The Development Review Commission held a public hearing on September 8, 2026, to consider several use permits, a zoning map amendment, and a code text amendment. The meeting included public comment, discussion, and votes on multiple items. Consent agendas were used to approve several routine items.
Good evening, everyone. Welcome to the September 8th, 2026 Development Review Commission hearing. The development review commission is created to hold public meetings and hearings to provide analysis and recommendations to the city council regarding general land use policies and applications where the commission has a recommendatory power and to render final decision decisions on specified applications where the commission has final decision making power. The development review commission recognizes that the creation of a desirable environment throughout the city for residents, business, and industry is a prime requisite for the interdependence of land values, aesthetics, and good site planning by promoting harmonious, safe, attractive, and compatible development that is therefore considered to be in the best interest of public health, safety, and general welfare. Any person aggrieved by a final decision of the development review commission may file an appeal to the city council within fourteen calendar days after the development review commission has rendered its decision. Development review commission recommendations to City Council are not final decisions. Next to him is Commissioner Stefan Richter, Vice Chair Michelle Schwartz. To my far left is Kendon Young, Commissioner Lynn Spears, and Commissioner Barbara Lloyd. And I am Andrew Johnson. Tonight with us from staff, we have Jeff Tamilovich, Ryan Levake, Michelle Dalki, Diana Kaminsky, Chris Jasper, Robert Mansle, Whitney Mayfield, William Joey Beasley, Joanna Barry, and Jason Wolfe. For members of the public, you'll be given up to three minutes to speak. If you wish to speak on an item tonight, staff will be monitoring that monitoring that time. And we will hear you. Seconded. Seconded by Commissioner Young. All those in favor, please raise your hand. And that passes unanimously. All right. Um we did review and come up with actually two consent agendas this evening. Um due to one of the commission members' uh um abstaining from one item. So if anyone in the public is wishing to speak on one of these items, please get my attention and we can pull that from our consent agenda. I will review our first consent agenda and we'll vote on that, and then we'll review the second consent agenda. So item four C request to use permit to allow an amusement business arcade in the GID zoning district for level up gaming located at 1301 East University Drive Suite 102. Was anyone wishing to speak on this item tonight? Okay, seeing none. Next item on the consent agenda is item four D, request use permit to allow a second story addition to an existing detached garage. A use permit to allow an accessory building over 15 feet in height, and use permit standard to reduce the side yard setback to five feet for Murray residents located at 929 East Driftwood Drive. Is there anyone wishing to speak on that item? Are you the applicant? No. Okay. Um did you fill out one of these comment cards? Yes. Okay, so you're the item that I have you wishing to speak on is item 4B, which is the Chechinelli residence. Yes. That's the one you want to speak on? Okay, you don't want to speak on item 4D, which is the Murray residence. That's 4D for B. Okay. All right. So seeing no one wishing to speak on item 4D, we'll keep that on our first consent agenda. And then uh item 6A is the last in that consent agenda, which would be request of zoning and development code text amendment for section 3-409, group home group homes for adult care, persons with disabilities, and child shelter, and part seven, chapter one definitions for clarifications and related updates in conformance with Arizona State Senate Bill 1473. Was anyone wishing to speak on that item? Okay, so that is our first consent agenda. Um, I entertain a motion for that consent agenda. Motion to approve consent agenda as stated. Okay, so there's a motion for the approval by Commissioner Richter. Is there a second? Second. And that's seconded by Commissioner Lloyd.
