No public hearing items were heard and there were no public comments on non-agendized items.

Public Comments & Testimony

  • No speakers provided public comment on non-agendized items.
  • No public testimony occurred on agenda items (no speakers on deferral/consent items).

Consent Calendar

  • Approved action minutes from the January 14 meeting.
  • Approved CP25-011 / ER25-096: Conditional Use Permit to allow installation of a new potable water pump station. (Approved unanimously.)

Discussion Items

  • Deferral: CP25-001 / ER25-007 (0 Skyview Drive, San Jose Water Company)
    • Staff (Deputy Director Manira Sandir) stated the conditional use permit for a utility facility requires an additional variance; the item will be re-noticed and is expected to return at the second February Planning Commission meeting.
  • City Council report / policy updates (staff report)
    • Staff reported City Council (Jan 13) approved proceeding with Santa Clara Valley Habitat Plan amendments; environmental analysis is underway and amendments are expected to return in coming months with a Planning Commission recommendation.
    • Staff reported City Council (Jan 13) approved “mega-ordinance” amendments addressing state law changes and streamlining to allow more housing.
    • Staff summarized City Council direction from a housing-focused meeting (Jan 27) regarding SB 79 implementation, including:
      • Direction to move forward with exempting industrial employment hubs (e.g., North San Jose, Edenvale, and other >250-acre employment areas) where they intersect with SB 79 transit areas.
      • Direction to analyze potential exemptions for properties lacking a one-mile walking path to transit station areas.
      • Direction to evaluate historic resources in the SB 79 context, noting recent state changes under AB 130.
      • Direction to explore minimum densities in the downtown core.
    • Commissioner Oliveria asked clarifying questions about an upcoming appeal; staff clarified the Feb 10 item is an appeal of the Planning Commission’s prior decision going to City Council.
    • Commissioner Oliveria expressed a positive view of staff’s SB 79 memo and presentation, stating it improved understanding.
  • Commission calendar / study sessions
    • Staff announced a joint study session with the Housing Commission on the Housing Catalyst Work Plan on Feb 25 (5:30–7:00 PM).
    • Staff stated they are exploring Feb 11 for an SB 79 Planning Commission study session (5:30 PM).
  • Development outcomes / performance metrics
    • Commissioner Casey raised concerns/questions prompted by news about a recently opened project (the “Fay” development) reportedly facing foreclosure and cited an article attributing low occupancy partly to lack of parking; Casey requested the City consider measuring success metrics (e.g., performance of approved projects over time) as part of the General Plan 2040 update process.
    • Staff responded that market conditions may be a major factor and stated that while the City has no parking minimums, developers often still propose parking to obtain financing; staff offered to look into broader impacts.
    • Commissioner Cantrell supported examining the issue and suggested closely evaluating the cost of money/financing timing as a possible driver.
  • General Plan 2040 update (staff update)
    • Staff noted the General Plan review process is ongoing; the next task force/commission meeting is scheduled for March 4, focused on small multifamily development and missing middle housing.
    • Staff stated outreach is somewhat behind schedule and consultants are expected to be brought on board to support open houses over the next 2–3 months.

Key Outcomes

  • Deferred: CP25-001 / ER25-007 (0 Skyview Drive utility facility/CUP; variance needed) to a February meeting; item to be re-noticed. (Approved unanimously.)
  • Approved the consent calendar (Jan 14 minutes; CP25-011/ER25-096 potable water pump station CUP). (Approved unanimously.)
  • Scheduled/anticipated next steps:
