The Tempe Development Review Commission held its regular hearing on September 13, 2022, beginning at approximately 2:00 PM. The meeting was chaired by Chairman Mike D. Domenico, with Commissioners Spears, Lloyd, Don Cassano, Michelle Schwartz, Vice Chair Andy Johnson, and Alternate Commissioner Chuck Redman in attendance. City staff present included Jeff Tamulevich, Ryan Lebake, Steve Abraham, Separna Daskupta, Diana Kaminsky, Lee Jimenez, Obinia Kingsby II, Joanna Berry, and Eddie Garcia. The meeting consisted primarily of approval of prior meeting minutes, a consent agenda covering four development items, and announcements. No members of the public provided testimony.
Minutes Approval
- The Commission approved the minutes of the August 23, 2022 Study Session and the August 23, 2022 Regular Meeting without changes or edits.
- Motion made by Commissioner Cassano, seconded by Commissioner Lloyd.
- The motion carried 6-0, with Alternate Commissioner Redman abstaining because he was not in attendance at those meetings.
Consent Calendar
- The Commission approved the consent agenda in a single vote, covering the following four items (items 3-6 on the agenda):
- White Castle Drive-Through Restaurant (PL220183): A Development Plan Review for a new 3,018 square foot drive-through restaurant at 8755 West Warner Road and South Jewel Street. Applicant: Kimley-Horne and Associates. Project Planner: Diana Kaminski.
- Bonarden Lane 8 Homes (PL210111): A Use Permit Standard to reduce the front yard setback from 20 feet to 18 feet in the R-4 District, and a Development Plan Review for a new three-story single-family residential development consisting of eight units at 1432 and 1435 South Bonarden Lane. Applicant: Palmer Architects, Ltd. Project Planner: Diana Kaminski.
- Tempe Emmanuel Lutheran Church (PL220035): A Use Permit to intensify an existing private school; a Use Permit Standard to increase the maximum allowed building height from 30 feet to 33 feet; and a Development Plan Review for a new two-story building of approximately 12,850 square feet at 715 West Southern Avenue. Applicant: Sketch Architecture Company. Project Planner: Obenia Kingsby.
- Elbo Smoke Shop (PL220199): A Use Permit to allow a tobacco retailer at 3121 South Mill Avenue. Applicant: Elbo Headshop, LLC. Project Planner: Lee Jimenez.
- Motion made by Vice Chairman Johnson, seconded by Commissioner Spears.
- The consent agenda was approved unanimously, 7-0.
Public Comments & Testimony
- The Chair asked whether anyone from the public had questions or concerns on the four consent agenda cases. No members of the public requested to be heard, and nothing was received from online participants.
Announcements
- Commission Member Announcements: Commissioner Cassano noted that the meeting room's presentation screens are touch-screen interactive, allowing documents to be manipulated by touch rather than by mouse.
- City Staff Announcements: Staff informed the Commission and public that the next Development Review Commission meeting is scheduled for October 25, 2022, with the agenda to be published three weeks prior to that date. Staff also noted that one case is expected at the next meeting involving the Orange Guadalupe Cemetery.

Welcome everybody to the September 13th, 2022 Development Review Commission hearing. The purpose of the Development Review Commission has been created to hold public meetings and hearings to provide analysis and recommendations to the city council regarding general land use policies and applications where the commission has recommendatory power and to render final decisions on specified applications where the commission has final decision making power, including but not limited to all aspects of a proposed and future development. The development review commission recognizes that the creation of a desirable environment throughout the city for residents, businesses, and industry is a prime requisite for the interdependence of land values, aesthetics, and good site planning by promoting harmonious, safe, attractive, and compatible development that is therefore considered to be in the best interest of public health, safety, and general welfare. Any person aggrieved by a final decision, a final decision of the development review commission may file an appeal to the city council within 14 calendar days after after the development review commission has rendered its decision. Development review commission recommendations to the city council are not final decisions. Today, uh in attendance uh from staff, we have uh Jeff Tamulevich, Ryan Lebake, Steve Abraham, Separna Daskupta, Diana Kaminsky, Lee Jimenez, Obinia Kingsby the second, Joanna Berry, and Eddie Garcia. Um with us uh here tonight from the commission. Uh I'm Chairman Mike D. Domenico, and starting from our left, alternate commissioner Chuck Redman, Commissioners Spears, and Lloyd, and Vice Chair Andy Johnson, Don Cassano, and Michelle Schwartz. And all of that will probably take longer than the rest of the meeting. What we just went through. Uh in our pre-session or study session, we had a chance to go through uh the minutes of the study session and regular meetings uh dated August 23rd, 2022. There were no changes or edits. I will entertain a motion for approval of those two sets of minutes. Chairman. Commissioner Cassano. I would make a motion for approval of the development review commission study session, minutes of August 23rd, 2022, and the regular meeting, minutes of August 23rd, 2022. Thank you. And let the record show that the motion carried six to zero with uh alternate commissioner Redman abstaining uh since he was not in attendance for those meetings. Uh that brings us to our consent agenda. It's the intention of the commission to pass all the remaining items uh listed on tonight's agenda as items three, four, five, and six in a single vote for approval as a part of the consent agenda.
