Speaker 1

16:39

Good afternoon, everyone.

16:40

Uh welcome tonight's study session.

16:42

We'll go ahead and I'll go ahead and uh call the meeting to order.

16:45

Thank you for your patience as we waited to get to the time frame of four twenty for a twenty-four hour posting.

16:51

Uh in front of us is an agenda council that uh has been posted, and I have no changes to it.

16:57

Uh I would like a motion to approve the agenda as uh presented.

17:02

So move.

Speaker 2

17:03

Second,

Unassigned speaker

17:03

we

Speaker 1

17:03

have a motion in the second, all in favor.

17:07

Opposed.

17:08

Motion carries.

17:10

Move on to item two, city council agenda for uh October twentieth, which is next Monday evening.

17:16

So the shell will uh roll through that for us.

17:20

So

Speaker 3

17:26

okay.

17:27

So on the agenda under consent, we have minutes from the last study session or and then the October sixth meeting, a few volunteers for the fire department,

Unassigned speaker

17:38

and

Speaker 3

17:38

then the treasurer report is in the packet.

17:41

And then under finance, um we'll have we did not receive any bids for the two off-sale liquor licenses and the one on off sale liquor license, so that would be pulled from the agenda, but we'll have a discussion as to how you would like to proceed forward on that.

17:58

And then um Jodi.

Unassigned speaker

18:01

Uh

Speaker 4

18:01

we'll have first reading of ordinance fourteen oh five and ordinance adapting the revision to the City of Spearfish personnel policies and procedure manual.

18:10

Um the uh policy that you had requested be removed has been removed.

Unassigned speaker

18:20

Looks

Speaker 5

18:21

like I'm up.

18:22

Uh we'll just have a public hearing uh per South Dakota codified law uh about entering into a lease with Northern Hills Amateur Hockey.

18:28

This is a temporary lease.

18:30

Uh, as you remember, we approved uh verbally them last year to move up to Hillsview.

18:34

And we've been working through a lease with them all year.

18:36

Uh we've ran into a couple of stumbling blocks with some legal aspects of a permanent lease.

18:40

So in order to get them up there this year to start using that facility.

18:43

We we're gonna do a one-year temp lease and then work through those legal issues the rest of this year.

18:48

And uh after the public hearing, then we'll ask for you guys to approve the resolution to enter into that lease agreement.

Unassigned speaker

18:55

And

Speaker 6

18:55

then for public works, we have a change order for the chip seal project.

18:59

Uh when I started sweeping the road in preparation of the application of chip seal, a lot of the uh crack sealing was coming out as I swept it.

19:07

So it was recommended that we re uh crack seal the roadway before we apply that chip seal.

19:13

And so that twenty-eight thousand dollar change order is uh for for that expense.

19:18

Then we have a a second change order that will be added to the uh agenda as well uh for the taxi lane project at the airport.

19:26

Uh the amount on that one is a little over twenty-three thousand.

19:29

Um trying to close that project out, and we got a drainage issue with the tie-in to the existing pavement for that tax healing extension.

19:39

Um a bit of an issue to work through with the contractor,

Unassigned speaker

19:43

but uh

Speaker 6

19:43

it's kind of a challenging area and to make sure that uh we only have to do the fix once and then it's gonna work the first time we do it.

19:51

The recommendation from the consultant is that we uh redo that tie-in in concrete.

19:55

And so that's why it's a higher dollar amount.

Unassigned speaker

20:00

And so that's why it's a higher dollar amount and uh recommending that the city uh particip participate in the cost of that because we're getting a better product uh for the solution for that.

Speaker 6

20:07

Um, and uh to go with that too.

20:10

There's not going to be any additional design or CA costs associated with uh that change order as

Unassigned speaker

20:16

well.

Unassigned speaker

20:16

So

Speaker 1

20:17

okay.

20:18

17 was go ahead, David.

Unassigned speaker

20:19

Do you want to somewhere between parks and rec and public works?

Speaker 7

20:22

We'll also have planning and zoning.

20:23

We have a uh preliminary plan for consideration uh submitted by uh Brad Limbo for the legacy ranch it states, and I believe all the information associated with that's included in the packet.

Speaker 1

20:35

Yes, and um I guess just to add to that uh for council, I did have an opportunity to um take a look at the presentation uh that went to planning and zoning last week.

20:46

So I guess I'd advise you just to maybe take about 30 to 40 minutes

Spearfish City Council Study Session – October 15, 2025

The Spearfish City Council held a study session on October 15, 2025, beginning at 4:20 p.m. (after a delay for proper posting) in the Council Chambers. Mayor Senden presided, with Councilors Hafner, Klarenbeek, Myers, and Rath present; Hourigan and Jacobs were absent per the minutes (though the executive session motion listed Jacobs as a seconder). City staff including Administrator Falcon, Attorney Knox, Finance Officer DeNeui, HR Director Mathis, Public Works Director McMahon, and Parks Director Ehnes attended. The session covered approval of the agenda, review of the upcoming regular council agenda, discussion of two ordinances (Personnel Policies and Snow Removal), public comment, departmental updates, and an executive session.

Consent Calendar

  • Agenda Approval: A motion by Myers, seconded by Rath, carried unanimously to approve the agenda as presented.
  • Review of October 20, 2025 City Council Agenda: Staff reviewed items including consent agenda items, first reading of Ordinance 1405, a public hearing for a temporary lease with Northern Hills Amateur Hockey, a change order for the chip seal project, a change order for the airport taxi lane project, and a preliminary plan for Legacy Ranch Estates.

Public Comments & Testimony

Public comment was taken in three segments:

On Ordinance 1409 (Snow Removal):

  • Rose Jarvis (petition carrier from 2010): Expressed concern that the proposed revisions weaken the original voter-approved measure. Argued that the city should use proven techniques (as in other communities) to avoid blocking driveways, rather than an on-call system. Stated that many seniors are physically unable to clear heavy snow and that the city should reallocate budget to snow removal.
  • Micah Peters (239 Lane): Opposed the ordinance change, stating it was not citizen-initiated. Said residents want driveways cleared, not a case-by-case system. Criticized the lack of a detailed snow removal master plan and urged the city to follow the existing ordinance and invest in solutions.
  • Don Snorteland (927 Sunset Drive): Reported that snow removal was good for a few years after the 2010 measure but then declined. Expressed frustration with windrows blocking driveways and said the city does not respond promptly.
  • Janice Huffman (wife of the original petition writer): Noted that many residents remain dissatisfied. Recalled that after the measure passed, removal was effective for a couple of years but then deteriorated. Disputed the city’s use of “snow emergency” for six-inch events and said the call-in system was unworkable due to high volume. Called for more funding if needed.
  • Bill Moths (1204 West Jackson Boulevard): Praised the city’s overall snow removal but objected to windrows blocking driveways. Suggested reducing salt usage to save money for clearing windrows, noting salt damaged his driveway.
  • Additional comments from Micah Peters (second appearance) proposed using snow gates up to six inches and then declaring emergencies, and developing a street-by-street snow plan.

On Ordinance 1405 (Personnel Policies): No public comments were offered.

On Other Issues:

  • Brad Limbo (developer of Legacy Ranch Estates): Asked the council to review recordings of the September 16 and October 7 Planning Commission meetings before the regular session. Noted he had a revised variance to present and expressed concern that prior submissions were not forwarded to boards.

Discussion Items

  • Ordinance No. 1405 – Personnel Policies and Procedures Manual: Mayor Senden reminded that the item had been tabled due to the volume of changes. HR Director Mathis noted the removal of the section on communication with council. City Attorney Knox stated that the chain-of-command issue had been the main roadblock; other changes, including those related to handguns required by state law (effective July 2025), were acceptable. He strongly recommended passing the remaining revisions to achieve state compliance. Council members indicated general agreement and planned further discussion at the October 20 regular meeting.

  • Ordinance No. 1409 – Snow Removal (Chapter 153, Section 011): Attorney Knox explained that the 2010 citizen-initiated measure placed obligations on the city. Proposed revisions aimed to align with efficient and cost-effective practices, primarily modifying subsection D (downtown snow placement), clarifying subsection E (property owner responsibility for sidewalks/crosswalks), and adding subsection F (windrow removal upon citizen request). Public Works Director McMahon added that the operational goal was to work within the current budget; fully complying with the measure would require major budget increases. Councilor Myers asked about cost estimates for alternative methods:

    • Snow gates: $400,000 to equip existing fleet, plus three motor graders with gates (over $1.5 million in equipment) and additional personnel. Gates are most effective for snow under four inches and shift the problem to mailboxes.
    • Plowing to center and hauling away: Took three weeks citywide in 2023; would require significant contractor costs (estimated $1 million more per year historically) and longer response times.
    • Councilor Klarenbeek noted that shifting budget would affect other departments. A discussion followed about safety (operator fatigue) and past challenges.
  • Legacy Ranch Subdivision: During agenda review, staff noted that the preliminary plan has a staff recommendation of denial due to noncompliance with ordinances on adjoining property and interconnectivity. Attorney Knox and Mayor Senden encouraged council to listen to recordings of the September 16 and October 7 Planning Commission meetings to understand both sides.

Departmental Discussion

  • Skatepark Update (Parks Director Ehnes): During a final walkthrough in late August, cracking and spalling (concrete surface separation) were discovered. Grand opening was canceled. CEO of American Ramp Company (ARC) inspected and attributed the issues to inadequate expansion joints. ARC is sending a crew next week to repair all cracks and will provide a three-year warranty (up from one-year). An amendment to the construction contract will be brought forward. Closeout expected mid-November.
  • Main Street and Colorado Avenue Chip Seal Project (Public Works Director McMahon): The project is expected to be completed by the end of the week (weather permitting).
  • Personnel: Two additional staff positions were noted for next year, which may help snow removal.

Key Outcomes

  • Agenda approved unanimously.
  • Ordinance 1405 and Ordinance 1409 will be on the October 20, 2025 regular City Council agenda for further discussion and possible action.
  • Skatepark repairs will commence next week; a three-year warranty will be added via contract amendment. Closeout is targeted for mid-November.
  • Executive Session: A motion by Rath, seconded by Jacobs (noted as absent in minutes – a discrepancy), carried unanimously to enter executive session pursuant to SDCL § 1-25-1(3) for consultation with legal counsel on litigation or contractual matters. The session began at 5:22 p.m. and ended at 6:17 p.m. No additional discussions followed.
  • Adjournment: Motion by Klarenbeek, seconded by Rath, carried to adjourn at 6:17 p.m.
