No public comments were received.
Public Comments & Testimony
- No members of the public provided testimony on any agenda item.
Discussion Items
- File PDA 200301 & ER25-074: A planned development permit amendment to modify Phase Two of the Tamian Station project (originally approved in 2020) from 219 market-rate units to 132 affordable units (100% affordable). The 4-story building will include 62 one-bedroom, 33 two-bedroom, 36 three-bedroom units, and one manager's unit, with a density of 68.75 dwelling units per acre. The project is eligible for state density bonus law concessions; three concessions were granted: elimination of ground-floor street-facing unit access, reduction in tree canopy coverage, and reduction in low-impact development site design measures. The project includes a surface parking lot with 35 spaces, a transit plaza, and off-site traffic calming improvements. The applicant, Melissa Durkin of Republic Urban Properties, stated the change was due to market conditions and that the project will apply for tax credits in September 2025, with construction expected to start June 2026. The hearing officer expressed support for affordable housing near transit.
Key Outcomes
- Deferral: File PDA 9806704 & ER220-202 (2569 Knowles Coles Court) was deferred to September 10, 2025, per staff request.
- Consent Calendar Approval: File H25008 & ER25044 was approved with staff corrections.
- Public Hearing Approval: The determination of consistency with the mitigated negative declaration for the Tamian Station Transit Oriented Development Project was considered, and the planned development permit amendment was approved, including the three density bonus concessions.
Meeting Transcript
Okay, good morning. We are calling to order the planning director's hearing of August 27th, 2025. My name is Martina Davis, and I am the hearing officer for today's agenda on behalf of and delegated by the Director of Planning, Building, and Code Enforcement, Christopher Burton. This meeting is held via Zoom conference call. Members of the public may participate by following the instructions listed on page two of the agenda. If you would like to provide public comment, you have two methods to do so. So the first method is for participants who have joined electronically. So if you're on the Zoom and you have audio input available on your computer or smoke phone, you can use the raised hand feature in Zoom during the agenda item you would like to speak to, or click star nine on your phone. Remember to keep your raised hand feature on until planning support staff identified your return to speak. If uh you aren't joining electronically via the Zoom, uh the alternative method is during the meeting, call 408-535-8517, or email planning support staff at San Jose CA.gov and identify your name and phone number that you will call in with and what items you would like to comment on. All members of the public will remain on mute until the individual identifies that they would like to speak and they are unmuted. Planning support staff will identify you by name when it is your turn to speak. At that time, you'll be unmuted and can provide comment for the allotted time. If you exceed your allotted time, you may be muted so that we can move on to the next speaker. Please note the following. For projects on the consent calendar, I will ask if anyone wishes to speak on the item. If a separate discussion is warranted, I will move it to the public hearing portion of the agenda. If a separate discussion is not needed, I will the item will remain on the consent calendar for approval. For items listed under public hearing, I will ask staff to provide a brief report. The applicant or their representative who wishes to speak on the item will have up to five minutes to speak and should identify themselves by stating their name for the record. After the applicant or their representative has spoken, any member of the public who wishes to speak on the item may provide testimony for up to two minutes per speaker for or against the project. All members of the public should identify their name for the record, although this is not required. Following comments from the public, the applicant may make additional remarks for up to five minutes. Public speakers will not engage in a conversation with the hearing officer or staff. The hearing officer's staff and the public are expected to refrain from abusive language. Repeated failure to comply with the code of conduct, uh, which will disturb, disrupt, or impede the orderly conduct of this meeting may result in removal from the meeting. The meeting of the director's hearing will now come to order. Okay. So let's move on to our order of business. So the first after my recital, the first item is uh deferrals. So these are items that are uh on the calendar, but for which deferral to a future meeting date is being requested. Um I will identify the items to be deferred and ask for comments from the audience and specifically on whether or not this item should be deferred. If you want to change any of the deferral dates or speak to the question of deferring these items or other items, please use the raised hand feature in Zoom or click star nine to raise your hand to speak. I will now open the public hearing. So the following items are proposed for deferral. And there is one file number PDA 9806704 and ER220-202. This is a plan to permit development permit amendment for proposing construction of a two-story single-family house and permitting two existing wooden exterior decks on an approximately 2.46 gross acre site located uh 520 feet southwest of Bergman Court and Yerba Buena Avenue. Uh the address is 2569 Knowles Coles Court. Um, the CEQA would be exempt pursuant to set guidelines section 15303 for new constructions or conversion of small structures. The staff recommendation is to defer to September 10th, 2025 per staff's request. Uh, would anyone like to speak on the matter of deferrals? Okay, I am seeing no raised hands. So the uh I will approve the deferral of this item to the September 10th, 2025 director's hearing, and the matter of deferrals is now closed. The next item on our calendar is the consent calendar. Uh, there will be no separate discussion as a reminder on the we have one item on the consent calendar today. Uh the item will be considered is considered routine and will be uh done in one action unless moved to the public hearing for discussion by myself. The public may comment on the entire consent calendar or ask to uh have any item removed and put on public hearing to speak uh specifically to that item. If you wish to speak to the item for uh excuse me, consent today, please use the raise hand feature in Zoom or click star nine. So our consent calendar item today is file number H25008 and ER25044. It's a site development permit to allow construction of one eight-story building with approximately 35,000 square feet of commercial space and an off-street parking establishment for existing office off-site office and future residential visitors and the removal of non-ordnance size, one non-ordinate size tree on an approximately 1.92 gross acre site at the northwest corner of Park Avenue and South Almond Boulevard.
