Speaker 1

0:04

evening, everyone.

0:05

Thank you for uh being here for tonight's uh joint uh city council and planning commission uh special session.

0:12

Um with the uh agenda that's before us, I'm gonna just ask council to take a look at that.

0:18

We have uh an agenda for approval.

0:20

Is there a motion to approve it, please?

Speaker 2

0:22

Move to approve.

Speaker 1

0:24

Second, second we have we have a motion and a second.

0:26

All in favor.

Speaker 2

0:27

Aye

Speaker 1

0:28

proposed that that carries uh item two is some opening remarks.

0:33

So Peter, I'm gonna go go ahead and turn it over to you.

Speaker 3

0:36

Thank you, Mayor, Council members and planning commission members.

0:39

Uh, we've lost one or two, maybe.

0:41

Uh thank you for allowing me to schedule this joint uh study session between the planning commission and city council.

0:47

I think it's important uh to review these two items together uh as the planning commission really serves as an advisory body to the city council on land development and zoning issues.

1:00

So I think this is very appropriate for the two bodies to hear the presentations, uh, hopefully have a good dialogue on these two two items.

1:09

Uh audience, thank you for coming as well.

1:12

Uh refreshments and our d'oeuvres in the back.

1:14

Please help yourselves.

1:16

So uh after uh almost a two-hour planning commission meeting.

1:20

Um, since I saved my voice last night, um full of energy tonight.

1:24

So

Unassigned speaker

1:25

uh

Speaker 3

1:25

just fair warning.

1:27

Whoops.

1:31

Can I click myself?

Unassigned speaker

1:34

No, I think yeah, so

Speaker 3

1:37

okay.

1:39

So okay, I am clicking.

1:42

All right.

1:42

So why are we here tonight?

1:44

Uh certainly

Unassigned speaker

1:46

uh

Speaker 3

1:47

great to have everybody in the same room.

1:49

Uh really appreciate

Unassigned speaker

1:50

that.

Speaker 3

1:51

But the purpose of tonight's meeting is to present um Clarion's uh assessment of Title 15, named land usage of our municipal code.

Unassigned speaker

2:03

Uh

Speaker 3

2:03

with us are Maggie and Elizabeth from Clarion.

2:06

Uh they were retained uh last year to assess our zoning and subdivision regulations.

2:13

Uh Steph will also present uh the draft engineering development standards that will be in the works for a number of years now.

2:21

So we're at the point where they're ready for adoption.

2:25

Uh but I think more importantly is to have a dialogue between the city council and planning commission members uh to just make sure that we're aligned that we're headed the right direction from a very high-level policy issue.

2:39

Um, and I think it's important for the two bodies to be aligned because

Unassigned speaker

2:44

when

Speaker 3

2:45

we review development projects, planning commission is often involved in a recommended recommending body to the city council.

2:52

Tonight uh there'll be no decision made on any of these items.

2:56

Uh, this is simply a study session to uh provide comments to staff to have that dialogue, uh, and certainly to provide any direction if you wish to have any uh changes or additional information.

3:11

First, I just want to spend a few minutes uh discussing like why why are we even doing this?

3:18

Why are land development regulations and engineering development standards important to the community, to staff, and to the planning commission and city council.

3:28

Like, why even bother with this, right?

3:31

So um kind of had this fun slide here.

3:34

I call it vision to implementation ecosystem.

3:38

So I think we're all familiar with our comprehensive plan.

3:41

Comprehensive plan, it has a very high level, is a policy document that establishes goals, right?

3:50

For the physical development of the city and what I would call livability of the city.

3:55

Comprehensive plans don't just address land use issues, they also address economic development, they address housing, uh, they address uh mobility to certain degree, but it's very high level.

4:09

It's really a vision for long-term uh development of the city.

4:14

But we need tools to implement that vision.

Joint City Council and Planning Commission Special Session – March 17, 2026

The Spearfish City Council and Planning Commission held a joint special session on March 17, 2026 (agenda start time 5:30 p.m., though minutes record an earlier call to order at 4:15 p.m.) as a study session to review the Development Regulations Analysis and draft Engineering Design Standards. No formal votes or decisions were made; the session focused on presentations, discussion, and public comment.

Discussion Items

  • Presentation of Development Regulations Analysis: Elizabeth Garvin and Maggie Squyer of Clarion Associates presented findings from an assessment of Title 15 (land usage). They highlighted five objectives: evaluate what works/doesn’t, identify opportunities to implement adopted plans, highlight best practices, discuss regulations for well-managed growth, and outline updates for user-friendly codes. Key gaps included inconsistent zoning districts (e.g., R1, R2, R3 all requiring 8,000 sq ft minimum lot area), lack of consolidated use tables, unclear subdivision procedures, and no administrative adjustment allowance. Three high-impact opportunities were identified: overhaul land development regulations, clean up review procedures, and clarify community growth policies.
  • Presentation of Engineering Design Standards: City Engineer Kyle Mathis and Staff Engineer Abby Larson presented the draft standards, developed over several years. The document covers sections on street design, wastewater collection, water distribution, storm drainage, grading, street lighting, and development process/submittal requirements. Notable updates from the June 2025 draft include an established appeals process, reorganization of Section 800, traffic impact study revisions, and removal of a proposed minimum 10-lot plat requirement. The standards aim to create consistency, protect public safety, and ensure quality infrastructure that the city will maintain. A tentative adoption schedule was outlined, with planning commission review on April 7, 2026, city council first reading on April 20, and potential adoption on May 4, 2026.

Public Comments & Testimony

  • James Sherer (903 Sunset Drive): Asked about zero lot clearance after removal of minimum lot requirement. Staff clarified that only the engineering standards' proposed 10-lot minimum was removed; zoning regulations on lot size remain unchanged.
  • Jayna Watson (52 Pearson Drive): Emphasized that the zoning ordinance is a living document with many updates over years (e.g., downtown parking reductions, CB-1 incentive plan). Asked where engineering standards can be found online; staff responded at spearfish.gov/899/standards-and-specifications.
  • Tate Johnson (2011 Red Oak Circle): Requested a summary of responses to public comments on the draft engineering standards. Staff confirmed a spreadsheet of comments and responses will be posted on the city website.
  • Brad Limbo (1955 Mainland Road): Thanked staff and noted that the 1983 extraterritorial jurisdiction (ETJ) document has not been updated and remains problematic.
  • Joe Jorgensen (1905 Stage Barn Circle): Requested a meeting with developers, contractors, and engineers to review specification changes before adoption. Noted that early subdivisions (Lookout, Jorgensen, Evans) were well-designed.
  • Online chat (Donald Hlava): Asked whether the standards and code rewrite will include adjustments to building setbacks and parking minimums. Wysocki responded that the short answer is yes, but the extent will be determined through the revision process.

Key Outcomes

  • No motions or votes were taken; the session was informational.
  • Staff will proceed with revising Title 15 based on Clarion’s assessment, with a full rewrite expected to take 18–24 months.
  • The Engineering Design Standards are scheduled for adoption on May 4, 2026, pending planning commission and city council approvals.
  • City staff committed to posting the public comment response spreadsheet online and considering a stakeholder meeting before adoption.
  • A discrepancy exists between the agenda (start time 5:30 p.m.) and minutes (call to order at 4:15 p.m.). The minutes also list the meeting date as Tuesday, March 17, 2026, consistent with the agenda date.
