Um welcome to the October twenty-fourth, twenty twenty-three development review commission hearing.

The development review commission is created to hold public meetings and hearings to provide analysis and recommendations to city council regarding general land use policies and applications where the commission has recommendatory power and to render final decisions on specified applications where the commission has final decision making power, including but not limited to all aspects of a proposed and future development.

The development review commission recognizes that the creation of a desirable environment through the city throughout the city for residents, businesses, and industry is a prime requisite for the interdependence of land values, aesthetics, and good site planning by promoting harmonious, safe, attractive, and compatible development that is therefore considered to be in the best interest of public health, safety, and general welfare.

Any person aggrieved by a final decision of the development review commission may file an appeal to the city council within fourteen calendar days after the development review commission has rendered its final decision.

Um I guess I could give you a little history on the project, uh, and then we could focus on actually what the request is.

Uh we purchased the property uh about two, two and a half years ago.

Uh we met with staff.

Staff was uh shared their preference that uh even though we're hard zone for up to 10 units on this particular property, they prefer to see single family detached housing.

So uh we looked at it and and just dropping four houses to fronting to the alley and to fronting to maple just seemed underwhelming.

And we don't like to do underwhelming, so we went about figuring out how we could do something better.

So you you can't get past the full premise that you have to have homes fronting the alley, and you have to have homes fronting maple, but we thought a tract, a landscape tract uh through the middle uh from maple to the center of the property where we would construct a pergola uh with a a fire pit and string lighting, um, and again continue uh the sidewalk of the landscaping uh through to the alley would provide a sense of community, um, something architecturally and aesthetically pleasing from the curb.

Uh, and again, give you know those neighbors uh a place to to join, have a glass of wine, enjoy a fire uh on a you know cool evening, uh those when we have them.

So uh to make all that happen, uh we needed uh some slight.

I don't want to say variances, I've been corrected more than once.

We need uh you know a use permit.

We are just north of the northeast corner of 13th and maple.

Um you can see we're just we're it's a 16,750 square foot lot, just under you know, 0.4 acres.

Again, it is zoned for up to 10 units.

Apparently, um we encroach on maple one foot into the 20-foot uh front yard setback.

Uh the way it's written is we need to ask for a use permit that allows up to 20% variance, so that brings it down to 16, but we are only encroaching on the second story upstairs one foot into the 20 foot, which is allowed and preferred uh there on maple.

We're not encroaching into it at all on along the alley.
