Uh item number seven.

And this is in District Three.

2:11

And Miss Via Gran is about putting establishing a well, what I call a monstrosity.

A big cell phone tower.

2:20

You you've seen what they look like.

2:22

Uh 100, 200 or more feet tall, right there on South W White Road.

2:29

Now, do you really want to place something right there for your residents that they have to drive by every day when they come back and forth to work there?

2:44

I don't see why you really want to do that.

2:47

I think uh you would want to say no to it, and especially if there's gotta be some other place in the out say on the outskirts of town where you can put cell phone towers and that bit people won't be uh so exasperated by by them.

3:04

Ms.

3:05

Via Gray.

3:09

Appreciate if you consider that, ma'am.

3:11

Councilmember Sus.

3:40

Councilmember Corr.

3:42

I like Council Mom.

3:43

Okay.

3:43

I just wanted to take a quick moment to highlight item number two, which is a new office for a really wonderful nonprofit, Beat AIDS, and we have two representatives here from Beat AIDS, and they are locating their office just two blocks away from Crockett Park, right by North Main, which is going to be a great location for them to really support not only RGBT plus youth, but all of our community as well.

4:04

So thank you so much for all of the work that you are doing and excited to support this zoning today.

4:08

Thanks, Mayor Pro Tim.

4:12

Thank you, Councilmember.

4:13

Any further discussion?

4:15

We have a motion and a second and a second on the consent agenda.

4:18

Please vote.

4:28

Motion carries.

4:30

That concludes the consent agenda.

4:33

We will now move on to individual items.

4:35

Uh staff, can you please start with I have items five and six?

4:38

Absolutely.

4:39

Good afternoon.

4:40

Agenda items five and six are a plan amendment and change of zoning, amending the southeast community area plan from neighborhood mixed use to community commercial and rezoning the property from R4 to C2NA C D with conditional use for motor vehicle sales.

Thank you.

5:19

Thank you.

5:20

We do have one person signed would speak on this item.

5:23

Jack Finger.

5:30

Mr.

5:30

Mayor Pro Tem, other members of the Council.

5:33

Once again, my name is Jack Finger.

5:35

And uh item five and six.

5:38

This is about uh placing a used car lot over on Rigsby Avenue.

5:46

And this is in this is in District Three.

5:48

Once again, Ms.

5:49

Via Grand, uh you uh have all the uh good controversies could seem to come your way there.

5:56

So yeah, it's but then the reason they are controversial is because the planning uh department's staff whom we pay to offer professional opinions on these things, along with the zoning staff, which come from that same department.

6:17

They both say do not do this.

6:21

Do not do this.

6:23

Why?

6:24

Well, perhaps maybe you've read in your due diligence, like I'm sure you've done maybe you've uh read the backup documents like I have.

6:32

It says that used car lot amid amid residences allows for commercial encroachment.

6:41

Commercial encroachment it you as you will find there's a lot of that to be that will take place on today this afternoon's agenda.

6:51

Yeah, the uh so the idea is to say is to say no so that the future of the people living there don't have to live amid more and more business squeezing them out.

7:11

Right?

7:13

Yeah, uh I I would like to thank you, folks are for quality of life.

7:18

You say you are well.

7:20

Let's see you prove it.

7:23

Thank you.

7:25

Thank you.

7:26

Item numbers five and six are in district three.

7:28

Councilman Via Grande is recognized.

7:31

Thank you, Mary.

7:32

I want to thank the zoning and planning commissions uh for vetting this case, and thank you for the applicant for working with my office in their neighborhood outreach performed.

7:40

Rigsby Avenue is a major thoroughfare on the southeast side, and there are already existing commercial uses on this same block and one block over.

7:48

Lastly, the C2NA restriction will provide area residents with having a say if other more intense or after hours commercial uses are sought out in the future.

7:58

Uh so if you've been through Rigsby, I think you know exactly where this is.

8:01

So with that being said, I'll make the following motion, motion to approve.

8:05

Second.

8:06

We have a motion and a second.

8:08

Please vote.

8:23

Motion carries up next is item eight.

8:40

The property is located at 7095 Hewerman Road.

8:44

Staff recommends denial, zoning commission recommends approval.

8:47

Twelve notices were mailed, zero were returned in favor, and zero in opposition, and there was no response from the riot commons community organization.

8:55

Thank you.

8:56

Thank you.

8:56

Every one resident signed to speak.

8:58

Jack Finger.

9:06

Other members of the council.

9:08

This item in uh number eight, it's in happens to be in district eight.

9:14

Ms.

9:14

Gonzalez, it's your district, and uh it's about the the idea of changing something, a location that's residential in character to well, commercial.

9:26

Yes, and uh the reason the zoning staff thought it was bad, another red flag, is because well, as I mentioned a moment ago, commercial encroachment.

9:41

Yeah, and uh that plus the idea it it could harm the residential character of the people that living nearby there.

9:51

So um yeah, now contractor facilities by themselves are are okay, but they are not aligned with the residences that they are situated next to.

10:06

So yes.

10:07

Why not to tell them no on this one?

10:13

Thank you.

10:15

Thank you.

10:15

Item A is in District 8.

10:17

Uh, Councilmember Mesa Gonzalez is recognized.

10:19

Thank you, Mayor Pro Tem.

10:21

Uh, thank you for the zoning to the zoning commission for working on this item.

10:24

Um, I'll be making the motion to approve.

10:28

We have a motion and a second.

10:29

Please vote.

10:42

Motion carries.

10:43

We'll now move to items nine and ten.

10:45

Agenda items nine and ten are a plan amendment and changes zoning, amending the north sector plan from suburban tier to regional center and rezoning the property from C3NAS with specific use authorization for an electrical contractor facility to C3NAS with a specific use authorization for a construction contractor facility for fencing.

11:07

Um the property is located at 13406 Western Oak Drive.

11:11

Staff recommends denial.

11:12

Planning and zoning commission recommend approval with the following condition that all installed lighting is to be downward facing.

11:20

Staff mailed 32 notices, zero were returned in favor, zero in opposition, and the Bavarian Forest HOA did not provide a response.

11:28

Outside of the 200 foot notification boundary, six notices were returned in favor.

11:33

Thank you.

11:34

Thank you.

11:35

We have two residents sign up to speak.

11:36

Mr.

11:37

Jack Finger.

11:45

Mr.

11:45

Mayor Pro Tem, other members of the council.

11:49

My name is Jack M.

11:50

Finger, and uh, you know, I think uh when you have newcomers coming to San Antonio, I think you should make it an ordinance placing a sign out in every single neighborhood uh warning.

12:03

You will eventually be squeezed out by commercial enterprises.

12:09

I mean it's true.

12:11

We have three three or four count them uh items here that deal with commercial encroachment.

12:18

And so far, yeah, y'all have approved every single one of them.

12:22

Do you really want this town to become one big smokestack?

12:30

Hmm.

12:31

I mean, where are supposed to people where are supposed to people live?

12:36

Where are they supposed to go when they have businesses on one side, business on the second side, business on the third?

12:44

Where do they go?

12:45

You want them to do you want to have them continually move out to Bernie?

12:52

This is what's going to happen.

12:54

You will squeeze out everybody who really wants to care about our city when you do this.

13:00

These are the consequences of a commercial encroachment.

13:03

Some neighborhoods have finally learned this long ago and they decided to do something about it, and they succeeded, and they let you know loud and strong when they see these things.

13:15

Others are not so organized, and you think you could just go ahead and allow it to just slip right in without anybody knowing.

13:24

But one person notices, and quite frankly, you really need to say no to these things at least once in a while.

13:35

You know, what's the change here from electrical contractor to construction contractor?

13:42

Yeah, two P's in a pod.

13:46

You re you really want to live right next to a com a construction contractor site?

13:52

Because that's what you're asking the people and this issue to do so.

13:56

The big red flags, planning commission, zoning commission say don't do this.

14:01

Are you going to listen to them?

14:06

Thank you.

14:07

Thank you.

14:08

Mr.

14:08

John Cooley.

14:13

Wonderful.

14:14

Uh thank you.

14:16

Items nine and ten are in District 8.

14:18

Councilmember Mesa Gonzalez is recognized.

14:20

Thank you, Mayor Pro Tem.

14:21

Um, I'm happy to welcome a new business of San Antonio from Labake Frio Fencing that will utilize a vacant ex existing structure.

14:28

Thank you to the zoning and planning commissions for their work on this item.

14:32

Uh motion to approve with conditions as read.

14:35

Second.

14:36

We have a motion and a second.

14:37

Please vote.

14:47

Motion carries.

14:48

That concludes today's zoning and land use session.

14:51

The time is now 2 24 p.m.

14:52

and the meeting is now adjourned.

14:53

Thank you all for being here.

San Antonio Zoning and Land Use Committee Meeting - April 16, 2026

The San Antonio City Council Zoning and Land Use Committee met on April 16, 2026, at 2:09 PM, with Mayor Pro Tem McKee Rodriguez presiding. Roll call was taken, and one item (Item 4) was continued to the June 18, 2026 meeting. The committee addressed the consent agenda and then considered several individual zoning items. Public comments were heard, and a series of votes were taken.

Consent Calendar

  • The consent agenda included items not listed for individual consideration. Two items were pulled for public comment: Item 7 (cell phone tower in District 3) and Item 11 (speaker declined to speak). The remaining consent items were approved by a motion and second, with Councilmember Corr highlighting Item 2 – a new office for the nonprofit Beat AIDS – and expressing support. The status of Items 7 and 11 after public comment is unclear from the transcript; they were not voted on individually during the session.

Public Comments & Testimony

  • Jack Finger (speaking on multiple items): Opposed Item 7 (a cell phone tower at South White Road, calling it a "monstrosity"), Items 5 & 6 (a used car lot on Rigsby Avenue, citing commercial encroachment and staff denial), Item 8 (a construction contractor facility on Hewerman Road, arguing it harms residential character), and Items 9 & 10 (a change from electrical to construction contractor facility on Western Oak Drive, criticizing commercial encroachment and urging the council to deny). He asked the council to prove their commitment to quality of life by voting no.
  • Laura Momsi Vais was signed up to speak on Item 11, but declined to comment.

Discussion Items

  • Items 5 & 6 (Plan Amendment and Rezoning – 1514 Rigsby Avenue): Staff recommended denial; Planning and Zoning Commission recommended approval. The property would be rezoned from R4 to C2NA C D with conditional use for motor vehicle sales. Councilmember Via Gran (District 3) made a motion to approve, noting that Rigsby Avenue is a major thoroughfare with existing commercial uses and that the C2NA restriction would allow neighborhood input on future uses. The motion passed.
  • Item 8 (Rezoning – 7095 Hewerman Road): Staff recommended denial; Zoning Commission recommended approval. The property would change from R20 C D (assisted living) to C2 NA C D with conditional use for a construction contractor facility. Councilmember Mesa Gonzalez (District 8) made a motion to approve. The motion passed.
  • Items 9 & 10 (Plan Amendment and Rezoning – 13406 Western Oak Drive): Staff recommended denial; Planning and Zoning Commission recommended approval with a condition that all installed lighting be downward facing. The property would be rezoned from C3 NAS (electrical contractor) to C3 NAS with specific use authorization for a construction contractor facility (fencing). Councilmember Mesa Gonzalez made a motion to approve with the stated condition. The motion passed.

Key Outcomes

  • Motion to Continue Item 4: Approved unanimously to continue to June 18, 2026.
  • Consent Agenda (balance): Approved; exact items not specified, but included Item 2 and excluded Items 7 and 11.
  • Items 5 & 6: Approved (motion by Councilmember Via Gran, seconded, carried).
  • Item 8: Approved (motion by Councilmember Mesa Gonzalez, seconded, carried).
  • Items 9 & 10: Approved with condition of downward-facing lighting (motion by Councilmember Mesa Gonzalez, seconded, carried).
  • Items 7 and 11: After public comment, the transcript does not record a subsequent vote on these items. Their final disposition is not indicated in the available record.

The meeting adjourned at 2:24 PM.
