Rules & Open Government Committee Meeting Summary (Oct. 29, 2025)

The committee convened to preview the upcoming Nov. 4 City Council agenda, approve routine records items, receive the annual City Council referral status report (including a requested deferral), and hear open forum comments primarily related to code enforcement and concerns about treatment and alleged misconduct at a safe parking program.

Discussion Items

  • Preview of Nov. 4, 2025 City Council Agenda

    • Reviewed Nov. 4 meeting schedule (9:30 a.m. closed session; 1:30 p.m. regular session) and consent calendar spanning multiple pages.
    • Highlighted upcoming items including: interviews for Board of Fair Campaign and Political Practices vacancies; actions related to an airport ground transportation island project; an amendment to the Municipal Code to prohibit sale/distribution of nitrous oxide and a temporary moratorium on issuance of tobacco retail licenses; actions related to the Fairways at San Antonio; and grant agreements for outreach/engagement serving unsheltered individuals.
    • Noted that Item 10.2 (Land Use) would be dropped from the Nov. 4 agenda.
  • Annual City Council Referral Status Report (2nd annual)

    • Staff report (Office of Administration, Policy and Intergovernmental Relations): Presented by Deputy Director Sarah Sarate with API Director Emily Lamb.
    • Referral status (since June 30, 2025; as of Sept. 30, 2025): 136 referrals total; 64 completed; 61 in progress; 8 not yet started; 3 deferred.
    • Staff request: Defer one additional item related to a traffic study for a planned development, citing that the study would not occur for at least another 18 months.
    • Public testimony (Roberto, on behalf of the Berryessa Flea Market Vendors Association):
      • Emphasized the importance of an item on the referral list related to flea market advocacy/relocation, stating that after five years there is still no commitment for relocation and stressing impacts to vendors’ livelihoods.
    • Committee discussion:
      • Asked whether work on potential flea market relocation pathways was limited to the Singleton property; staff clarified the analysis is broader and not limited to Singleton, with an intent to report back in Q1 of next year.
      • Clarified that the earlier Council direction about the Singleton option was intended to remove the RFP requirement as a barrier to pursuing it as an option, not to make it the only option.
      • Discussed how deferrals are tracked so items are not lost; staff stated deferred items remain on the list but are not actively pursued for near-term updates to avoid false expectations.

Consent Calendar

  • Approved the public record for the week (no public comment).

Public Comments & Testimony

  • Thomas Baker (open forum):

    • Expressed appreciation for help from code enforcement staff member Joe Celio.
    • Requested assistance with two neighborhood blight matters: a public records request submitted 10/12/25 (submission R010059-10125) for which he stated he had received no response; and an unresolved code enforcement case regarding blight at 1548 Coke Lane (case 2024-11234). He alleged another code enforcement staff member was impeding progress and asked several officials for help.
  • Kimberly Perry (open forum; resident at 1300 Berryessa):

    • Stated she filed a complaint with the City Auditor alleging criminal activity and embezzlement (including stolen donated generators).
    • Expressed that she received no response after contacting the Council office and others.
    • Asked for clarification on her status as a “participant” in a program and stated she believed she was facing retaliation and potential removal from the program.
    • Chair stated the office had received her email and was looking into the information, while noting the committee would not resolve the matter at the dais.
  • Frank Pacheco (open forum):

    • Stated his civil rights were violated by a safe parking staff member; described being accused of theft and stated he was told to provide receipts while being prevented from leaving, leading to police involvement until he said he proved his innocence.
    • Reported that someone was allegedly allowed to move into his RV without his consent while he was at work.
    • Expressed concerns about being “dehumanized,” restrictions on visitors, and being told he could not store certain items in his motorhome.

Key Outcomes

  • Approved the Nov. 4 agenda review actions (with Item 10.2 Land Use dropped) on a 5–0 vote.
  • Approved the consent calendar (weekly public record) on a 5–0 vote.
  • Accepted the annual City Council referral status report and deferred the specified traffic-study-related referral on a 5–0 vote.
  • Meeting adjourned at 2:17 p.m.

Meeting Transcript

It is two o'clock, so we're going to start the roll call. Candelas. Here. One. Foley. Here. Camille. Here. Cohen? Yeah. We have a quorum. All right. Welcome to the October 29th meeting of the rules and open government committee. As a reminder, we expect all attending to follow the code of conduct located on the agenda. Failure to comply with this code of conduct and behavior which will disturb, disrupt, or impede the orderly conduct of the meeting may result in removal from this meeting. Okay, we're going to start today by reviewing the agenda for Tuesday, November 4th. We have it's notice for 9 30 closed session and a 1 30 regular session. And consent consent starts on page four and continues on pages five, six, seven, eight, and nine. Section three, we have the interviews to fill spaces spots on the board of fair campaign and political practices. We have actions related to ground transportation island project at the airport. We have section seven, an amendment uh on the Muni Code to prohibit sale and distribution of nitrous oxide and a temporary moratorium on issuance of tobacco retail licenses. Section eight actions related to the fairways at San Antonio and actions related to grant agreements for outreach and engagement programs serving unsheltered individuals. No, we do have one item. Oh, the item 10.2 and land use will be dropped from the agenda. Do we have any public comment? No public comment. All right, thank you. We don't, I don't think we have no ad sheet. Okay, great. We have a motion and a second. Looks like we have no comments, so we'll vote. Motion carries five zero. Thank you very much. We have no meeting on November 11th, so we have no other agenda to review. Consent calendar just has the public record for the week. Do we have any public comment and consent? No public comment. Okay, back to the committee. All right, we have a motion and a second on consent. That motion carries five zero. And now we have one action item today. It's our annual city council referral status report. Um, Sarah, are you? I think your daughter's presenting. That would be great. Yeah. Good afternoon. Uh Chairman Cohen, committee members, Sarah Sarate, Deputy Director of the Office of Administration, Policy and Intergovernmental Relations, joined by Emily Lamb, Director of API. We're here to submit the second annual City Council referral status report, which is an opportunity to compile all referrals, provide the status of implementation or completion, and make requests to drop or defer individual items. As you'll recall, we submitted MBA number three as part of the budget process, where we conducted an extensive and comprehensive analysis of council referrals.
