1:28Uh Ivan Hooper is our transportation engineer, and then Aisha Malia Talua is our planning commission secretary.

1:46Uh with regards to how the meeting will proceed tonight.
1:49Uh there are two items on the agenda, and uh we'll first have uh staffer introduce those items, and then um uh if the uh applicant will uh have the opportunity to add to the presentation afterwards the staff will uh then uh close out uh their comments and and we will open the meeting up to public comment.
2:12Um and um we will then close public comment and open it up for planning commission deliberation and and uh motions as applicable.
2:23And uh so we'll proceed uh with the first item now.
2:27It is the uh Fortner annexation.
2:30If you're okay with it, I'll just stay right here in my seat.
2:33Uh this is the Fortner annexation.
2:35The applicant is not gonna be in attendance tonight.
2:39Uh he's already told me beforehand, but the request is to annex three particular parcels that are hatched out on this uh vicinity map.
2:47We have properties located at 8564 south and 8590 south 10th east.
2:54Uh there are two properties that have the same address of 8564, one has a home and the other one is vacant.
3:00So this annexation is just over an acre in size.
3:03Uh the zoning in the county is A1.
3:07You'll see on that uh area highlighted in green.
3:11Uh typically when we've annexed these properties with the A1 zone, it's an R110, so 10,000 square foot lot minimums.
3:18Uh the one on the corner at 8590 East is actually an existing duplex that has two uh single families living in that uh home.
3:27And so Sandy has zoning as R210 on the west and on the east side of that property, and so because it's already an existing duplex, we're gonna recommend an R210 zone uh just so it's a legal conforming use instead of creating a legal non-conforming use.
3:44And so staff would recommend that the planning commission forward a positive recommendation on this particular annexation.

6:56Uh but the property is located at 1139 South 700 East, and the request is um to have adult daycare uh for people with developmental disabilities uh in a portion of the existing building.
7:11Um this is a conditional use within the professional office zone.
7:16Um so I think we will hear from Jane in just a minute.
7:23I will mention um that we did receive an email today, and that was emailed to everyone on the planning commission.
7:28Um, just a comment about um the use in support of it.
7:32I also did receive a phone call as well from Jill Maxwell.
7:38Um, and she thinks that it is a good idea and is in favor of the project as well.
7:43So I just wanted to mention that those two comments uh were received today, and so that's why they are not included in the staff report.
7:51We went to the site a few uh weeks ago.
7:54Correct, yes, and you guys visited the uh planning commission visited the site several weeks ago um because it was recently rezoned to the PO zone.
8:04Um and this is I'll just kind of talk through a little bit and then Jane can add anything uh in just a second, I think, as we're getting some technical difficulties figured out.
8:14Um we had have a picture of the space.
8:17Um they're planning on using uh the basement level of the um of the building.
8:25Um planning to start out with two to three people with hopes to go up to 15 uh in transportation.
8:31They're planning on doing uh all the transportation pickup and drop off uh with a van, and so they wouldn't uh they're not planning on having um clients come to be dropped off and picked up um by other people.

9:04Um so I just want to say good evening, commissioners.
9:09Um, like they say, my name is Jane Talpa.
9:12I'm here on behalf of empiring you.
9:14Thank you for the opportunity, and I apologize.
9:17I was hoping to attend in person, but my son's youth football dinner is tonight, so I gotta do my team mom duties there.
9:25So I apologize, but thank you guys for being so understanding.
9:29Um, like Sarah did say it is an adult day program.
9:33We will be serving a we will start off with two to three individuals with developmental disabilities and behavioral needs.
9:41Go we hope to expand to um about 15 to 20.
9:46If possible, if not, we're happy with um uh whatever amount that we do get.
10:00Our services will be Medicaid waiver funded, and everyone there will be a person-centered approach that we will be helping individuals gain independence, building different skills and connect with the Sandy community.
10:16In mind, um, the rooms are also um separated and uh designated for different activities to and reach um these individuals' lives when they're um attending the day program.
10:33We have a sensory room, a music room, exercise room, arts and crafts.
10:38Um the list can go on is pretty open, it's welcoming.
10:44Um and I believe everybody that will be attending and also employed by empowering you will enjoy the space and the activities plan.
10:54Uh we will maintain the staff to client ratios and making sure that the individuals are always supervised, they will not be unattended or unsupervised.
11:04A staff will always be with them at all times, like Sarah did say, we will be transporting them to and from their homes, their group homes, and dropping them off after day program services.
11:18We are only open Monday through Friday from 9 to 4.
11:22Um I would say the noise level is pretty very minimal.
11:28Um, a lot of the activities will be indoors.
11:31If we do go in the community, it will be going to local stores, the aquarium, uh, museums and stuff.
11:41Um people won't be hanging out in the parking lot.
11:45Uh parking accessibility is there's enough parking for everyone.
11:54And then I believe that empowering you will also give families a peace of mind, create jobs or a place for their individuals, their family members to come to to also feel safe and also have fun.
12:09Um and then we also want to encourage um community integration for these guys.
12:17And we are also committed to being good neighbors.
12:22And um, let me see what else there is.
12:25Sorry, I'm just looking at my bullet points.
12:28Um yeah, so I just want to end basically that empowering you is more than just an adult day program for adults with developmental disabilities.
12:38It's a place where individuals can grow, can connect, and also thrive individually.
12:44Um, and we respectfully ask if you guys can help us approve our conditional use permit.
12:51We will greatly appreciate it.
12:52And if you guys have any questions, I'm open for any comments or questions as well.

13:05Uh just one thing that was pointed out in the conditions that will need to be modified.
13:09Um, we put um about meeting the requirements of the Department of Services for Persons with Disabilities, uh, but it was pointed out that it is the division of services of division of services for persons with disabilities.
13:25Um, I know that um they have plenty of parking, and I know that there are uh they aren't buying the whole building, they're just a tenant within the building.
13:36So have we have we enough parking for other tenants in the future, given the fact that they need a certain number of parking?
13:44Have we thought about that?
13:46Yes, so the um original site plan um required 74 parking spaces, and that was for office and retail use, and the site has just over a hundred parking spaces.
13:56Um, so even with this additional use, there still is um plenty of parking spaces since it was already um overparked with.
14:05So there's plenty, yeah.

14:12We've already talked about this and we're show rezone and uh parking-wise, pretty much everybody they're bringing in is by bus, so no the clients are will drive.

16:00So just just to be clear, the code building code requires an area of refuge, um, which can qualify as that area in front of the elevator, and the firemen will actually come down and take the handicapped people out.
