proposed amendments to be noticed for the August 26, 2025, meeting. Key changes include:

    • Accessory Dwelling Units (ADUs): Updated definitions to comply with HB 577, allowing detached ADUs by right, prohibiting short-term rentals.
    • Parking: Reduced residential parking requirement to one space per unit per state law.
    • Proximity Prohibitions: New restrictions on cigar bars and kennels based on distance from residential districts. The board requested adding a definition of "nightclub" to distinguish from cigar bars.
    • Conservation Commission Bylaws: Added requirement for performance escrow and three-year monitoring for wetland mitigations. The board discussed potential complications with state mandates allowing residential uses in commercial districts.

Key Outcomes

  • Young Land Holdings Site Plan: The motion to approve with conditions failed (tie vote, motion not carried). The board voted to continue the application for an additional 65 days, with the applicant to obtain a traffic engineer review of the turning plan and potentially enhance mitigation. The continuance was approved.
  • Public Matters: Both items (Citizens Bank trailer and 26 Ermer Road cooler) were accepted with no opposition.
  • Zoning Amendments: The board agreed to move forward with the proposed amendments, with a revised definition of "nightclub" to be added. The amendments will be noticed for the August 26, 2025, meeting.
  • Other: The board promoted the new town website chatbot and noted that a depot master plan update will be presented on September 9, 2025.
  • Adjournment: The meeting was adjourned.
