0:11This is the regular meeting of the Board of Public Service for Tuesday, August 26, 2025.
0:18This is a public meeting and there are no lettings today, but we do have one hearing which we will handle at this time.
0:27Hearing number 125688-RH is being conducted pursuant to Section 26.100.030 of the revised code of the city of St.
0:40The purpose of this hearing is to determine whether to revoke the conditional permit numbered as 125688 issued to Grant BP Gasmart to occupy 3182 South Grand Boulevard as a gas station with snack foods and no cooking.
1:00The parties have been notified of the violations of the conditions of this conditional use permit in writing by certified mail along with the posted notice of today's hearing date.
1:11The hearing has been convened in order to address the issues surrounding conditions number one, three, and six.
1:19Condition number one, the windows must be kept clear of clutter with only permitted areas of the windows covered by signs in accordance with city ordinances with these conditions.
1:31Application shall be made for all signs and approved by the office of zoning administrator before installation.
1:39Condition number three, there should be no sale of items that can be used or intended for use as drug paraphernalia as defined in ordinance 68404 or successor ordinances, including but not limited to food scales, glass tubes, disposable lighters with pop-off tops, seal scrubbing pads and screens, rolling papers, ephedrin or pseudoephedron, diet supplements, sleep aids, bath salts, or other substitutes for illegal drugs.
2:14Condition number six, there should be no loaning for which the applicant must post a no loitering sign and enforce it.
2:22The office of zoning administrator had the burden approved the conditional use permit conditions have not been complied with.
2:29After all evidence of the zoning administrator has been presented, the board will ask for additional testimony, if any in support of the revocation.
2:38Then the conditional use holder will be given the opportunity to present evidence.
2:43Lastly, the board will hear other testimony in opposition to the revocation if any.
2:57As you testify, please direct your comments to the board and not to those in the audience.
3:03Members of the audience are asked to remain silent and not coach the witnesses.
3:08During your testimony, members of this board may have questions for you.
3:12Following the hearing, the board will proceed with its regular agenda.
3:16Following the conclusion of the regular agenda, the board will deliberate, discuss, and vote on the hearing.
3:21The board will notify the conditional use holder of its decision by mail in about two weeks.

3:33Item number one, a certified copy of the zoning code of the City of St.
3:39Item two, the conditional use permit numbered as 125688, issued on April 17, 2018 for Grand BP Gasmart, COMA July Julya to occupy 3182 South Grand to operate as a gas station with snack foods, no cooking.
4:03Item 3 Letters dated August 5th, 2025, sent by mail to DBA Grand BP Gasmart COMAR Jalaya at 3182 South Grand Boulevard.
4:22Louis, Missouri 63118.
4:25And Amar Association LLC CO Amar Jalaya at 3182 South Grand Boulevard, notifying the permit holder and the other named entities of the violations of the permit and providing notice of the public hearing regarding revocation of conditional use permit number 125688 to be held on August 26, 2025.
4:54Item 4, photographs dated July 31, 2025 of the indoor and outdoor conditions at 3182 South Grand Boulevard.
5:04Item five, a copy of an email from the zoning inspector Sandra Long to the zoning administrator Mary Hart Burton, dated July 15, 2025 regarding complaints about the permit holder's business.
5:18Item six, a copy of the public notices of today's hearing in the city journal dated August 12th, 2025, August 19th, 2025, and August 26, 2025.
5:33Item seven, a photograph dated August 22nd, 2025 of a sign posted at 3182 South Graham Boulevard, giving notice of today's revocation hearing and of the premise.
5:47An item 8, a copy of a memorandum and related photos dated August 26th from the zoning plan examiner, Sandra Long to the zoning administrator Mary Harburton regarding an investigation of permitted property on August 25th, 2025.
6:05During which violations of conditions one and three were observed.
6:11At this time, the board asked for representative of the office zoning administrator, please come forward and be sworn in.

6:38As of my investigation yesterday, there's still all the signs on the windows still have not been permitted.
6:45The applicant did state he thought the sign company did it in 2017.
6:50And he is still selling black mouth cigars, which he said he thought he could sell them.

7:07Uh the windows kept clear of clutter and only permitted signs and violation number, condition number three, no sale of items used for drug paraphernalia, correct?
7:17He did post his no watering sign outside.

8:41Can you please respond to the violations of the conditions that have been presented today by the Office of the Zoning Administrator?
8:49Yes, uh first and foremost, good afternoon, guys.
8:54I had the business for 13 years.
8:56So I know it's easy to bunch in all the gas stations and stores bunches together, but I work very well with the city.
9:03So I spoke with um Miss Sandra and I explained to her yesterday that we are one 100% willing to comply with everything on the list.
9:12So and I showed her yesterday that when it comes to the windows, I spoke with Anheuser Bush today, which did the windows back in 2017, and they said that they they do the windows all over St.
9:24Louis, including the Enterprise Center, uh, where the blue split, and they said that they do not do permits.
9:29So I also called a signing company uh called Mason Sign, which also said they don't do permits in the city of St.
9:36However, if this is an issue, I have no problem complying.
9:41We can remove them, and I can work with the city with something that can cover the windows.
9:46Uh, the reason the reason I'm um um I showed Sandra you said about the windows is if we remove the signage from the windows, you're basically going to see the storage room.
10:00So it's going to be boxes um and letters and things like that, which which are going to show it's going to be extremely hideous, as well as you could also see behind the register.
10:05So for example, if we remove the signs from the windows, somebody could just stand there, watch the cashiers count money, make safe drops and everything, which is unsafe.
10:14And something that I had bought up uh uh a few years ago with uh Miles uh McConnell office, and they they said, okay, we can keep the signs up.
10:23So that was something I spoke with his office about, and they said, okay, we'll keep the signs up for it because it was uh a safety issue.
10:29But like I said, I'm I'm willing to cooperate with you guys and comply.
10:33We can remove them, that's no problem.
10:35Uh and we can work down the road with some some new types of signage.
10:39Um, as far as the loadering signs, I apologize to Sandra yesterday.
10:43We had them on the inside, and uh, I just moved them outside so they're easier to see because um you can only see them at night time.
10:50You can see them well.
10:51This way we you can see them better.
10:53Um, as far as the anything um cigars and cigarellos commonly used or adapted for uh controlled substances.
11:02We have a sign, I'll show it to uh Monica right here, uh, that we had for five years that says we do not sell blunts, papers, cones, or wraps.
11:10What we do sell are black and miles, which are tipped cigars, and these are not used for us uh any uh we paraphernalia like a cigarello.
11:18So for example, when people see that sign, you I mean, any of you can come stand with me just for an hour.
11:24We have 10, 15 people come every hour and ask if we sell cigarellos or blunts or papers and cones or reps.
11:30I show them that sign, and we have black and miles, but nobody's ever said since since we quit selling them in 2017.
11:37Nobody's ever said, hey, I'll just take a black and miles because it's not the same use.
11:41Whereas a cigarella is filled with fiberglass, these are tobacco.
11:45So these are meant to be smoked, but they're not meant to be empty.
11:47However, like I said, I'm still willing to comply.
11:50If you guys disagree with me on that, you say, hey, we still don't want you selling black and miles, and I'll quit.
11:56But um, as far as the list, black and miles aren't mentioned there because they are meant to be smoked, they're not meant to be broken down like a paper, cone, wrap, or cigarello, which is why I have that sign that sticks for all customers.
12:08We don't sell cigarettes, bunts, papers, cones, or wraps.
12:11So that's something I've been working with the city with uh Georgiana Ekbow.
12:16Uh, I've worked with her for years.
12:17She knows about us with the police department and also with with the Miles's uh Miles in his department.
12:24So if everyone in this building knows that we've always worked with the city, we have no problems complying with you guys.
12:30I know it's easy to bunch in, say, like, well, these are nuisance and that's uh a high traffic area, grand or kings highway or or grave way or whatever, but we we are different.
12:40And I'm and I'll show you guys that we're different, and so that that we don't get bunched in with all those properties.
12:46Um, like I said, I'm willing to comply.
12:48It was uh and as far as loitering, you can you can speak with uh Carl Whitaker, who's the police in charge of our area, or Rachel Witt, they'll tell you when it comes to loitering, panhandling, we're the best in the city.
13:02Our ratings are even higher than the target on Hampton because when when it comes to panhandlers and loaders, we kick them off the light immediately, which is something we have to deal with being on being on a street like Grand or Kings Highway or Gravway, you know, it's just a high high traffic area where people are just non-stop walking up and down the street panhandling.
13:21So or whatever they're doing.
13:23So that's just like our reputation with the city.
13:26We have a very good reputation.
13:27I'm willing to comply, whatever you guys want us to do, we'll do it.
13:30If it comes to the signage, I can work with whoever's responsible for the signage.
13:34We can do a whole new sign.
13:36Um, we can like like I said, Anne Heiser Bush did this one.
13:40So they put the Cardinals logo, the blues logo, uh St.
13:43Louis FC, and then below it, they might have put like Bud Light or Budweiser.
13:47We can completely remove that, just keep like the sports teams or I can make something like the arch or downtown or whatever, just something that is still covers the windows because I'll show these pictures to uh Monica and uh Sandy saw yesterday.
14:03If we remove the signage from the windows, you're just gonna see the backs of boxes, ladders, and it's it's gonna be extremely ugly.
14:10Just as you're looking at instead of looking at the store, you're gonna be looking at storage room, which is how the building was designed.
14:16Um I don't know what else to say.
14:19So I don't I don't uh I don't know.

14:24Obviously, you are passionate, and you came in today and you are talking about all these different things.
14:31So, you know, from my perspective, and I'm gonna give the other directors an opportunity here in just a minute to ask you questions.
14:37So currently you're in violation of two conditions, which is the window signage and the items, uh the cigars and cigarellos.
14:46So a conditional use grants you the opportunity to run a business in an area that's not zoned for a business.
15:00This board uh in the zoning division work really hard to make sure that you're not intrusive on the neighbors that you live with there and the conditions on the permit are the same today as they were when it was granted.
15:08So, you know, I am not gonna sit here and go through a bunch of small details because that's not my forte.
15:16However, uh Sandra Long and Miss Burton, the zoning administrator in the billing division are the experts in these items, and I'm gonna ask you to please listen very carefully when I tell you this.
15:29Okay, please speak to them, Miss Long, Miss Burton, the billing division.
15:35Find out what you need to do to be in compliance, and please get in compliance as soon as possible.
15:43How long do you think it would take you to get in compliance for these two items?
15:48If you spoke to the folks from the city and they told you exactly what you need to do, how quick could you do this?
15:55I mean, if you want me to stop selling the black amounts today, I can I'll throw them in the trash.
15:59I have no problem with that right now.
16:01I'll throw them in the trash.
16:02Um, I really like to me, it doesn't make it doesn't make that much of a difference.
16:07It's just like I said, a black amount is like a cigarette.
16:10So if if you guys want me to quit selling them, I'll just quit selling them.
16:13I really it's not that serious for me.
16:16As far as the windows, like I said, that's not only is it ugly, it's a safety, it's uh very because like I said, uh people can see what you have in your storage area, and that they can just walk in and walk back there and grab whatever they see.
16:29Also, because you could see behind the register, they can just see where where the employees are counting the money, how much money they're counting, and and they can even um they can even just see where where we put our safe jobs.
16:41So I showed that to Sandra yesterday, and if if you guys want me to remove the signs from there, I will, but work with me, tell me what like if I can do some other sign where it's uh clear or tinted or whatever, just for the safety, and just because it looks nice, because if you can see, like I'll show these pictures again to Monica.
16:59If you can see, and I'll if Mary uh Burton is here right now, I'll go show you the pictures and Sandra saw yesterday.
17:05If you can see like what what you'll be seeing, if we remove the signage, it's gonna be really ugly.
17:10It's gonna be a huge eye sore, and uh Sandra can attest to that because I showed her yesterday.
17:16Uh what so again, I would recommend to you you speak to the experts, assuming this board allows you, you know, time to cure, and you make sure that you discuss with them, see what is allowable, what is not allowable.
17:33There's always options, but that's something for you to discuss with them, and then get into compliance.
17:40Uh, assuming again, this board grants you um time to do that.
17:45So at this time, in the interest of time, I'm gonna open the floor from any questions for any of our board directors of our conditional use permit holder.
17:56Yeah, so just a uh comment, and I think Rich may have asked my question about how long it would take.
18:02Um, we've had conditional use holders come in before this board and exude the same level or close to the same level of confidence and assurance, strong assurances that you have 30 days later, or whatever the time frame we provide, they come back and it uh sadly it's almost comical because we'll hear that from Miss Long or someone else, two, three, four, five still in violation, and we have this the similar assurances.
18:31So if you are granted that time period or close to the same time period, it's imperative that you do what you say today.
18:40You you spoke a lot and you said a lot of things, and I appreciate that and respect that.
18:46It's just folks have to do what they're talking about, and they have to do what they're saying in front of this board.
18:52So I just I hope you understand that emphasis on that.
18:57Yeah, yes, I I understand uh Mr.
19:00Greg, but but like I said earlier, it's not just talk.
19:02I've had this business for 13 years, and in the last 13 in the last 13 years, like I said, we are we are one of the best when it comes to the nuisance panhandling.
19:11I can get give you papers from the police department to show that we're we're one of the least called uh businesses in in South City as far as gas stations and stores, but it's like I said, it's it's not just talk.
19:23If you want if you want this done right now, like I said, will you guys literally follow me back to the store and I'll just throw the black amount in the trash?
19:30But like I said, the black and miles are like a cigarette.
19:33If if like if like we're not gonna uh go over the semantics, if you're not happy with them, I'm not happy with them.
19:39We'll get rid of them.
19:40Uh like the windows, I would prefer if we speak with somebody and and they can see because I I don't want to just go with like a razor blade and take off the covering today, and then something happens tonight.
19:51So maybe maybe if I can speak with Mary Burton today or Sandy Long, and we can we can come out with something as far as the windows.

20:30Um to be honest with you, um, I had a meeting with uh Miles McDonnell, and uh there's uh a guy he used to be on the police force, and he works in Miles' office.
20:40So we that's who I spoke with.
20:42This was this was at least a year ago.
20:44So we spoke with him, we spoke about the black and miles, and I explained to him, I said, you know, black and mounts are not meant to be broken down, but not we don't sell like like uh when Sandy took the picture yesterday.
20:54We don't sell any blunts, papers, cones, wrecks, and pipes, anything of that nature.
20:59Nothing like nothing like ashtrays for for cigarettes or anything like that, because to me that's all we peripheral.
21:05So we don't sell anything like that.
21:07I showed I showed the pictures to the gentleman that works with Miles, as well as uh letters from Georgiana Ekbo, Officer Hearns, and the Officer Carl Whitaker.
21:18So I showed that to Miles as far as the signage, they weren't happy with the signage, neither neither was the city, um, the South Grand uh the South Grand uh development with Rachel Witt.
21:30They weren't happy with the windows either.
21:31But when they come came and spoke with me, I showed them.
21:33I said, listen, if we get rid of the Rindle signage, this is what we're gonna deal with.
21:38So the meeting I had with Miles was over a year ago.
21:40The meeting I had with Rachel was like two years ago, and ever since then, we've never had an issue.
21:45Um, and I don't as far as everything else, the we don't have issues with anything else either.
21:50So, like I said, if if you guys want me to remove them today, I can remove them today, but please uh let me let me do with uh Mary Burton and uh Sandralong before I remove them to show them what we'll be dealing with before I remove them because like I said, if I remove them, it's gonna be really ugly and very unsafe.
22:07The black and miles, uh if you tell me right now, get rid of them, we'll do that immediately.
22:12But the windows, if I can work with somebody today, that would be awesome.
22:16Yeah, I think in regards to the black and miles, I think no tobacco is is allowed.

22:36And I I know like I've been I've been in the gas station industry for 20 years, I know black and miles aren't, but like I said, if you if you tell me quit, we'll quit immediately.

23:51Um, in regard to the window coverings, um the condition is not saying that he cannot have proper blinds or curtains in his window.
24:04But the issue is that he's chose to use a sign to cover what's in his window.
24:10Um a sign requires a permit.
24:14Uh nobody can excuse him for from getting a permit for a signs, but he can remove the signage and he can do proper blinds or window coverings on the inside of his windows.
24:27Um, I also want to just inform the petitioner.
24:32Uh, he mentioned Miss Rachel Whitt.
24:34I believe she's the uh uh chairman of the SID for South Grant.
24:38He mentioned that he works with her, but he hasn't spoken with her.
24:41And I'd recommend that he do speak with her because this complaint against his business originated from her office.

32:10We heard from our zoning inspector, Miss Long, that the conditional use holder was still in violation of condition number one about windows having non-permitted signage and condition number three selling items that were could be used as illegal drugs.
32:29We also heard from our conditional youth permit holder who talked about he would work with the board and with the uh departments in order to uh resolve both of these noted issues.
32:43And then I want to note that we had no one at today's hearing that were in support or opposition uh to this revocation hearing.
32:52So with that brief summary, I'll open the floor for any discussion.
32:58I think from my end, it was good to hear that um he'll you know he would have to get a permit for additional signage or replacement signage, but that there's nothing that precludes him from putting up blinds or something like that.
33:14So I'm assuming it will take him some time to procure blinds or whatever uh he would need to block off that window, but it seems like that could be a fairly straightforward easy fix to solve that problem that's correct.

34:40So um, just for my own knowledge, is the issue with the signage something that is literally a fixed to the window.
34:50Um, for example, if if a business owner wanted to put up some construction vapor and just tape it to the window or something like that.
35:00Is that considered signage?
35:07So the definition of a sign is if you offer a good or service on premise.
35:13So that's how those become classified as a sign because he sells Anheuser Busch products on the premise.
35:24Normally we would not encourage people just to put up brown paper, especially the South Grand, because this is a neighborhood that's a walkable neighborhood.
35:35It's got a great streets award.
35:38So that's not really what we want to encourage because you kind of associate the brown paper with vacant storefronts or storefronts that are under construction.
35:48So we would always encourage proper blinds or curtains or window coverings.
35:54There's a variety of things.
35:56There's things that you can get that are somewhat transparent, but black out the sun, or make the windows opaque so that you can't see through.
36:17Studies show that you want the windows open so that you can see people inside and it programs or activates the street.
36:27With all that said, though, there's still nothing stopping him from having proper window coverings in the windows.
36:33It's just that what he has now is a sign, and that requires a permit.
36:37So he has two choices.
36:38He can apply for a permit.
36:41He would probably end up at the board of adjustment because that's probably going to be more signage than that business is allowed.
36:48Or he can remove those signs and do an alternative window covering.
