The City of Tempe Hearing Officer, Vanessa McDonald, convened a public hearing on Tuesday, October 6, 2026, at 1:00 PM to consider approval of prior meeting minutes and an abatement request for a code-violating property. No public comments or appeals were filed.
When you are ready, my dear. Good afternoon. Today is Tuesday, October 6th, 2026, and this is the first hearing of the month for the City of Tempe Hearing Officer. My name's Vanessa McDonald, and I I'll be conducting the hearing this afternoon. I'm gonna read something into the record and then we'll go ahead and jump into our really brief agenda this afternoon. The City of Tempe Hearing Officer is authorized by Arizona revised statutes and the City of Tempe Zoning and Development Code. The hearing officer is granted the authority to conduct public hearings to decide upon the abatement of code violations occurring on properties within the city. These violations include deteriorated pool structures or landscaping, storage of junk or refuse, and storage of inoperable or unregistered vehicles. Abatement actions are brought before the hearing officer by the city's code compliance division, typically after numerous attempts at contacting the property owner to obtain voluntary compliance with the code. The hearing officer may issue an order directing the owner, occupant, property manager, or other responsible person to remediate a code violation, or may authorize the city to abate the property to correct the violation. The cost of the abatement is the responsibility of the owner of the property where the violation occurs and will be collected as an assessment against the property in violation of the code. Any property owner who is agreed by a decision of the hearing officer may file an appeal within 14 calendar days after the hearing officer has made a decision. The deadline for appealing any decision rendered today is 3 p.m. on October 20th, 2026. Abatement appeals are heard by the City of Tempe Board of Adjustment, after which they may also be appealed to Maricopa County Superior Court. A property owner has 14 days after the date of the hearing officer's decision to either file an appeal or bring their property into code compliance. If an appeal is not filed or the property isn't brought into compliance within this required 14-day time frame, the property will be abated by the city. The first item on our agenda is a set of minutes from our meeting held on September 15th, 2026. Um I had a chance to review those minutes when they were sent to me right after that hearing, and I believe that they accurately reflect what took place at the hearing. So I'm gonna go ahead and approve the minutes for September 15th, 2026. This brings us to agenda item two A. This is a request for approval to abate public nuisance items at the Brunson property. This property is located at eleven oh eight East Alameda Drive. The applicant is the City of Tempe Code Compliance represented this afternoon, I believe, by code inspector Scott Lean. Come on down. Good afternoon. Good afternoon. Good afternoon. Thank you, Madam Hearing Officer. My name is Scott Lee, and I'm a co-compliance inspector with the City of Tempe Co-compliance Division. I am here this evening to request a hundred and eighty-day open abatement for the property located at 1108 East Alameda Drive, Tempe, Arizona. This case was initiated on May 11th, 2026 for junk trash debris causing infestation of bugs. On May 12th, 2026, I inspected the property and observed weeds in the front and side yards. Also visible was junk trash and debris scattered all over the backyard. Well on site, I contacted the property owner, identified as Scott Brunson. I explained to Mr. Bronson why I was there, and he told me that he would work on cleaning up the property. A correction notice was issued for the observed violations. On May 27, 2026, I re-inspected the property, which was still in violation. A final notice was mailed to the property owner, Mr. Brunson. On June 11, 2026, Supervisor Kowalski and I went to the property and I observed the property was still in violation.
