Um the first individual is uh Brandon Raymond.

1:37

Sir, you have three minutes.

1:38

You'll be followed by Jay Wenger and then Mark Gueretta.

1:42

Each of you have three minutes.

1:46

Technically, I was told to sign up in case y'all had questions, so I really don't have anything to say.

1:50

Okay.

1:50

I just want my house to stay a house and not be a business.

1:53

So that's all I've got.

1:55

Appreciate.

1:56

Thank you.

1:58

Jay Winger.

2:02

Followed by Mark Guerrera.

2:09

I'm Jay Winger from 7467 Timber Creek Drive.

2:14

I was uh president of Atonement Lutheran Church when we started the process to try to rezone one acre of our four acres that our church sits on.

2:29

Uh like many congregations, we uh have struggled to keep our doors open, uh especially during the pandemic and after.

2:41

Uh our goal is to continue to support the community in which we're uh a part of, especially the uh friendship house and uh the schools in our community with school supplies, friendship house with food, clothing, and cash donations.

3:06

Uh we're struggling again to pay our utilities to try to have a pastor on Sunday mornings uh to give us the word uh and uh we were established in 1961, and uh we want to uh be a part and stay a part of the community.

3:34

This one acre should help us with our expenses.

3:38

Thank you.

3:42

Final speaker on consent agenda items, Mark Retta.

3:53

Good afternoon.

3:55

Uh actually I I don't have uh very much to say unless there's a rebuttal to our request.

4:00

We're just trying to um convert an existing house to uh a small light office use.

4:09

Uh we own the property across the street and some property next next to it.

4:14

And uh we're not gonna alter in any way the exterior of the building, just some renovation inside and uh trying to modernize it a little bit.

4:25

So unless there's rebuttal, I that's all I have to say.

4:30

Thank you.

4:31

Thank you.

4:32

We actually have one more um uh individual to speak.

4:35

Uh Marie, excuse me, Mia Marie Pueg.

4:40

Okay.

4:48

Okay, those are all the individuals that have signed up to speak um on the consent agenda.

4:52

Is there a motion to approve the balance of the consent agenda?

4:56

Second.

4:57

Okay.

4:58

Is there any council discussion on the items on the consent agenda?

5:02

Yes.

5:03

Okay.

5:05

Councilman White.

5:07

Thank you, Mayor.

5:09

And I'm commenting today on behalf of Councilwoman Aldrette Govito on items 16 and 17.

5:17

She would like to thank the applicants for being here today and uh for answering all the questions thoroughly throughout this process.

5:25

The councilwoman especially wants to recognize the village in the woods HOA for voicing their neighbors' concerns and for reaching an agreement with the applicant to address those concerns.

5:36

Through restrictive covenants, the applicant has committed to limiting their hours of operation, restricting vape shops, liquor stores, and auto repair businesses from operating here, which is a big win for the community.

5:50

In addition, the applicant received a letter of no opposition from the Braun Street, the Braun Station West neighborhood across the street.

5:59

And with this in mind, uh the councilwoman would like the restrictive covenant to be reflected in the record.

6:06

Thank you.

6:10

Any other comments from the dias?

6:13

Okay.

6:14

That concludes council discussion on the consent agenda.

6:17

There's a motion and a second to approve the consent agenda, which are items two, four, seven, nine, ten, eleven, twelve, thirteen, fifteen, sixteen, seventeen, eighteen, and nineteen.

6:27

Please vote.

6:37

Okay, the motion carries.

6:41

We'll now move on to individual items.

6:43

Um staff, please start with item number one.

6:46

Absolutely.

6:47

Thank you, Mayor and Council.

6:48

Agenda item number one is an alcohol variance to allow for on-premise consumption for a bar located at 5520 West Military Drive.

6:57

The applicant is amending their hours of operation to be Monday through Sunday, 4 p.m.

7:02

to 2 a.m.

7:03

Three notices were sent to schools and Lackland ISD.

7:06

Lackland ISD supports the updated hours.

7:10

It is within 300 feet of Lackland Elementary School and the Virginia All-Red Stacy Juniors Senior High School.

7:16

Thank you.

7:17

Great, thank you.

7:19

We have one member of the public signed up to speak.

7:21

Uh Jack Finger, you have three minutes, sir.

7:31

Madam Mayor, other members of the city council, my name is Jack M.

7:35

Finger.

7:36

And uh item number one, Mr.

7:38

Mungia, I believe this is in your district.

7:41

It uh was continued from earlier point uh last month, I believe.

7:45

It's about uh placing a uh alcohol sales, alcohol sales within 300 feet of a well says here in elementary school.

7:56

Yeah, Laclan Elementary, right there on uh on Military Drive.

8:01

Lacklin Elementary and another one.

8:07

All Red Stacy Junior, senior high school.

8:10

So the question remains, sir, is why why not say say no to placing alcohol sales within 300 feet where school kids uh play and walk to and from school.

8:27

The um Texas Alcohol and Beverage Commission has rules against these things.

8:33

They uh they they have good reasons as to why they don't want such alcohol sales to be placed right where school kids are walking and running and playing.

8:46

So um would you please say no to having these influences right right to where where the school kids are, sir, instead of just continuing or saying yes to it there.

8:59

Thank you.

9:02

Item number one is in district four.

9:04

Councilman Mungia is recognized to speak.

9:06

Thank you, Mayor.

9:06

I'll just note that the two um schools in question are are on the Lackland Air Force base behind a large gate, so no one can actually walk past that school from the bar.

9:17

So just want to let you know that.

9:19

And I want to give uh kudos to the bar for also agreeing to start later in the day at four o'clock after school lets out.

9:27

Um and the school signed off on it.

9:30

So I'll make that noted.

9:31

Uh motion to approve with conditions as read.

9:34

Second.

9:38

Is there any other council discussion on item number one?

9:43

Okay, there's a motion and a second to approve with conditions as read.

9:46

Um item number one, please vote.

10:00

The motion carries.

10:00

Uh staff, please present the next item.

10:03

Agenda item number six is a change of zoning from C3 to C3NAS with a specific use authorization for auto paint and body repair with outside storage of vehicles and parts permitted, but totally screened from view of adjacent property owners and the public rights of way.

10:21

It is generally located in the 3,000 block of city-based landing.

10:25

Staff recommends denial.

10:26

Zoning Commission recommends approval.

10:28

Staff mailed 12 notices.

10:30

Zero were returned in favor and zero opposed, and there is no registered neighborhood association within 200 feet.

10:37

Thank you.

10:38

Okay.

10:42

We have two individuals signed up to speak on the item.

10:46

The first person is Emily Wessler.

10:49

You have three minutes you're okay.

10:51

Okay.

10:52

Um Jack Finger, you have three minutes.

11:01

Other members of the council.

11:02

Once again, my name is Jack M.

11:04

Finger.

11:05

And uh item number six.

11:10

This one falls in district three, and Ms.

11:12

Via Grand, this is in your district.

11:14

It's about uh what is it?

11:16

Auto paint and body repair with outside storage of vehicles in parts.

11:23

Just uh right there over at the city on the street called city-based landing.

11:31

The uh red flag here is that zoning staff said that uh this thing it's right uh well in their words.

11:43

I'll read what they said here.

11:45

It seems a heavy commercial presence hindering the transition to a vibrant mixed-use environment.

11:58

That's what the intention it was for for the uh this area on that street.

12:05

They also mentioned the noise and the odors that do come from a auto paint and body shop.

12:14

Ms.

12:14

Via Grant.

12:15

So uh you know logic would say you don't put an auto paint and body shop close to where people people are gonna be affected by it negatively.

12:31

That's what the uh the staff, the paid staff that we yes, we paid to get professional opinions on these things.

12:38

So uh Ms.

12:39

Via Grant, would you please say no to item number six?

12:44

Thank you.

12:49

Okay.

12:50

Item number six is in district three, council and via is recognized to speak.

12:55

Thank you, Mayor.

12:56

I want to thank the applicant for working with my office and with the stakeholders in this immediate area.

13:01

The no alcohol restriction and the additional screening requirements of this development will assist with maintaining the established aesthetic appeal of the Brooks Regional Center.

13:11

With that being said, I will make the following motion, motion to approve.

13:15

Second.

13:18

Okay.

13:20

Is there any any other council discussion on item number six?

13:24

Okay, there's a motion and a second to approve.

13:27

Please vote.

13:35

Okay.

13:35

The motion carries.

13:37

So that concludes today's zoning and land use session.

13:40

The time is now 2:30.

13:41

The meeting is now adjourned.

    • Brandon Raymond raised concern about his house becoming a business, stating, "I just want my house to stay a house and not be a business."
    • Jay Winger (from 7467 Timber Creek Drive, former president of Atonement Lutheran Church) described the church's effort to rezone one acre of its four-acre property to generate income. The rezoning "should help us with our expenses."

    • Councilman Mungia (District 4) noted the schools are on Lackland Air Force Base behind a large gate, so pedestrians cannot walk from the bar to the school. He commended the bar for agreeing to start at 4 PM after school lets out, and reported the school system signed off on the variance.
    • Vote: Motion to approve with conditions as read passed.
  • Item 6 – Change of Zoning (3000 block of City Base Landing): Request to change from C3 to C3NAS with a specific use authorization for auto paint and body repair with outside storage of vehicles and parts, permitted but totally screened from view.
