And in item five, we have 5.1, which is a commission use permit and a design review to establish a retail storefront cannabis business and an administrative use permit to establish a retail non-storefront delivery only cannabis business in an existing 4375 square foot commercial building at 2521 West Lane application number P210602.

Um public hearing is now open.

And is there any disclosures by any commissioners?

Seeing no disclosures, uh, I'd like staff's report before we hear anything else.

Good evening, Chair and Commissioners.

Uh before you this evening is a proposal for a commission use permit, design review, and administrative use permit to establish a retail storefront and retail non-storefront delivery cannabis business in the existing 4375 square foot building at 2521 West Lane.

The proposed location is a developed lot in a commercial general zoning district accessed from West Lane, approximately a third of a mile south of uh East Alpine Avenue on the east side of the Union Pacific Railroad.

Surrounding uses include an automobile collision facility to the north, a tile and stone business to the east, a recycling facility to the south, and railroad tracks directly to the west.

The applicant, Caroline Johnson, is a 2021 general pool winner.

Uh the applicant proposes to utilize the structure for both retail storefront and retail non-storefront delivery uses.

Approximately 74% of the building will be used for delivery operations.

And hours will be from 8 a.m.

to 8 p.m.

for the retail storefront and 8 a.m.

to 7 p.m.

for the delivery portion of the business.

On March 1st, 2022, the City Council adopted ordinance uh 2022 311601 amending the cannabis regulatory program.

However, those new regulations do not apply to this application as this application was submitted and deemed complete prior to the effective date of that ordinance.

So I I do need to be very clear that this is going to be under the formal uh cannabis regulatory program that was pre-existing uh that date.

The applicable program includes a limited expansion of certain cannabis types, including retail storefront.

The ability to apply for this was through a lottery where two winners are selected, a general pool winner and an equity winner.

Again, this applicant is the general pool winner of the lottery, so they are not an equity applicant.

This proposed land use does meet all location requirements, including 300 feet from residential and 600 feet from uh schools, youth centers, child call centers, um, religious facilities, and drug abuse treatment facilities.

The neighborhood context map identifies the subject site uh signified by the star and all parcels within a 600-foot buffer, and that's identified in that purple circle.

That's a 600-foot mark.

Um the project is mainly composed of industrial limited and industrial general uses in that area.

Although there's no uh requirement in the applicable uh code language for this application, uh we are providing a map showing the proposed location and its relationship to other uh approved locations.

The closest cannabis business is also a retail storefront with delivery, and that's about 1.4 miles away.

And you can see that in the in set, that is the Wilson Way location.
