Your responsibility as a public uh property owner or a lienholder of a dilapidated structure case is to demonstrate the following.
Number one, provide the required documents, discuss your detailed scope of work with a cost for each item outlined in order to bring the property into compliance to the satisfaction of a code officer.
Number two, submit the required proof of financial ability to pay for the proposed work and discuss the feasibility of repairs dependent upon the monies at hand.
And number three, request the amount of time needed to complete the work.
All abatements ordered by the board shall be enforced.
All work proposed must be done within code regulations and required permits prior to commencement of work.
You may obtain all permits from the Department of Development Services located in this building at 1901 South Alamo Street, San Antonio, Texas, 78204.
If in doubt to the process during this time, please contact the code enforcement officer.
Any owner or lienholder dissatisfied with the order of this board may file an appeal in civil district court within 30 days after the date that the order is mailed.

In City Council District 5, the property address 652 Thompson Place.
Emergency demolition was ordered for the main structure due to a sudden act.
The structure was removed on June 9th of 2026.
Also in District 5 at 1120 slash 1122 Bettis Street, the main structure was ordered a demolition.
I'm sorry, it was a emergency demolition due to a sudden act and was removed on June 17th of 2026.
In City Council District 5, a main structure located at 10162 Wood Trail was declared an emergency demolition due to a sudden act and was removed on June 17th of 2026.

We'll move into the individual case presentations, and our first case is going to be.
That's 4426 Eisenhower Road.
Good morning, board.
Good morning.
For the record, my name is Cynthia Santana, Dangerous Premise Officer for the City of San Antonio Development Services Department.
The structure being presented today is located at 4426 Eisenhower Road with a recommendation for demolition in accordance with City Code Article 8, Chapter 6.
This case is the first time being heard before this board.
The legal description is NCB 12375, block 5, lot 10, located in City Council District 2.
The owner on record is Caballeros Salvador Remos Ramos with a mailing address of 4426 Eisenhower Road, San Antonio, Texas, 78218.
All notices of hearing were properly issued as required.
The following individuals are present on behalf of the case.
Mr.
Caballero Salvador is here, he's the owner, and SAPD officer Carlos Gutierrez.
A phone number was not found for the owner, but I have spoken with him.
The following is a timeline of events regarding the notification process.
The first inspection regarding 4426 Eisenhower Road was conducted on March 13th, 2026.
Original notice was mailed on March 17th, 2026, and the certified receipt was claimed on March 19th, 2026.
The conference meeting was held for 4426 Eisenhower Road on April 16th, 2026.
Neither the owner nor any representative appeared at the meeting.
A notice to vacate was posted at 4426 Eisenhower Road on April 22nd, 2026.
On June 18th, 2026, the notice for the BSB hearing was posted at 4426 Eisenhower Road.
And on June 17, 2026, the notice for the BSB hearing was mailed to the owner, and the certified receipt has not been returned.
No scope of work or financial proof or letter of credit or engineers' report has been provided.
As of July 1st, 2026, there are no permits on file for 4426 Eisenhower Road, and no fire damage assessment has been requested.
An administrative warrant was obtained and executed on June 1st, 2026 for the photos being presented today.
The first photo is of the front elevation as it faces the street, showing a string single story structure in a residential zone with no water service since November of 2025 and no electrical service since March of 2026.
The structure was built in 1957 and is 3100 square feet.
It has a slab on grade foundation, brick veneer, and wood siding with a shingle covered gable and flat roof combination.
The structure suffered a fire on March 12th, 2026.
This structure is less than a thousand feet from St.
Thomas Moore School, which is on the street directly behind this house.
The brick veneer on the front elevation under the carport is cracked.
The window glazing on the left side is broken and secured with plywood.
The window in the center is now broken at my last visit to post-hearing notices.
This is a close-up of the front windows on the left.
The second pane from the left is now broken as well.
This is the overhang on the left elevation at the rear.
The decking fascia and soffit are charred from the fire.
The decking on the overhang of the rear elevation is collapsed.
This is the left side of the rear elevation.
The wall at the top under the peak is collapsed.
The shingles are damaged and hanging where the decking was burned away.
The electrical wires coming into the electrical panel are damaged from the fire.
The windows are broken and boarded up.
Here you can see the fire damage to the roof decking and the electrical connections.
On the far left corner, you can see the support pillar listing out to the left and separated from the patio cover.
The cover is bowed in the center.
The rear windows under the patio cover are broken and boarded.
The rear door was secured by the city as well.
This is the left corner of the rear elevation where you can see the condition of the patio roof cover a little better, showing the amount of bowing.
This photo is a close-up of that support pillar that is falling away from the structure.
The only thing supporting it currently is that metal bar at the top that's going from the framing of the patio roof cover into the stone.
There's another angle of this corner from inside the patio.
You can see the dilapidated condition of the pillar.
This angle is from underneath the covered patio of the bowed roof cover.
This is the right elevation from the rear of the structure.
The window is broken and secured by plywood.
The siding lacks weather protection by the corner at the bottom.
This is the right elevation from the front of the structure.
The siding again lacks weather protection.
The window frame, you can see there is broken loose from the exterior wall.
The brick veneer is cracked in the center and pulling away from the frame at the top right half of that section.
As you walk in the front entrance, this is the first room that you encounter.
The ceiling drywall and insulation are missing.
The floor contains rubbish and debris.
The wall between the rooms is fire damaged.
The ceiling is missing, and the walls are smoke damaged.
This is the room to the left of that kitchen area.
The ceiling is damaged by that far window.
These windows at the bottom half are all broken and secured by the city.
There's no ceiling, and debris is scattered about the room.
The walls are smoke damaged and missing drywall to the right of the photo.
The air conditioner ductwork is damaged from the fire.
The window glazing is missing, and the windows are secured with plywood.
This is the fireplace in that room.
It was being used by people staying in the structure to cook, despite having no electricity or water services.
Each time we came to secure the structure, a fire was going in the fireplace.
We had to call the fire department to extinguish it before we could secure the structure back again.
If you turn around and look away from the fireplace, towards the rear elevation, on the left side of the structure, natural light is present there at the back.
At the end of the hallway, drywall is missing from the ceiling and the walls.
The top section of the wall studs are charred.
The subfloor is exposed with no floor covering in this section.
This is a bedroom that has no wall or ceiling cover.
The smoke, it's smoke damaged, and the electrical fixtures are fire damaged.
Wall studs to the left and right of the photo are charred.
Natural light is visible from the exterior wall and window.
This bedroom was being used by vagrants.
When I first came in after the fire, this entire room was full of bicycles.
Looking directly up from that location, you can see the ceiling joists and rafters are steel beams.
Roof decking is charred.
Looking towards the floor in that room, there's a large amount of debris and rubbish causing egress violations.
The wall covering is missing, exposing the wall studs, which are also charred at the top.
Windows are damaged and covered with plywood.
On the right side of the structure, there's two additional bedrooms.
These were being used as sleeping rooms by vagrants with the exposed subfloor and broken windows.
This photo is of the second bedroom on this side.
Again, the same issues.
The history of this structure is defined by neglect beginning four months prior to March 12, 2026 fire when active water service was disconnected despite continued occupancy.
Immediately following the fire, the first inspection revealed individuals were still living inside the debris-ridden structure, using the fireplace for cooking without access to electricity or running water.
Mr.
Caballero stated to me that he had insurance and contractors that were scheduled to meet with him.
He was explicitly informed that a fire damage assessment was required before any permits could be issued, and that people could not stay in the structure without active utilities under the unsafe conditions of the structure.
Reinspections revealed people continued to stay at the structure with and without the owner at times.
Neighborhood Housing Services Department made location to offer Mr.
Caballero's assistance, of which he did not take advantage.
A notice to vacate was subsequently posted.
However, occupancy persisted during every single reinspection.
The owner has shown a complete failure to maintain the property.
The city has been forced to intervene repeatedly to mitigate the community burden, abating large accumulations of rubbish twice, securing the windows and doors three separate times, reboarding the structure after it was repeatedly broken into by both vagrants and the owner.
Given the proximity to St.
Thomas Moore School directly behind, it leaves the structure open to entrance by vagrants or children.
Compounding these issues and safety violations is the structural compromise of the building.
The back left wall is completely missing at its top peak, and the fire damaged ceiling rafters and joists present hazard to anyone entering the premises.
Because the owner has provided no proof or financial ability or physical ability to repair this structure, it remains a dangerous public nuisance.
The structure is unsound, unventilated, and completely unfit for human habitation.
The structure located at 4426 Eisenhower Road is in violation of City Code Article 8, Chapter 6-156, subsections 1, 2, 7, 8, 11, 12, 15, 17, and 18, in which any building or structure which has any or all of the conditions or defects herein, after described, shall be deemed to be a dangerous building and a hazard to public health, safety, welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation pose a threat or potential threat to life, health, property, or human safety.
Staff recommends demolition with an order to vacate and to remain secure and free of rubbish and debris.
That concludes my presentation for 4426 Eisenhower Road.

I have a couple.
You abated this twice.

So that's separate.

We've had to go in and we went in and cleaned the property of rubbish and and trash and stuff in the back that they were bringing in through the alleyway.
Everything from bicycles to mattresses.
There's human feces in the backyard.
So we cleaned all that up.
And not more than a couple of weeks later, the neighbors began calling again, and we had to go back out there and clean it again.
So do you have a cost on both of those?
Yes.
The one on March 30th was $1,788.
May 5th we went back.
And then March May 12th, we had to go back again.
It was $360.
And again on June 1st, we had to secure it again at $195.
And it still doesn't cover the window.
No, there's windows broken again.
I have to send some that those the last two, the 195 and 360 were for securings.
Okay, because it's it states in your notes that you put a work order in for a window on the left, if I remember right.

I I just discovered it on my last visit, so I was waiting for this is current up to date.

Okay, now the electric was shut off, water was shut off, but there's a note in here that says the water was still running.
It was still running.
They had uh illegally turned the water on, and I had to notify Saws, and they came out and they pulled the plug on it.
The meter?

Okay, because that's yeah, that's the only way you really know it's gonna be shut off.
Um you got a phone call from SAPD on 628?
Correct.
They called me in the evening.
Uh the neighbors had told them, gave given them my phone number, and uh stated that I knew what was supposed to be happening with the property.
They called to tell me that people were back inside the structure, asked me what had happened uh with our notices, and I told him at that time that we had issued a notice to vacate.
So this is well after you put a trespass, I mean um notice to vacate.
Uh yes, sir.
So every time you go to that notice of vacate is missing.
Well, they take it down.
I mean, it's it was there, it was uh the notice to vacate was posted in April, and just continued to be violated, and you get several calls from police officers letting you know that people are on the property other than what you've seen.

Good morning.
My name is Officer Carlos Cutieris.
I work out of the East substation for the safe unit.
I've been in the department 20 years.
I am assigned uh the district 4350, which is the address there at 4426 Eisenhower.
So, as of January 1st through uh June, we have gotten 65 calls to that location.
They range from calls from squatters, deaths where the suspects run into the location, calls for wanted persons where there have been some arrests.
Uh we had got calls also for possible young kids at the location, uh calls for narcotics and obviously calls for for fires.
A lot of these calls are coming from the neighbors around the home there.
Uh they're the ones that are seeing this, and these calls are happening uh at all hours uh of the day.
They come from the morning and from the night at night as well.
Since the fire has happened, I believe we have got a total of see the fire occurred on March 12th, I believe.
Since then, we've gotten 43 calls after the fire, and mainly they're coming in as burglaries in progress, and what they are is some of the homeless that are breaking into the location there and staying.
Uh what makes it dangerous for the officers, and I was involved in one of them, is these calls are coming in uh like I said, all hours of the night or the day, is that the only way we can make entry to the location is from where they're breaking in from, which is usually a little a window.
Uh, and it's always on the section and and I know the pictures are not up right now but it's always on the section where the fire is at which is towards the back area where they can't be seen from Eisenhower.
So we have to go in through that same little area there with the the wood being charred and that's what makes it dangerous.
When these calls come in uh we have to go in we have to see if anyone's in there because it's very dangerous uh so last week alone I believe we had three of them and I was involved in one of them where we had to go in there uh and it's very dangerous for the officers you saw the pictures um like I said these calls are all from neighbors there's two associations neighborhood associations Wilshire and East Terror Hills I get phone calls from those associations and it's always about this location here and it's always about people going in at all hours of the night uh starting fires the neighbors are concerned uh that a fire another fire would start and that now their homes were getting you know uh catch fire as well so that's just a little history uh I've been in that area for about two years and that was one of the first addresses they gave me when I came over uh was from the associations uh when I introduced myself and said I'm the safe officer of this area any questions that was one of the first addresses they gave me and this is this is the problems that that we're having that that's my my presentation any questions of the officer um I I already know the answer to this one this is already right near a school correct but correct it's about four blocks from St.
Thomas More uh I believe it's south of that location and there's also four three or four churches that are east of that location uh probably about five blocks away now for the school is this a high traffic area for kids absolutely this is their number one route that goes straight to the school correct yes there's also Kruger Elementary which is just north of that location as well so that's kind of in between both of the schools there where you'll constantly see school buses going uh east and west on uh on Eisenhower.
Now you took this over from Safe Officer Trevino uh no I took this over from safe officer Michael Cole apple okay because I know say Trevino Trevino is just uh Isa he's just north of Eisenhower.
Okay.
And I was gonna ask you what was his notes because when you do your ride alongside, well so we write we don't write I don't write together with anybody I write by myself however though because he's he's the neighboring district uh we go together to these calls because we're very familiar uh with the with that particular location um if he were here I'm sure he would pretty much tell you the same thing so in conversation with him it's not just this area they're probably going back and forth yeah it's the same people same people uh and and now that you bring that up I did have it on my notes so they're just east of that location I'm sorry just uh yeah east of the location there's two convenience stores there's a QTs and there's a uh I believe a 7-Eleven so a lot of the homeless people hang out in that particular area when the thefts come out they run back to this address right here and that's where the calls all coincide right there all right thank you sir additional questions there are none thank you very much sir thank you salvador calvaros if you would please come forward sir.
Good morning good morning sir if you would please state your name and the council district my name is Salvador Caballero I'm the owner of 4426 Eisenhower and um we uh I bought that house to uh I used to buy houses and and fix them up and sell them but I went through a terrible divorce uh so I stayed there and uh so I was fixing it up my problem was uh trying to fix it up while feeding the homeless there too.
You know, I've been feeding the homeless for 23 years.
Uh, and I started uh downtown and then I worked to uh uh Haven for Hope and the police officers wanted to get me out of the street and and put me to Haven for hope.
So I did that for uh 18 years.
Uh so the and this is how it all started.
It's it's me taking the homeless to my house and feeding them there.
And and that and I do apologize for that, and that is my fault.
Um this house uh we boarded it up.
Uh the last notice that she said that they put at my house, I wasn't even there because they told us we couldn't I couldn't even work on it.
Now, uh the floors on those pictures, I guess that she has a lot of debris in them on all that.
All those floors are cleared.
I I cleaned all those floors.
We uh that house came with some wooden floors, and we were able to save the wooden floors from the front of the door all the way to the living room, all the way up to the hallway.
Now the hallway did burn, and then my master bedroom also the th that floor is gone.
But the middle bedroom, uh, also we saved those floors, and those are wooden floors.
I have nothing on those floors anymore.
Uh I do have metal rafters and metal beams, and uh I only have one hole where the where the fire penetrated through the through the roof, but that is covered up and so forth.
Um now I did go to the hospital and I went on the 18th, uh, and I didn't come out to the to the eighth.
Uh I mean I went on the 25th and I came out on the eighth.
So I didn't get any notice or anything.
I'm here today because my wife passed through, my ex-wife passed through there and saw a notice and she took a picture of it.
So last night she called me and asked me if I was gonna be at a meeting, and I said I I didn't get served or anything.
Somebody went to her house.
And I used to live in Alamo Heights.
Uh my kids went to St.
Peter's uh Central and then to St.
Mary's.
When I have a graduated from St.
Mary's, my son is here, and then I have uh a boy and a girl that went to North Texas.
So um, the only thing I'm asking right now is that I wasn't there when they served they served these papers, so I'm not prepared.
I have been talking to a civil engineer, uh, it's called Texas uh licensed engineer, and they're I told them to call the city because it's boarded up, and they did a lot of boarding, but we also I spent uh eleven hundred dollars buying the wood to board it up the first time when I went into the hospital.
You know, um so uh I'm asking just the board to give me some time if if I can get some time in and I have the dates here that I was in the hospital plus the bill that I still have to um uh I I was in a real bad accident uh so I haven't worked.
I've owned my business.
Uh I do pest control.
I didn't put I mean I've done pest control all my life uh but out of high school I started in the pest control business, worked for ABC Pest Control, opened my own company uh APC, and uh Advanced Pest Control.
So uh I know uh that this house has been a problem uh uh house.
I did rent this house out, and uh it started with me not checking the background and and having bad uh bad people come in there, but they have they've since now they've been arrested, they no longer live there.
Uh I know the officers have been going over there.
Every time they go out there, we're working on the house.
I was working on the house.
I didn't know that I needed permanents to clean my house.
When they came in, uh we had the after the fire, they threw all the sheet rock.
We threw it all to the bag.
We were bagging all that sheet rock together when they came in and took those bags.
Uh so uh I just uh what I'm here today is to ask for an ext uh an extension so I can have a civil engineer come in and and uh I do want to sell the house.
I'm not gonna live there any long.
I'm not gonna be there anymore.
Um I do have a relationship with all my neighbors.
Isaac, the one next door, Mr.
Martinez on the left side.
Sonny uh bought a car from him.
He was uh he he was a seal.
Uh and then uh the one right across me was a mechanic for the service.
We're all friends, you know.
I I used to do the service, I used to do their uh lawn lawn service for all these four people.
Uh also did their families, their their sons or daughters, pest control.
So we were all friends and uh I I know that I I went back and talked to them and I apologize for what they've gone through.
Uh and I told them that uh it's only gonna get better.
Uh I'm not gonna rent that house anymore.
I'm gonna sell it.
But uh I think it's still in good shape.
When it did burn, it only burnt on one half of the house.
The other house house is is fine.
The she-rock is gone because the the fire department came in and knocked all the sheet rock out.
Uh so it was on the floor.
And you can imagine when w I was there when all this was happening.
You know, and uh i i it tore my ho my heart out to see that, but uh I've been working on it ever ever since then.
Uh what I'm asking the board is just to give me some time.
Uh I don't know how much time you can give me to to uh fix it up, but I do want to fix it up and sell it.
It's still a good house.
Um I did talk to civil engineer.
I'm working with uh a company called Licensed uh Texas Licensed Engineers, and they're I told them to call the city because it it is boarded up.
We need their permission to come in uh so uh to get estimates.
Uh and he told me he was gonna go in there, take pictures and start on the roof and then on the walls and so forth on the bearing walls and so forth.
Um but since he went out there, he looked at it, he said uh it looks like it's in good shape still.
Uh I know the picture that they have was when all the trash was there, but it's not in that condition anymore.
Uh I did get a call from Isaac, the neighbor on the right side.
I'm working with him.
Every time he sees somebody, I tell him to call the the police department.
But a lot of times they when all these police department they get there and they make a report, they they make a report because they see somebody out there.
And it was me working out there or me on the roof or um in a lot of them were the fire department would get there and they wouldn't they never turn off the fire, they never turn off a fire in the fireplace.
Never.
And I was there all uh I was there after I got rid of my two tenants that I had there.
I I did have a bad family that half of them did get arrested.
Um I am 66 years old right now.
Um I've never I've never spent a day in jail my life.
You know, I um and uh I don't plan to in my old age to go back to, you know, go go to jail.
So I just want I just want the board to give me some time so I can work on it.
Scalero, let me ask you a couple questions if I may, please.

Uh have you ever lived at this residence?
I I uh rented it out for uh when I got divorced about six years ago, I bought this house and um I decided to stay with it because I was fixing it up.
I I rented it out for about three three years and then I moved in with the last family that was there because they were tearing it up, and I did move into that back room, uh, but I was hardly there because I was always working.
Uh but I did I did leave uh live there for a while, yes sir.
Uh so you rented it for three years.
You lived there how long after that three year period of time?
Off and on two years, two years, yes, sir.
Uh and where were you living besides that?
Uh, the address approximately.
I was living at uh two seventy-five Rock Hill in Alamo Heights.
Uh I belong to Saint Peter's uh the Apostle.
Uh so my kids were going to uh uh Saint Peter's right off of Broadway, right by the fifty fifty club, right the little church that's there.
And what date are approximate date, what year it better be a big question?
What year did you actually start inviting uh homeless into the euro uh well that's it's been uh to my house since almost since I bought it uh six years ago, I was cutting my lawn and one of them came in and and uh took the lawnmower away from me and and did it for me, and I hired him to to do my lawn and then to paint my house.
So at that point about five years ago, six years ago when yes sir.
Did you bring any information to us this morning about financial ability to do the work that needs to be done?
Uh no, no, I don't.
That's why I'm asking for more time.
But uh I've had you know people from the church telling me that they will help me uh also uh the Cortez family.

I'm not saying they they they wouldn't uh uh when I met Cynthia, that was I was already working on after the fire, all the she rock, all those pictures that you see on my backyard, we threw all that outside because we were bagging it and I called the city to come pick it up, and we were already dragging those big bags to the front of the house when they they showed up and they took it.
Uh but I didn't get any notice, no sir.

No, other than in staff of uh DHA uh DSD.

You know, I did call a lot of those people, but they wouldn't help me.

The uh they did surgery on my foot.
I had an infection, so they cut off a couple of toes.

Uh he said he was gonna take pictures, uh, but I don't want to take anybody out there without uh permission of the city.

Um there is another uh there's another man that owns um uh La Quinta and he has uh uh a company a construction company and I've been talking to them also, but uh engineering company I talked to them at uh uh about last week about showing up, you know.

I have posters uh on my the whole house all the way around, not not to trespass.

Uh it automatically allows them to arrest.
I um I'm willing to do that.
I never got uh told that that I could do that, but I I told my uh neighbors if they see somebody on the roof, I also have solar panels up on the roof.
They stole three solar panels.

But uh I talked to the civil the engineer, and he said that he has people that can do that.
Uh I don't want to do that anymore uh since uh I have a bad foot.

So you're saying uh and you asked for to give you some time.

Well, I talked to the in uh engineer this morning, and I told him I was coming to the meeting.
Uh he wanted to go out there today to go look at it.
So I don't know how much time I can get uh to get all the paper, the right paperwork to turn into the city and to turn into uh code compliance.
Um because they told me you have to have the right paperwork showing exactly what's going to be done, uh what day, what time, what's gonna go first, second, third, fourth.
Uh if I can get all those pay that paperwork uh a month, and then uh, but I do want to leave it boarded up and my neighbors are Isaac, the one on the right, he has my permission to check the house and call me or call the city uh police department if somebody's at the property.

They have a ring camera so they can see anyone that comes through the alleyway.
So I mean, we're trying to stay on it, we're trying to make sure it's secure, and I and I think what's most important is that he's not there right now, and they're not gonna come looking for him, and we're gonna make sure that we we keep on calling the cops if we see anybody and of course uh we still need to help secure that that back door.
So uh the neighbor actually agreed to help us do that too.
So it's just gonna come down to just staying on it, and uh, and I agreed to help him and be there for him.

So as far as the uh criminal trespass affidavit, initially it was it was talked to him about it uh when we first started going out there when I first started going out there.
The issue that we were running into with Mr.
Gabiero because he was helping a lot of the homeless, he was allowing them to reside there.
So many times uh the issue, and I know and and uh every time I've run into him or spoke with him, I would bring this issue up.
Uh what's happening is we would go there.
Uh speaking for myself, I would go there, talk to him, and and many times he can stay uh but he can't, or he's okay, but she's not okay.
We'd go back, we'd follow up, and we'd say, I thought you said that this person could not.
Well, they're okay to stay today, but then there can't be tomorrow.
So it was constantly back and forth, and I explained to him that the longer they stay here and they're gonna start to reside here, it's gonna be very difficult for the police to help you criminal uh legally get them off your property.
Because you're telling me that certain people are allowed, and you're upset with them now because of a certain for whatever reason, so now it's not okay for them to stay there.
It's very difficult uh for us as police officers to to get them out of there legally.
So I said at some point uh by you allowing uh people to stay here, they claim residency.
At some point, they may have to be an eviction that you're gonna have to end up doing because you're you're the owner, you're allowing them to stay there.
You're saying that in lieu of rent, uh they're doing yard work, they're doing this for you.
Um so that's where the issue of the trespass uh became pretty difficult.
Uh now that he's not there uh and he's not living there.
Um we can we can definitely help him with that.
That's not a problem.
But prior to all this, this was this was talked about.
And uh he was in a sense warned about if you continue to allow people to come in here and go, we won't be able to arrest them for burglary because they're breaking you're the cost coming in as a burglary, but you're saying it's okay.
Oh, he's okay to stay here, she's a so it's making things very difficult for us to to help him out.
Uh but now that he's not there and he is not living there, uh we can we can certainly help him with the trespass, but at the time we could have done it as well, but that was the issue that we were running into.
And it's because he was trying to help the homeless, but by granting them you know, come on in, they're allowed to enter my home.
So, uh you had indicated in your first testimony that there were 65 calls uh in total.
Uh can you give me approximate uh year or date, month so where those calls started, or at least what period of time those what I did is I did a uh just a quick history starting in January, uh going into June.
Um so if I can go back here real quick here.
So January 2nd of 2026 is when I did the check, and uh that was for a homeless related, and it goes all the way to June 21st, and this is all 2026, uh, for the last call being of suspicious persons.
And again, a lot of these calls are uh very um like I said, from thefts to burglaries, and a few of those are or myself creating calls out there because neighbors are calling me on we have a city phone with our safe unit that we give our card out uh to anyone who asks, uh, and they'll call and say, This is um a concern that I have.
Uh can you check on this location?
I think something's going on.
So we'll create a call for documentation obviously because of our body camera.
Uh and a lot of these are what we call patrol bias, where I'm going out there myself and walking the premises and checking it.
Uh so they vary from suspicious persons to wanted persons to uh homeless camps uh to fights to burglaries in progress, narcotic laws, uh suspicious vehicles uh and suspicious persons.
And those suspicious vehicles and suspicious persons are happening at night uh when people are just pulling up to the driveway, parking in there, staying on uh sleeping in the driveway in their vehicles or going in through the back.
Those are where the suspicious persons and suspicious vehicles come in from.

The structure being presented today is located at 3446 Roosevelt Avenue with the recommendation for demolition.
In accordance with City Code Article 8, Chapter 6.
This case is the first time being heard before the board.
The legal description is NCB 7676 block west 50 feet of north 108.34 feet of south 158.34 feet of 4 ORA7, located in City Council District 3.
The owner on record is Alvarez Michael A with the mailing address of 511 Back Bay Drive, Dixon, Texas, 77539.
All notices of hearing were properly issued as required.

The following is a timeline of events regarding the notification process.
The first inspection regarding 3446 Roosevelt Avenue was conducted on November the 13th, 2023.

On February 11th of 2025, the conference meeting was held with owner over the phone.
On June 17th, 2026, the notice for the BSB hearing was mailed to owner, and the certified receipt has not been returned.

The first photo is of the front elevation showing a single story commercial structure built in 1970 with a post and beam foundation, wood panel siding, and flat metal roof.
This structure has no active water or electrical services.
From this photo, you can see this the skirting is missing, exposing the foundation to the elements.
Wood panel siding is deteriorated, and the roof and overhang are in poor condition.
I'd like to point out to the board that this front door is where I first make entry into the structure.
The next photo is a closer look at the front porch landing, which is completely deteriorated, making it difficult to walk on and posing egress concerns.
The following photos of the right elevation.
Once again, the skirting is missing, exposing the foundation and siding is weathered and worn along the bottom, and the structure has been vandalized with graffiti by vagrants.
The next photo is of the rear elevation.
The siding is deteriorated along the roof and overhang, and the broken window is boarded up.
The following photo is a better look at the rusted and bent metal roof along with the rotting sheathing and rafters.
The following photo is of the left elevation.
Siding is damaged and lacking weather protection as well.
And the next photo is a closer look at the foundation from the left rear corner.
The cinder block post have sunk into the ground.
The exposed beams is rotting and detaching, and the siding is also separating, exposing the weathered and damaged wood members.
The following photo is a view of the rotting and overhang uh member wood members from the same corner.

And the following photo is my view once inside.
This structure is one large room with a restroom, which you can see to the right hand corner.
Trash and debris is scattered throughout.
Walls have been vandalized, showing signs of vagrants.
The floor is very sponging and unsafe to walk on, posing egress concerns.
And it was difficult to inspect due to all the debris.
The next photo is a look at one of the walls with a broken window and a hole in the drywall where natural light is entering the structure, exposing the interior to the elements.
The next photo is a closer look at the restroom, which is full of debris and broken drywall.
And the following photo is of the ceiling above the restroom.
The drywall has collapsed, exposing the roof system, which is rotting and decaying.
And my final photo is of the ceiling in the center of the structure where the drywall has also collapsed, exposing water damage sheathing.
This is a commercial property with a single story structure found to be in deteriorated and dilapidated condition.
The foundation cinder block posts are cracked and sinking.
The exterior walls are worn with holes, and the roof and overhang are separating and rotting.
The interior is full of trash and debris and vagrants continue to enter and vandalaze the structure.
And this structure is located within a thousand feet of a child care center.
To recap, the structure located at 3446 Roosevelt Avenue is in violation of City Code Article 8, Chapter 6, dash 156, subsections 1, 2, 5, 7, 8, 11, 12, 15, 17, and 18, in which any building or structure which has any or all of the other conditions or defects herein after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation.
Pose a threat or potential threat to life, health, property, or human safety.
Staff recommends demolition.

My name is Michael Alvarez.
Um I've traveled here today from a home in Dickinson, Texas, which is in Galveston County, uh, approximately four hours away.
Uh, took the day off work to be here, as did my son.
Uh, went ahead and pulled the kids out of bed about 4 a.m.
this morning uh to get here on time for this meeting.
Um I did want to show up for this meeting.
I feel it is important, um, mostly to show respect for the city uh for all the efforts that had have been put forth.
Um I want to put on record, as a matter of fact, uh the professionalism and courtesy shown uh by Officer Kintania as well.
His communication is fantastic.
Uh we have a good rapport, uh, have worked together for a while uh regarding this property.
Uh I was gifted this property to uh to myself as a Christmas present by my parents.
It has been one of the most costly Christmas presents I've ever received.
Um, it has cost me multiple weekends with my family.
Usually we take a holiday weekend, which is a three-day weekend to come up and clean the property as best as we can.
Um that's happened probably about four times to the tune of anywhere between a thousand to two thousand dollars per visit.
Um that's not including the hotel stay and visits to the river walk that we take since we're here already.
Um with that said, uh, I am not here to offer any opposition uh to the demolition of the property.
I agree with the city and everybody who's employed here who's stating that the property is dangerous.
Uh the property is so dangerous that I personally don't want to have to subject my kids to going in there and helping me clean up any longer, as well as my wife, my parents, my cousins, and people who've helped me in the past.
Um, I concur with demolition.
Um I, as a matter of fact, uh want to also uh thank Mr.
King here, he has attempted to meet me prior.
Um, I think there was a change in policy recently that disallowed me to sign a hold harmless form.
Uh we tried.
I took the day off work on a Friday.
Well, I had to be there for a meeting that morning.
I left at 10:30, attempted to get here, and because of Houston traffic, I was trying to pass through the city as we were in rush hour.
I missed him by about 30, 45 minutes, and it was maybe a week later that the policy changed.
So I was unable to sign that hold harmless form, or the structure would already be down with my concurrence.
Um, with that said, um I have prior, I guess it was probably two, three years ago, signed a trespass affidavit.
Um, I am and and I I don't wish to speak negatively of SAPD because everybody has been very professional that I've ever dealt with.
However, they have been unable to keep the vagrants off the property.
They're very persistent.
Um we have put up fencing on the front of the drive.
The drive is also it's I guess listed by the city as a separate property, but it's the only access to the property.
Um I pay taxes on them separately.
Uh, with that, you know, being the case, there was a carpet business that prior was storing their stuff on there.
I was getting letters and stuff continuously about the carpet remnants that are on my property.
I'm like, it's not mine, but we'll, you know, make sure that it gets cleaned.
I made contact with people, oh yeah, we'll clean it up, and they of course they never did.
Uh from what I understand, the owner of the building uh was renting to that company, and that company has since left.
Therefore, carpet's no longer an issue on my property.
So, um, but we put up a fence at the street, which was constantly pulled and curled back.
It was uh it was a chain link fence, you know.
So then we went and my dad's a welder, so we put up a actual steel fence.
I I don't know how tall it is, it's pretty tall, uh, that is chained and padlocked um to keep people off the property, you know, completely.
Um, and that's the actual main property itself with the structure on it.
And when we came back the next time to actually try and clean the property, my key didn't fit the lock.
Turns out that they had cut the lock and put their own.
Um, so I couldn't even access my own property without actually breaking the lock.
Um, and every time we've come, you know, well, not every time we've come, but you know, when we came to clean, we would actually have to contact the police, get people off the property, make sure that it was clear, and then go in there.
Um, so again, with all with all that said, um, I'm in concurrence.

Um, the one thing that I will state though, and I I do want to go ahead and make sure that everybody understands this property was never commercial.
Um prior to me owning it, it was owned by my parents.

So it was raining in, you know, ruining the walls, the ceiling, and the flooring, and it just started to grow from there.
So by the time I got the property, uh that buildings is a mess.
So for the record, there's nothing historic about the building.

This is the first time 224 South Home is being presented before the board.
Please note on February 14th, 2025, a dangerous assessment response team inspection was conducted.
The inspection is a collaborated inspection with a variety of city departments that included the San Antonio Police Department.
The legal description is NCB 6182, no block number, lot 191 and 192, located in City Council District 5.
The owner on record is the Pata Minerva with a mailing address of 224 South Home San Antonio, Texas 78204.
The property owner is not present today.

The Office of Historic Preservation has confirmed on June 16, 2025, the property is not eligible for historic designation.
The first inspection regarding 224 South Home was conducted on February 14th, 2025.

On February 21st of 2025, a conference was scheduled at the City Attorney's Office.

There is a work order in place to remove all the trash and debris, so we are currently working on that.

It is exposing the seal beam that is sitting on grade.
So this is going to be that rear portion of that left elevation.
Again, the roof system, the roof covering, the metal roof covering is rusted, and the siding lacks weather protection.
This is looking underneath the foundation on that left elevation.
The beam does have significant water damage.
So this is going into the front door of the structure.
Floor covering is missing throughout the structure, so the subfloor is exposed and it is worn.
But there is so many items blocking the walkway, so you cannot make entry into that bedroom.
This is going into another room.
Again, large amount of items throughout the structure.
Where there is floor covering, it is a lifting off of the floor, posing a tripping hazard, and all of the items are blocking the windows indoors, posing an egress hazard, and the sheetrock has collapsed from the ceiling.
So this is going to be a second view going into that one bedroom that has all of that large amount of debris and other items.
And again, all of the windows are blocked, all of the doors are blocked.
That door to the left is a door to the exterior, and you cannot access it.
The sheetrock is missing in multiple areas.
The plumbing fixture for the shower is also missing.
It is not usable.
Here is another bedroom again with large amounts of items just blocking the windows, and the subfloor is exposed.
This is going to be the kitchen area.
The sheetrock is damaged with some writing on the wall, large amount of items on the floor, so it is hard to walk through.
The water heater is connected into the kitchen as well.
And there is a water leak underneath the sink.
They have a bucket to catch the water.
This is just another angle of that kitchen from the back door showing the large amount of items in the kitchen and the water heater installed in the kitchen as well.
So this is going to be the front elevation of the accessory structure.
The wood siding does lack weather protection along with the fascia boards.
This is going to be the right elevation of the structure.
The wood siding lacks weather protection.
The corrugated metal roof covering is lifting from the structure and it is rusted and worn.
This is going to be the rear elevation of the structure.
It is close proximity to the neighboring fence line, and again, the corrugated metal roof covering is detaching from the structure, and the wood siding does lack weather protection.
This is looking inside of the accessory structure.
Again, just large amount of storage.
There is sunlight coming through the rear right or the rear left portion of the structure.
And this was the only view I could get of that left elevation.
The exterior wall is missing on the front portion.
So this was on February 14th of 2025.
That is the day of the dart to show that no changes really have been made to the structure.
This is going to be that right elevation again.
It is it remains the same.
So as of February 14th to the date on June 2nd, it remains the same.
So this is going to be the rear property and rear elevation of the structure.
We did abate the property on February 17th of 2025.
So since then it the property has gotten worse.

The structures located at 224 South Home are in violation of City Code.

Staff recommends demolition for the main structure and the accessory structure and for the property to be vacated.

The underlayment is weathered and pulling away from the studs, which are exposed to the elements.
The wood siding on the addition has rotted at the bottom.
It was covered up with a wood trim at one point.
Eventually that detached and continues to deteriorate.

The wood siding at the bottom continues to deteriorate around the entire addition.
The windows are broken from vagrants repeatedly breaking into the structure.
The pergola at the rear right side is weathered.
The slab that are poured at the rear are significantly cracked.

The trim again detaching, exposing the deterioration.
The overhang is missing the soffit.
The decking and is water damaged.
The fascia is deflecting and detaching from the rafters.

This area was infested with bees.
We had it abate it once so that we could go and cut that grass.
The bees are back despite our request for them to vacate.
This opening allows rodents and pests to continue to enter the structure.

The window was broken into and the door unlocked.
This is about the sixth time the structure has been broken into that we had to have it secured.
As you walk into the front entrance and turn to the left, this front room has missing window glazing.
The ceiling has missing drywall and collapsed insulation.
This room also has missing drywall from the ceiling.
The electrical wiring is hanging from the joists.
The floor tiles in the bathroom in the original build are loose and detached from the floor, creating walking surface and egress violations.
This is a photo of that exterior door where the window was broken.
You can see natural light around the door frame where it does not seal properly, allowing pests and elements, the weather elements to enter the structure.
This structure has remained neglected by the owner for at least the last three years.
No contact has ever been established with the owner as it continues to deteriorate with exposed wall studs, damaged roof covering, and dilapidated overhangs.
At one point, prior to our last three abatements, a group of people, neighbors described as a work crew, had moved into the structure, coming and going only at night through a front window that they had broke.
We found roofing shingles stored inside the structure at one point.
The damaged ceiling drywall was cut out and all the collapsed insulation had been cleaned up.
Only when we continued to secure the structure did they stop returning.
However, vagrants continue to pull the plywood off the back through the alleyway there and break into the structure, creating a potential threat for children attending the school across the street.
Without immediate attention, this structure will continue to draw the attention of vagrants and to deteriorate.
The structure located at 1202 Marseille Street is in violation of City Code Article 8, Chapter 6-156, subsections 5, 7, 8, 11, 12, 15, 17, and 18, in which any building or structure which has had any or all of the conditions or defects here and after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation, pose a threat or potential threat to life, health, property, or human safety.

But they didn't do a very good job because that whole swath of shingles just blew right off, is laying there.

And it's been basically in this condition since 22.
And yet we've never talked to an owner or anybody who has any kind of official party to this property.

It's just an empty office.

The original notice was mailed on April 28th of 2025, and the certified receipt was returned unclaimed on May 28th, 2025.
On April 14th, 2025, a conference was held at the city attorney's office.
However, no property owners or responsible parties attended the meeting.
On June 18th of 2026, the notice for the BSB hearing was posted at 214 Hermitage Court.
On June 17, 2026, the notice for the BSB hearing was mailed to Lois Dravino, and the certified receipt has been returned on claimed on June 25th of 2026.
On June 3rd, 2026, an administrative warrant was executed to obtain photographs.
No scope of work or financial proof or letter of credit or engineers report has been provided.
No permits have been obtained for the property.
This is the front elevation of the main structure.
The foundation skirting is missing in multiple areas.
Some of it has been replaced by corrugated metal.
The siding is lacking weather protection as well, along with the structural wood members for the attached front porch.
This is going to be the left elevation of the structure portions of the siding is missing, exposing rotted wood, and again, corrugated metal has been replaced for the foundation walls, and the back portion it is completely missing.
This is going to be the rear elevation of the structure.
Again, the foundation walls are missing or replaced with corrugated metal.
Areas of the siding is missing and windows are broken or unsecure.

The cedar posts are rotted.
The cell beam is also rotted along with the floor joists.

At the time of the dart, we had actually conducted the dart due to past history with animal care.
Unfortunately, the property was completely vacant during the dart, and the property has remained vacant.
So there was nobody on the property at the time of the inspection.
There were no animals at the time of the inspection, and it has remained vacant.
So now it's just being occupied by vagrants at this time.
This is going into the kitchen area.
Again, the subfloor is exposed.
It is worn.
This is the bathroom area.
The floor is soft going into the bathroom, and there is a portion behind the toilet that does expose some sunlight coming through as well.
Here's one of the bedrooms.
This is one of the windows that has been broken into.
We have secured the property multiple times.
However, the structure keeps getting broken into.
In this area, the window is boarded up and poses an egress hazard.
So this is going to be the front left elevation of accessory structure number one.
It is sitting on bricks at this time.
The fascia boards do lack weather protection along with the siding.
It is starting to be worn on the bottom.
And then it just has uh storage at this point.
And there is sunlight coming through the wall system and the roof system.
This is going to be the front elevation of accessory number two.
It is a metal storage shed.
The front right area, it is dented in, and there is graffiti.
So this is the right elevation of the structure.
There is multiple areas of graffiti, and the siding is dented in and the roof covering is rusted and worn.
This is the rear elevation of a structure of accessory too.
And again, the siding is rusted.
There is some graffiti that has been blocked out due to the obscenities, and then the roof is rusted and worn.
And this is the interior of the structure, just a large amount of items being stored to the point to where it's flowing out of the door.
This is going to be the front structure of accessory number three.
It is sitting on cinder blocks as well.
The siding is deteriorated.
It is exposing insulation from the interior of the structure, and the windows are broken and or boarded up.
This is going to be the left elevation of the structure.
Again, the siding is deteriorated.
There is insulation exposed as well.
And this is the rear elevation of the structure.
Again, the siding is starting to deteriorate.
And this is going to be the right elevation of accessory number three.
There is no siding, it is just plywood that is untreated and starting to get water damage.
This is the interior of the structure.
Behind that fallen shelf.
There is wood paneling that is missing.
The stud members are exposed along with the insulation.
So this was going to be the day of the dart on April 8th.
The front of the structure, it remains the same.
No changes have been made.
This is going into the kitchen area on April 8th.
It remains the same as from April to June of 2026.
This is the bathroom area.
So again, this was April 8th of 2025, and the previous photo I showed you of the bathroom was June 3rd of 2026.
It remains in the same condition.

The structures located at 214 Hermitage Court are in violation of City Code Article 8, Chapter 6, 156, subsections 1, 2, 8, 11, 12, 15, 17, and 18 for the main structure, subsections 1, 2, 8, 11, 12, 15, 17, and 18 for accessory structure number one.
Subsections one, two, eight, eleven, twelve, fifteen, seventeen, and eighteen for accessory structure number two, subsections one, two, eight, eleven, twelve, fifteen, seventeen, and eighteen for accessory structure number three, which any building or structure which has any or all of the conditions or defects here and after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation pose a threat or potential threat to life, health, property, or human safety.
Staff recommends demolition for the main structure, accessory structure one, accessory structure two, and accessory structure number three.

No, no one has ever came forward.
The neighbors could not provide any contact information either.
And Bearcat didn't provide anything that no, uh, we what we have is what Bear County appraisal has as well.
And the only thing right now I see here is still a problem is the vacant.

And they're not calling SAPD.
They actually will just tell the contractors when I have them on the property to clean and secure, they'll walk up to them and ask them what's going to happen.
Apparently there was potentially a shooting, but San Antonio Police Department doesn't have a record of it.
So if it's not called in and reported, then it's not on record, so we can't confirm or deny that anything was happening on the property, unfortunately.
So we don't have a record of how many are keep coming and going.
