0:50

We have one site plan.

0:51

Mr.

0:52

Trotter, you're up.

0:57

Good afternoon, Supervisor, members of the town board.

1:00

Liam Trotter with the planning department, and I have one site plan to present this afternoon to the board, acting as the board of site plan review.

1:06

The application is Spark Car Wash.

1:09

The subject site is located on the north side of Middle Country Road in between Alexander Avenue and uh Route 347 in Lake Grove.

1:20

It is the vacant parcel between Pep Boys and the New York State DOT highway yard and the proposals for the construction of a new 4,949 square foot car wash with 23 accessory vacuum stations and associated site work.

1:37

So this site will be developed as you can see it's actually a through lot.

1:42

It could it fronts on Middle Country Road and goes all the way north to 347, but the development will only be on the southern half of the site for the new car wash.

1:50

They will be utilizing uh an existing curb cut on 347.

1:54

That used to be for the checkers uh restaurant.

1:58

So they'll be reutil utilizing that curb cut, um, re-establishing a new cross-access drive lane to access the site from 347.

2:07

There'll also be a new curb cut with a right-in and right-out only on middle country road.

2:13

So again, this is the proposed overall site plan.

2:15

Here's a zoomed-in version that you can see.

2:17

So access you'll the on-site traffic will flow through if you come up from Middle Country Road.

2:23

The queue lane begins on in the north side of the building, and then you'll drive south through the car wash, and then you can either exit the site or use one of the vacuum stations that are located on the west side of the building.

2:36

The applicant has agreed to six conditions of site plan approval.

2:40

The first condition is that they obtain the necessary permits from the town building department prior to construction and that the uh any ground sign shall be in monument style with a two to three-foot masonry base, not to exceed a total height of ten feet as per the BZA conditions of approval.

2:55

The second condition is that uh due to the location of the subject parcel uh being within an area of reported northern long-eared bat habitat, all land clearing activities at this site shall only occur during the months of December, January, and February, consistent with the New York State Department of Environmental Conservation Regulations.

3:13

The third condition of approval is that the applicant shall install a tree preservation fence around all trees to be preserved on site.

3:21

The fourth condition is the applicant shall obtain a highway work permit from the New York State Department of Transportation, which they already have.

3:29

The fifth condition is that prior to the issuance of a certificate of occupancy, the applicant shall provide the town with a recorded copy of the cross access agreement with the adjacent lot to the west.

3:40

So the lot to the west, they're gonna obtain a cross access for that curb cut on 347.

3:48

It's the properties are in from the same owner but different corporation names, so in case anyone sells in the future there is that cross access that remains in perpetuity.

3:57

Remain in place.

3:58

Yep, and the last conditions that the storm water pollution prevention plan prepared by Boulder Engineering shall be maintained on site for the duration of construction.

4:08

Um and this is these are the proposed color elevations of the building.

4:12

Does the board have any questions?

4:14

Proposal for any fueling on that site, correct?

4:16

No fueling.

4:16

Just go just straight car wash, yep.

4:18

Okay.

4:19

Question by the board.

4:21

It's a drive-through car wash, yep.

4:24

Question by the board.

4:25

No, I have none.

4:26

Okay.

4:27

Okay, thank you, Mr.

4:28

Trotter.

4:28

  • Lou Debaco (48 Juniper Avenue, Smithtown) expressed strong support for Councilman Thomas Lohmann, noting that the District Attorney cleared him of allegations and praising his character.

Discussion Items

  • Spark Car Wash Site Plan: Liam Trotter of the Planning Department presented a proposal for a 4,949 sq ft drive-through car wash with 23 vacuum stations on Middle Country Road, Lake Grove. The applicant agreed to six conditions: (1) obtain building department permits and adhere to sign requirements, (2) confine land clearing to December–February to protect northern long-eared bat habitat, (3) install tree preservation fencing, (4) obtain a NYSDOT highway work permit (already secured), (5) record a cross-access agreement before certificate of occupancy, and (6) maintain a stormwater pollution prevention plan on site. The board approved the site plan later in the meeting.
  • Parks, Recreation, and Open Space Preservation Fund: A public hearing was held on Local Law #13-2026 to create a non-lapsing trust account for acquiring and maintaining parks, open space, and natural resources. Supervisor Wehrheim introduced the idea of linking the fund to an incentive zoning program; the town attorney confirmed the fund could be structured to accommodate that. No public comment was offered, and the hearing was closed and the law adopted unanimously.
  • Future Public Hearings: The board authorized advertisements for four public hearings on October 22, 2026 at 2:00 PM concerning amendments to building construction fees and inspections (Local Law #14-2026) and fire prevention plan filings and fees (Local Law #15-2026).
