The Stockton Planning Commission met on May 12, 2022, at 5:32 PM and adjourned at 6:15 PM. Four commissioners were present (Brenda Jones, Waqar Rizvi, Jeff Sanguinetti, Gerardo Garcia); three were absent (Anne Mallett, Brando Villapudua, Xavier Mountain). The main agenda item was a public hearing on a request for a use permit and waiver for off-sale of beer, wine, and distilled spirits at a proposed liquor store at 2701 East Hammer Lane, Suite 117.

- Use Permit and Waiver for Off-Sale Alcohol (Item 5.1, P22-0044): The applicant, Chenda Tung (and spouse Vanna Petch), requested approval to operate a liquor store in a commercial center. The site is in a high-crime reporting district (345) where crime statistics are 103% above the citywide average, necessitating a waiver. Staff (Michael McDowell) recommended approval with conditions including security cameras, employee training, and a security guard. Police Department representative Lewis Porta noted that the site itself had only 4-6 reported crimes and that stronger conditions (as proposed) have been effective in reducing problems. The applicants expressed their commitment to security and compliance. There was discussion about whether to continue the item due to the slim commission (only 4 members), as a single 'no' vote would deny the permit. After initially wavering, the applicants chose to proceed. Commissioner Rizvi moved to approve the request as recommended by staff, seconded by Vice Chair Garcia. Commissioner Mountain is absent. Commissioner Risvy. Here. Commissioner Via Pudua is absent. Vice Chair Garcia? Present. Chair Sanguinetti? Yeah. We have a quorum. Thank you. Um, Commissioner Rizby lead us in of Pledge Allegiance. Please join me in Pledge of Allegiance. I pledge allegiance to the flag of the United States of America. So our first item of business tonight will be uh the adoption of the consent calendar. However, item 3.1 has been pulled by city staff, so there really isn't a consent calendar tonight. And so we're gonna move on to public comment item number four. If there's anybody in the audience that would like to speak, now's the time regarding public comments and or if there's any blue cards that have been filled out. We have no blue cards, Chair. Thank you. Okay, I am not seeing anybody wanting to come up and speak at the moment. Um so we're gonna move right to you about this item. Okay, I kind of figured that, but I was so we're gonna move to the public hearings, which will be your turn here in a minute, okay. And that the public hearing part of the program tonight is item 5.1, which is a request for a use permit, and waiver for off-site beer, wine, and distilled spirits at a proposed liquor store located at 2701 East Hammer Lane in Suite 117. Uh planning number P22004, APN 090 5807. Um we're gonna have a staff report first, and then we'll take it from there. Staff, please. Okay. Good evening, Mike McDowell, community development deputy director. As you mentioned, uh the site uh for this evening's presentation is at 2701 Hammer Lane, located in green there at the corner of Hammer and Lorraine. Uh the general plan for this location identifies commercial for the actual site. You can see there's a mix of uses surrounding the site. You've got residential located to the east of the site. I'm sorry, to the west of the site, and you've got industrial located to the north and to the south of the site, and you have some office space located immediately west along the rain. Zoning map additionally calls this site out as commercial general, and then the surrounding use is again very similar as far as they match up with the uses I described for the general plan land use. So the actual uh tenant space, so 117 is the tenant space here. It's with the star, so it's located in the back of the center. If you look at the site today, we're looking basically hammer lane, is is just to the uh bottom of the screen, and then Lorraine to the left of the screen. So with alcohol requests, again, this one's for off-sale alcohol sales. This is general, so this would be beer, wine, and spirits with the request uh for alcohol, as you know, uh it requires a use permit from the commission, and then the proposed liquor store complies with all restrictions and existing sales of uh licenses, and the project site is located within a high crime reporting district, therefore the applicants requesting a waiver, and as indicated in your staff report, I'll get to it as far as the crime. It's located in crime reporting district 34 345.
